The May 10,2004 meeting of the Zoning and Annexation Committee was called to order
by its Chairperson,Council Member Ervin Kuspa at 3:53 p.m. in the Council Informal Meeting
Room.
Persons in attendance included Council Members Dieter,Kelly,Puzzello,Pfeifer,
Varner,Kuspa,White,Coleman and Kirsits; City 1111Schalliol Carldl,ittrebh Planner Director Myers,
Gary Gilot,Bernie Feeney,Robert L. Gummer,
Rita Kopola,Terry Bland of the' ixfl`gtnh'rthunr and Kathleen Cekanski-Farrand,Council
Attorney.
Council.Member Kuspa noted that the Zoning and himself.xation Committee Members

Council Member Kuspa stated that the first item

Council Member Kuspa noted that the next item on the Committee's agenda was Bill No.
14-04 which is a rezoning request for the property located at the southeast corner of Ironwood
Road and Inwood Road.
Jeff Myers,a Planner with Area Plan,noted that the Area Plan Commission held a public
hearing on April 20,2004 and sends Bill No. 14-04 to the Council with a favorable
recommendation. Mr.Myers stated that the new zoning ordinance became standards way 7th,
and that the petitioner has the option of developing either under

In response to a question from Dr. Varner,Mr. Gummer noted that there has been a
reduction in the density from the 1997 proposal.
Council Member Kuspa opened the hearing to the public. No one spoke in favor of the
proposed bill.

Committee Report
Following further discussion, Council Member Punnello made a motion, seconded by
Council Member Kelly that Bill No. 14-04 be recommended favorably to the Council. The
motion passed.
Council Member Kuspa then called for a presentation on Substitute Bill NO. 18-04
which is a proposed rezoning request for the property located approximately 195' northeast of
the intersection of Prairie Avenue and Locust Roads on the sourtherly side of Prairie Avenue.
Jeff Myers, a Planner with Area Plan,noted that the Area Plan Commission held a public
hearing on April 20, 2004 and sends Substitute Bill No. 18-04 to the Council with a favorable
recommendation. Mr. Myers noted that the petitioner has the option of developing either under
the former standards which were in place at the time of filing the rezoning petitioner or under
the new regulations.
Bernie Feeney of Lang,Feeney&Associates,Inc. made the presentation on behalf of the
petitioner Woodhaven LLC. He provided a preliminary site plan of the area in question. He
noted that the rezoning is being requested so that a self-serve car wash and a small retail center
could be developed. The total site to be rezoned is 2.76 acres.
Council Member Kuspa opened the hearing to the public. No one spoke in favor of the
proposed bill.
Council Member Kirsits noted that there is a great deal of traffic in this area and along
Ewing, SR 23,and Prairie and inquired whether the petitioner had had discussions with the
Department of Public Works with regard to a traffic light since he believes that only a blinking
light is now located in the vicinity.
Mr. Feeney stated that the entrance is as far away as possible from the intersection and
that discussions with the Engineering Department are ongoing.
Dr. Varner asked how far the site is from Ewing, and Mr. Feeney noted that it is 400'
closer to the corner store.
Carl Littrell, City Engineer,noted that the site lines should improve in light of the plans
to lower the hill; and added that sidewalks will also be constructed.
Council Member Kelly then made a motion, seconded by Council Member Coleman that
Substitute Bill No. 18-04 be recommended favorably to Council. The motion passed.
Council Member Kuspa noted that the last item on the agenda is Bill No. 19-04 which is
a proposed rezoning request for the property located at 416 West LaSalle. A letter dated May 4,
2004(copy attached)was sent to the Council from James McCune requesting that the Bill in
question be withdrawn from further consideration.

There being no further business to come before the Committee,Council Member Kuspa
adjourned the meeting at 4:05 p.m.
