Qommttt import <br /> pub& 1110orkz aub Vroperty Vacation (onuutttu <br /> The October 28, 2002 meeting of the Public Works and Property Vacation Committee was called <br /> to order by its Chairperson, Council Member David Varner at 4:40 p.m. in the Council Informal <br /> Meeting Room. <br /> Persons in attendance included Council Members Varner, Aranowski, Pfeifer, King, Kelly, <br /> Coleman, Kuspa and White; Community &Economic Development Director Jon Hunt, Richard J. <br /> Deahl, Bruce Bancroft, City Engineer Carl Littrell, Human Right Director Lonnie Douglas, Terry <br /> Bland of the&MO 521ZI b ertb1tUC C and Kathleen Cekanski-Farrand, Council Attorney. <br /> Council Member Varner noted that the first item on the agenda was to review Bill No. 77-02 which <br /> is a vacation request for the first north/south alley east of Michigan Street from Navarre Street to <br /> Bartlett Street for a distance of 586 feet and a width of 14 feet. <br /> Dr. Varner noted that the Board of Public Works sent a favorable recommendation as evidence by <br /> their report of October 28,2002(copy attached). <br /> Mr. Richard J. Deahl, the attorney representing the petitioner, Memorial Hospital of South Bend, <br /> Inc. then made his presentation. Mr. Deahl noted that Memorial has interest or owns 100% of the <br /> affected property. The vacation would facilitate the development of Memorial's Campus on the <br /> east and west sides of the subject alley. <br /> Community & Economic Development Director Jon Hunt stated that the City Administration is <br /> supportive of the proposed vacation. <br /> City Engineer Carl Littrell noted that the Department of Public Works supports the proposed <br /> vacation and would be vacating their easements. <br /> Council Member Pfeifer inquired whether the petitioner has met with the two (2) neighborhood <br /> associations which represent this area. <br /> Mr. Deahl stated that they have not met with the associations, however they are planning to discuss <br /> future development plans in the near future. <br /> Council Member Aranowski noted that Memorial meets monthly with NNN and NNN keeps the <br /> other neighborhood association updated. <br /> Following discussion, Council Member Aranowski made a motion, seconded by Council Member <br /> King that Bill No. 77-02 be recommended favorably to Council. The motion passed. <br /> Dr. Varner then called for a presentation on Bill No. 02-79 which is a resolution addressing the <br /> acquisition of certain land located near the intersection of Lincoln Way West and Bendix Drive. <br /> City Engineer Carl Littrell made the presentation. Mr. Littrell stated that the property is necessary <br /> to provide right turn lanes for southbound traffic approaching Lincoln Way West. Five (5) <br /> separate parcels are affected. <br /> The Council Attorney noted that she has a copy of the governing law in this area, namely Indiana <br /> Code § 36-1-10.5-1 through Indiana Code § 36-1-10.5-6.
