HomeMy WebLinkAbout07-14-03 Zoning & Annexation tCommitt1 Ittport Zoning anb Thintsation tontinittia The July 14, 2003 meeting of the Zoning and Annexation Committee was called to order by its Chairperson, Council Member Ervin Kuspa at 3:40 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members Aranowski, Coleman, Varner, Kirsits, Kuspa, White, Pfeifer, and King; Joe Heintzelman, Andy Videkovich, Ray Simmons, Kevin Sullivan, Terry Harlan, Mike Stack, Michael Urbanski, Terry Bland of the goOttth 3 ti ' ribtttt and Council Attorney Kathleen Cekanski-Farrand. Council Member Kuspa noted that the Committee consists of Council Members Kelly, Varner, Coleman and himself. Council Member Kuspa called for a presentation on Bill No. 39-03 which would amend Chapter 21 of the South Bend Municipal Code by revising Article 10 addressing Sign Regulations. Andy Videkovich an Area Plan staff member made the presentation. He noted that Bill No. 39-03 was initiated by the Area Plan Commission. The Area Plan Commission held a public hearing on the proposed Bill on June 17, 2003 and sends the Bill to the Council with a favorable recommendation. The Bill would revise and limit the size, separation distance and display area of outdoor advertising signs within "IP" Industrial Park Zoning Districts. The restrictions would be the same in all districts where permitted. No one from the public spoke in favor or against Bill 39-03. Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill No. 39-03 be recommended favorably to Council. The motion passed. Council Member Kuspa called for a presentation on Bill No. 40-03 which would amend Chapter 21 of the South Bend Municipal Code by revising Article 6,Division 2, to allow pool and billiard halls as a special exception in the "C" Commercial, "D" Light Industrial, and"E" Heavy Industrial Districts. Andy Videkovich an Area Plan staff member made the presentation. He noted that Bill No. 40-03 was initiated by the Area Plan Commission. The Area Plan Commission held a public hearing on the proposed Bill on June 17, 2003 and sends the Bill to the Council with a favorable recommendation. The Bill would permit pool and billiard halls as a controlled use but would require a special exception to be filed through the Board of Zoning Appeals and the Common Council in order for any to be located within 1,000 feet of any two(2) other controlled uses. Council Member King noted that the Bill would permit billiard halls to be located by family restaurants on a case by case basis. Council Member Kuspa then opened the meeting to comments in favor of Bill No. 40-03. Joe Heintzelman noted that approximately 6 1/2 years ago he opened Oscar's which was a Victorian Era Billiard Parlor. He had over 200 people who participated in billiard leagues with the primary age group being between 25-45 years of age. He noted that his company held tournaments which benefitted such groups as the Diabetes Association. His establishment was a place where people could come and enjoy themselves in an establishment with a good reputation. Because of the hospital purchasing the building he is in the process of relocating his business. Zoning and Annexation Committee July 14, 2003 Page 2 Mike Stack, Public Relations Coordinator for the College Football Hall of Fame and formerly of WSBT spoke in favor of the proposed Bill. He noted that mr. Heintzelman runs an "outstanding business"which was visited by the firefighters from New York City when they were in town. Mr. Stack noted that having such a business is beneficial for developing community relations for visitors to our city. Ray Simmons then spoke in favor of the Bill. He noted that an establishment like Mr. Heintzelman's is a "jewel of a billiard parlor" based on his many travels and a great asset to the community. Kevin Sullivan spoke in favor of the Bill. He noted that he is an employee in the County Surveyor's Office. Such an establishment is one of the"finest around" with a good atmosphere. Terry Harlan spoke in favor of the Bill. He noted that he works on Hill Street. He participates in tournaments and believes that establishments like Oscars are a"class act". Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill No. 40-03 be recommended favorably to Council. The motion passed. There was no miscellaneous business.
