Brookfield St. to First East/West Alley (Preliminary Review) Dear Ms. Morocho: At its September 28, 2021 meeting, the Board of Public Works reviewed comments by the Engineering Division, Community Investment, Fire Department, Police Department. It was determined that the alley vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient and that it would hinder the use of a public right of way by the neighborhood in which it is located or to which it is contiguous, per I.C. 36-7-3- 13. The Department of Community Investment also noted the vacation did not meet the requirements of the City’s current subdivision ordinance. Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of this alley. If you have any further questions, please call this office at (574) 235-9251. Brookfield Street _____________________________________________________________________________________________________________ PLEASE INSERT YOUR RECOMMENDATIONS IN THE APPROPRIATE FIELD BELOW, BASED ON THE FOLLOWING I.C. 36-7-3-13 CRITERIA: 1.The vacation would/would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. 2.The vacation would/would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. 3. The vacation would/would not hinder the public’s access to a church, school or other public building or place. 4.The vacation would/would not hinder the use of a public right-of-way by the neighborhood in which it is located or to which it is contiguous. PUBLIC WORKS: No objections, pending the applicant agrees to hire a bonded contractor, that obtains a permit from Engineering, to tear out the alley approach and replace the curb. They may not utilize the vacated alley as a driveway because it would be splitting two properties. Access to the garage in the back of the house would only be able to be accessed via the North/South alley. COMMUNITY INVESTMENT: Unfavorable 1. The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. 2. The vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient. 3. The vacation would not hinder the public’s access to a church, school or other public building or place. 4. The vacation would hinder the use of a public right-of-way by the neighborhood in which it is located or to which it is contiguous. Note: The subdivision ordinance requires a mid-block connection for any lot of 600’ or greater. This block is greater than 600’, so the mid-block connection should be retained.
