HomeMy WebLinkAbout03-10-03 Zonning & Annexation Committee port ZQtttttg and tttttexatton Committee The March 10, 2003 Zoning and Annexation Committee was called to order by its Chairperson, Council Member Ervin Kuspa at 3:15 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members Aranowski, Pfeifer, Kelly, Coleman, Kuspa, White, Varner and Pfeifer; Larry Magliozzi, Area Plan Assistant Director John Byorni, Historic Preservation Commission President John Oxian, Wayne Doolittle, Michael Danch, Citizen Member Isabel Gonzalez, Marc Nelson of the St Joseph County Health Department, Dennis Whitacker, Larry Steele, Terry Bland of the mind Vend. 'Craning and Council Attorney Kathleen Cekanski-Farrand. Council Member Kuspa noted that the Zoning and Annexation Committee members include Council Members Kelly, Varner, Coleman and himself. Council Member Kuspa then called for a presentation on Bill No. 8-03 which would annex and bring within the city limits of South Bend certain land in German Township which is contiguous to the city for Salah&Cynthia Hilal II commonly known as 52447 Portage Road. Michael Danch of Danch, Harper & Associates, Inc. made the presentation and provided an annexation diagram to the Committee (copy attached). He noted that last year the western portion of the Hilal property was brought into the city limits. This bill would bring in the front portion of their property which now meets the contiguity requirements of the annexation state law. Following discussion, Council Member Coleman made a motion, seconded by Council Member Kelly that Bill No. 8-03 be recommended favorably to Council. The motion passed. Council Member Kuspa then called for a presentation on Bill No. 1-03 which is a zoning request for the property located at 742 East Ireland Road. John Byorni, Assistant Director of Area Plan noted that the proposed zoning request received a favorable recommendation from both the staff and the Area Plan Commission. Michael Danch of Danch,Harper&Associates, Inc. made the presentation and provided a copy of a preliminary site plan to the committee (copy attached). He noted that the house on the property would be removed and that an MFB Financial Bank building would be constructed which would have a drive-thru. Dr. Varner, the District Council Member where the bank is proposed stated that it would be a very good proposal for this location. Following discussion, Dr. Varner made a motion, seconded by Council Member Coleman that Bill No. 1-03 be recommended favorably to Council. The motion passed. Council Member Kuspa then called for a presentation on Bill No. 3-03 which is a zoning request for the property location at 2701 Northside Boulevard. John byorni, Assistant Director of Area Plan noted that the proposed zoning request received a favorably recommendation from both the staff and the Area Plan Commission. 0 200 _' - ____■//111.11411111111111111111 3 1 Zoning and Annexation Committee March 10, 2003 Page 2 In response to a question from Dr. Varner, Mr. Byorni noted that the property is located behind Nuner School. Tiberius Mihalache, the Petitioner, made the presentation. He noted that the condition of the real property is currently in "bad shape". He stated that he would construct a "high end" multi-family multi-family residential building. Dennis Whitacker, the President of the River Park Neighborhood Association, spoke in favor of the rezoning. He noted that the River Park Neighborhood Association Board voted to endorse the plan, noting that it is directly across from the Partnership Center. He concluded his remarks by stating that the development would be a positive improvement for the neighborhood. Council Member Kelly noted that he is the District Council Member where the proposed rezoning request is located. He stated that he concurs with the remarks made by Mr. Mihalache and mr. Whitacker and that the development has the solid backing of the neighborhood. Following discussion, Council Member Kelly made a motion, seconded by Dr. Varner that Bill No. 3-03 be recommended favorably to Council. The motion passed. Council Member Kuspa then called for a presentation on Bill No. 11-03 which is a request to establish an Historic Landmark for the structure and real property located at 130 Park Lane. Mr. John Oxian, President of the Historic Preservation Commission, made the presentation. He =� noted that the building is referred to as the "Junior League House" and is currently owned by Memorial Hospital. It depicts Colonial revisited architecture and is ranked "S 12". Documentation was then provided to the Committee which include copies of the handwritten HPC l Staff Report,minutes from the HPC meeting and pictures of the buildings. Mr. Oxian noted that if the buildings are moved in the future that language in the ordinance would designate that they would retain their Historic Landmark status. I I The Council Attorney questioned the purpose of the language in Section 3 of the ordinance. i Council Member Coleman also questioned the language in Section 3 of the ordinance. He asked if there was any precedent for the language proposed in Section 2 addressing a future move of the structures. Dr. Varner noted that the building moved to Devon Circle included language similar to Section 2. Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill No. 11-03 as to be amended be recommended favorably to Council. The motion passed. Council Member Kuspa then called for a presentation on Bill No. 12-03 which is a local historic landmark request for the structures and real property located at 1114 Lincolnway West. Mr. Oxian made the presentation. He noted that the structure is one of the finest examples of a Queen Anne house. He then provided the HPC report dated January 15, 2002 on the Secor House and copies of pictures of the building. Following discussion, Council Member Kelly made a motion, seconded by Dr. Varner that Bill T____ 0 200 . . . . iiceen4 and Annexation Committee March 10. 2003 Page 3 No. 122-03 be recommended favorably to Council. The motion passed. P Council Member Kuspa then called for a presentation on Bill No. 13-03 which is a request to designate the property at 833 Northside Boulevard as an historic landmark. Mr. Oxian made the presentation. He stated that the bill would designate the two (2) street lights which are currently in front of the old Sollit Construction Building as historic landmarks. He provided the HPC staff report dated February 15, 2002 to the Committee (copy attached) and provided copies of pictures of the subject street lights(copy attached). He noted that the lights may be moved sometime in the future but currently then are owned by John Friedline. The Council Attorney was asked to prepare the necessary amendments to the Bill for this evening's meeting. Following discussion, Dr. Varner made a motion, seconded by Council Member Coleman that Bill No. 13-03 as to be amended be recommended favorably to Council. The motion passed.
