A RESOLUTION OF THE HISTORIC PRESERVATION
COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA
QUALIFYING ADMINISTRATIVE APPROVAL ITEMS FOR ROUTINE
MAINTENANCE EXCLUSIONS
WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph
County, Indiana (the "Commission") exists and operates under Article 13, Section 21-13 of the
South Bend Municipal Code and Chapter 154, Section 246, et. seq. of the St. Joseph County,
Indiana Code of Ordinances ("Enabling Ordinances"); and
WHEREAS, these Enabling Ordinances establish the powers and duties of the
Commission, which include the power to oversee modifications performed on designated
Landmarks and Historic Preservation Districts through the Certificate of Appropriateness
("COA") review process; and
WHEREAS, the Commission shall issue a COA prior to the construction,
reconstruction, alteration, demolition or moving of any exterior feature of any building,
structure or use; and
WHEREAS, the Enabling Ordinances direct the Commission to adopt bylaws for
carrying out its powers and duties, which include the aforementioned COA process; and
WHEREAS, Article 9.5, Section 1 ("Staff Procedures") of the Commission Bylaws
authorize staff to determine if applications are exempt from COA review for work limited to
the ordinary maintenance and repair of any building, structure or use which will not involve a
change in any exterior features of the property; and
WHEREAS, the Bylaws Article 2, Section 3a ("Code of Ethics — Responsibility to the
Community") encourages that the Commission and its designated Staff representatives
continually evaluate and update theirs plans, guidelines and procedures to ensure they meet the
community's current and future needs.
NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION
COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY AS FOLLOWS:
I. The Historic Preservation Commission hereby affirms that the following work,
examples and conditions qualify as and/or for Routine Maintenance Exclusions,
and may be administratively approved by the Executive Director, Deputy or
Commission President (Bylaws Article 9.5 Section 1):

a. MATERIAL
i. The use of an appropriate architectural epoxy is permitted for
restoring damaged, original material (esp. character -defining
features, old-growth wood and metal).
ii. Sections of incompatible siding may be temporarily removed to
evaluate the condition of the siding underneath.
b. WINDOWS
i. Inappropriate, fixed storm window units may be removed.
ii. Appropriate, wood storm window sashes may be installed at
missing locations.
iii. Interior storm windows that do not detract from existing window
units, may be used.
c. ROOFS
i. Architectural shingles may be substituted for three -tab asphalt
varieties.
ii. Rooftop heating elements for snow and ice dam mitigation, may be
installed at approved locations.
iii. New gutter sections may be installed at inconspicuous and
specified locations.
d. MECHANICALS
i. Exhaust vents and plastic piping for Natural Gas, LP or Radon
systems may be installed at specified, unobtrusive locations.
e. AMENITIES
i. Installations of small-scale and appropriate amenities, including:
Plaques, Address Signs, Historic Markers, Mailboxes, Flower
Boxes, Light Fixtures, Sconces, Flags and similar items are
permitted.
L FENCES
i. Changes in mounting post and gate locations, within previously
established perimeters are permitted.
ii. Alternative wooden picket styles that are in keeping with
applicable Standards and Guidelines, are permitted.
g. TREES
i. A severely damaged, diseased or structurally intrusive tree
specimen may be removed if a suitable replacement will be
substituted in situ.
ii. Different tree varieties may be substituted if original species are no
longer available or appropriate for the specified location.
iii. New trees (for removed specimens) may be planted in nearby,
alternate locations whenever the original location is deemed
incompatible.

h. TRAILERS & EQUIPMENT
i. Staff shall approve staging locations for temporary or mobile
construction equipment used in the maintenance and improvement
of designated sites and structures.
2. Conditions for Routine Maintenance Exclusions:
a. All criteria must be evaluated against local standards and guidelines and
stylistic appropriateness. Allowances and conditions for Routine
Maintenance Exclusions must be validated in writing on approved
departmental forms by a qualified Commission administrator.
b. The Commission reserves the right to qualify work as a COA petition if
reasonable exceptions to the existing material, form, function, dimensions
or compatibility, are identified.
c. This resolution in no way limits the Commission's authority where
otherwise provided by law nor should it be seen as a means to contradict,
hamper or avoid local building and zoning regulations.
d. This resolution shall not be construed to prevent the necessary
maintenance required to preserve the building, structure or its use from
deterioration by neglect.
e. This Resolution shall take effect immediately upon its adoption by the
Commission.
