The July 28, 2003 meeting of the Zoning and Annexation Committee was called to order by its
Chairperson, Council Member Ervin Kuspa at 4:42 p.m. in the Council Informal Meeting Room.
Persons in attendance included Council Members Aranowski,Kelly,Pfeifer,King, Varner,White,
Kirsits and Kuspa; Jeff Meyers, Public Works Director Gary Gilot, Edward Hardig, Kahmyar
Fahitti, several unidentified members of the public, Terry Bland of the gitouth 3 ikltti 'CribUiC
and Council Attorney Kathleen Cekanski-Farrand.
Council Member Kuspa noted that the Committee is composed of Council Members Kelly,Varner,
Coleman and himself.
Council Member Kuspa then called for a presentation on Bill No. 47-03 which is a zoning request
for the property located at 1881 North Ironwood Drive.
Jeff Meyers, a planner with Area Plan then reviewed the Area Plan Commission report. He noted
that the Commission sends the Bill to the Council without a recommendation, however the staff
recommendation was favorable.
Edward Hardig, a local attorney, then made the presentation on the Bill. He noted. that he
represents Martin's who is the proposed tenant and Dunn Road Development,LLC., who will be
the landlord. They plan to construct a 10' by 20' square building to be used for a fuel dispensing
facility. He noted it would not be a gas station and would not have a car wash. Martin's has been
working with the City to alleviate the traffic congestion. Martin's will give up 3-4' on the west
side of Ironwood for a left holding lane to permit turning into Martin's which is being proposed for
to address safety concerns. Dunn Road is 3-4' higher than the rest of the plaza and contributes to
run-off of water with concerns being raised by the residents of New London Lakes. Martin's has
been working with the residents especially those who spoke in opposition at the Area Plan
Commission meeting. He noted that Martin's is interested in being a full-service facility, noting
that a gas station had been located on the site where the Burger King restaurant is now located.
Mr. Hardig stated that he believes that all differences have been addressed with one of the curb cuts
off of Dunn being closed, more screening and evergreens to be planted, and directing lighting
away from New London Lakes. He also noted that the trees along Dunn would remain. The only
signage would be to utilize signs already in existence. He noted that residents in the area would
like the additional service being offered if the zoning is approved.
Mr. Hardig noted that representatives from Martins's are present to address any questions, as well
as their Engineer,Kahmyar Fahitti. He stated that Martin's wishes to be a good neighbor and that
their relationships go long and deep.
Council Member Kelly thanked Council Member King and the Martin's representatives for
working hard on this project, noting that he had received may calls about the project, but now they
have all stopped.
Council Member Kuspa noted that the removal of the curb cut on Dunn should assist the traffic
congestion in the area,and that much of the lighting is reflected from other projects in the area.
Council Member King noted that he was not a member of the Committee however he does
represent the area which is within his Councilmanic District. He believes that there are many

benefits from this development. He stated that those living in the area will benefit with the
upgrades in traffic patterns which are proposed. Martin's has shown its interest in developing a
good plan which meets all public safety concerns by hiring its own Traffic Engineer to work with
the City on these issues. Drainage will be more effectively captured which will also benefit those
living in the area.
Mr. Gilot noted that the proposed traffic upgrades will improve the overall safety in the area.
Following discussion, Council Member Kelly made a motion, seconded by Dr. Varner that Bill
No. 47-03 be recommended favorably to Council. The motion passed.
There being no further business to come before the Committee, Council Member Kuspa adjourned
the meeting at 5:01 p.m.
