The October 28, 2002 meeting of the Public Works and Property Vacation Committee was called
to order by its Chairperson, Council Member David Varner at 4:40 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Varner, Aranowski, Pfeifer, King, Kelly,
Coleman, Kuspa and White; Community &Economic Development Director Jon Hunt, Richard J.
Deahl, Bruce Bancroft, City Engineer Carl Littrell, Human Right Director Lonnie Douglas, Terry
Bland of the&MO 521ZI b ertb1tUC C and Kathleen Cekanski-Farrand, Council Attorney.
Council Member Varner noted that the first item on the agenda was to review Bill No. 77-02 which
is a vacation request for the first north/south alley east of Michigan Street from Navarre Street to
Bartlett Street for a distance of 586 feet and a width of 14 feet.
Dr. Varner noted that the Board of Public Works sent a favorable recommendation as evidence by
their report of October 28,2002(copy attached).
Mr. Richard J. Deahl, the attorney representing the petitioner, Memorial Hospital of South Bend,
Inc. then made his presentation. Mr. Deahl noted that Memorial has interest or owns 100% of the
affected property. The vacation would facilitate the development of Memorial's Campus on the
east and west sides of the subject alley.
Community & Economic Development Director Jon Hunt stated that the City Administration is
supportive of the proposed vacation.
City Engineer Carl Littrell noted that the Department of Public Works supports the proposed
vacation and would be vacating their easements.
Council Member Pfeifer inquired whether the petitioner has met with the two (2) neighborhood
associations which represent this area.
Mr. Deahl stated that they have not met with the associations, however they are planning to discuss
future development plans in the near future.
Council Member Aranowski noted that Memorial meets monthly with NNN and NNN keeps the
other neighborhood association updated.
Following discussion, Council Member Aranowski made a motion, seconded by Council Member
King that Bill No. 77-02 be recommended favorably to Council. The motion passed.
Dr. Varner then called for a presentation on Bill No. 02-79 which is a resolution addressing the
acquisition of certain land located near the intersection of Lincoln Way West and Bendix Drive.
City Engineer Carl Littrell made the presentation. Mr. Littrell stated that the property is necessary
to provide right turn lanes for southbound traffic approaching Lincoln Way West. Five (5)
separate parcels are affected.
The Council Attorney noted that she has a copy of the governing law in this area, namely Indiana
Code § 36-1-10.5-1 through Indiana Code § 36-1-10.5-6. She noted that the Council is required

to adopt such a resolution under this state law. The Board of Public Works is also required to file
copies of the two(2) appraisals with the Council.
In response to a question from Council Member Pfeifer, Mr. Littrell stated that the purchase of land
would permit making a lane for turning right onto Bendix.
Council Member Coleman noted that there is a ponding problem in this area. Mr. Littrell stated that
all drainage would be addressed.
Following discussion, Council Member King made a motion, seconded by Council Member
Aranowski that Bill No. 02-79 be recommended favorably to Council. The motion passed.
There being no further business to come before the Committee, Council Member Varner adjourned
the meeting at 4:50 p.m.
