1 Zoning anti annexation (Committee
The February 24, 2003 meeting of the Zoning and Annexation Committee was called to order by
its Chairperson, Council Member Ervin Kuspa at 4:32 p.m. in the Council Informal Meeting
Room.
Persons in attendance included Council Members Varner, Pfeifer, Coleman, Kirsits, Aranowski,
King, Kuspa and White; Larry Magliozzi, Marsha Adelman, John Oxian, Terry Bland of the
'+olltii gtibUnt and Kathleen Cekanski-Farrand,Council Attorney.
Council Member Kuspa noted that the Council Members present who are on the Committee include
Dr. Varner, Council Member Coleman and himself. Council Member Kuspa then called for a
presentation on Bill No. 03-20 which addresses the fiscal plan and establishes a policy of
providing services to an annexation area in German Township commonly referred to as the Villas
at Lake Blackthorn II Annexation Area. He also suggested that this Bill be combined for purposes
of public hearing with substitute Bill No. 2-03 which is the proposed ordinance for the same area.
Larry Magliozzi of Community & Economic Development made the presentation on Bill No. 03-
20. He noted that 2.81 acres are addressed in the proposed fiscal plan with the area being located
on the east side of Orange Road north of Brick Road. There is one (1) house currently located on
the subject property which will be zoned "A" single family and will become part of the 1st
Councilmanic District. The area will become part of Police Beat 22 and will be primarily serviced
by Fire Station# 11.
Marsha Adelman then made a presentation on Bill No. 2-03 which is the zoning ordinance. She
noted that this will add eight(8) additional lots to the 107 lots previously addressed by the Council.
She added that tax abatement is critical to these lots be marketed.
Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill
No. 03-20 and Substitute Bill No. 2-03 be recommended favorably to Council. The motion
passed.
• Council Member Kuspa then called for a presentation on Bill No. 03-21 which addresses the fiscal
plan and establishes a policy of providing services to an annexation area in German Township
commonly referred to as the Slah and Cynthia Hilal II Annexation Area. He suggested that this
Bill be combined with Bill No. 8-03 for purposes of public hearing since the proposed ordinance
addresses the same area.
Larry Magliozzi made the presentation on Bill No. 03-21. He noted that 3.2 acres are addressed in
the proposed fiscal plan with the area being contiguous property Y in German Township to the City
of South Bend. There is one single-family home located on the property and it will become part of
the 1st Councilmanic District. The area will become part of Police Beat 22 and will be primarily
serviced by Fire Station# 11.
There was no presenter available for Bill No. 8-03. Council Member Coleman then made a
motion, seconded by Dr. Varner that Bill No. 8-03 be tabled until the end of the Committee
meeting. The motion passed.
Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill
No. 03-21 be recommended favorably to Council. The motion passed.

Council Member Kuspa then called for a presentation on Bill No. 6-03 which would designated the
structures and real property located at 1021 Portage Avenue as a local historic landmark.
Mr. John H. Oxian, Historic Preservation Commission President, made the presentation. He
noted that the property contains the old Axtell house which is Queen Anne style and is ranked
"S 12". He noted that the owners of the property will be here this evening to speak in favor of the
designation.
The Council Attorney inquired whether Mr. Oxian or any of his staff had filed the HPC staff
review and recommendation, the location map and current photographs of the property with the
City Clerk's Office.
Mr. Oxian stated that he had not filed those documents, noting that his wife now types the
documents. He noted that he did have the survey card for the property however.
After discussion on whether Mr. Oxian could provide the necessary documents by this evening,
Council Member Coleman made a motion, seconded by Dr. Varner that Bill No. 6-03 be
recommended favorably to the Council subject to the filing of the required documents with the City
Clerk's Office. The motion passed.
Council Member Kuspa noted that he received today a letter from Karen R. Hammond-Nash,
Director of the Historic Preservation Commission requesting that Bill No. 87-99 addressing the
proposed local historic landmark designation for the natatorium located at 1040 West Washington
be postponed until April.
Council Member Pfeifer stated that she has been working since 1999 on the "Save the Natatorium
Committee". They will have a business plan in March and therefore recommended that the Bill be
continued until the April 28, 2003 meeting.
Council Member Coleman made a motion, seconded by Dr. Varner that Bill No. 6-03 be continued
until April 28,2003. The motion passed.
Under miscellaneous business, Larry Magliozzi noted that Area Plan will be initiated a zoning
ordinance next week for property in the Copperfield Annexation area which addresses duplexes. A
meeting on the Cooperfield Annexation will take place on Thursday, February 27th at 7 p.m. At
Jackson Middle School. An informational brochure has been prepared for that meeting.
Mr. Magliozzi noted that they were unable to contact Mike Danch the presenter of Bill No. 8-03.
There being no further business to come before the Committee, Council Member Kuspa adjourned
the Committee meeting at 4:55 p.m.
