HomeMy WebLinkAboutResolution No 31-2021 - Donation of Equipment (150) RFID BadgesRESOLUTION NO. 31-2021 A RESOLUTION OF THE SOUTH BEND INDIANA BOARD OF PUBLIC WORKS APPROVING THE DONATION OF POLICE PROPERTY WHEREAS, the City of South Bend, Indiana Board of Public Works (the “Works Board”) has exclusive control over personal property held by the South Bend Police Department (the “SBPD”) pursuant to Ind. Code § 36-9-6-1; and WHEREAS, I.C. § 5-22-22-1 permits and establishes procedure for disposal of personal property which is no longer needed by the City or which is unfit for the purpose for which it was intended; and WHEREAS, the SBPD possesses certain property, namely: used One Hundred Fifty (150) RFID Badges which have been retired from use; and WHEREAS, Aaron M. Knepper, an employee of SBPD, has made known to the SBPD the significant need for police and emergency services equipment for use by a smaller emergency response departments for the provision of emergency services; and WHEREAS, the SBPD wishes to gift, under the supervision of and with the assistance of the St. Joseph County Communications Center (PSAP), to such smaller emergency response departments (the “Donees”) all of which service areas located in the City of South Bend; and WHEREAS, I.C. § 5-22-22-8 states that personal property may be deemed worthless if the sale or transportation of such personal property would cost more than its value and allows for the disposition of such personal property at the discretion of the City; and WHEREAS, City staff has determined that the cost of discarding the property would be more than its value. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND, INDIANA BOARD OF PUBLIC WORKS AS FOLLOWS: 1. The Works Board hereby approves the donation and transfer of the one hundred fifty (150) RFID Badges from the SBPD to the Donees and authorizes staff of the SBPD to work with the PSAP to carry out any and all actions necessary to facilitate the transfer. 2. This Resolution will be in full force and effect upon its adoption by the Works Board. ADOPTED at a regular meeting of the City of South Bend, Indiana Board of Public Works held on September 14, 2021. SBPD Liability Release and Waiver Liability Release and Waiver I, __________________________________, intend to use equipment, property, or facilities (“equipment”) owned and/or operated by the South Bend Police Department (“SBPD”). SBPD is donating said equipment to: , with the transfer taking place without exchange for any consideration. Said equipment is more expressly identified as: In consideration for the transfer and use of the equipment, I expressly agree to and acknowledge the following: 1.For myself and on behalf of my heirs, administrators, successors, and assignees, I voluntarily waive, release and hold harmless the City of South Bend and SBPD, their employees, agents, instructors, boards, officers, suppliers, and representatives, from any claim, suit, cause of action, cost or expense that I might have due to negligence, personal injury, death, property damage, or loss, known or unknown, arising either directly or indirectly from my use of the equipment. 2.This Liability Release and Waiver shall be governed by and construed in accordance with the laws of the State of Indiana and the parties agree that in any action, venue shall lie exclusively in St. Joseph County, Indiana. 3.If for any reason, any provision of this Liability Release and Waiver is held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision hereof, and this Liability Release and Waiver shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. I have read this Liability Release and Waiver Form, which is a waiver of ALL liability, fully understand its terms, understand I have given up substantial rights by signing it, and have signed it freely and voluntarily without any inducement, assurance or guarantee being made to me and intend my signature to be a complete and unconditional release of ALL liability to the greatest extent allowed by law.
