AN ORDINANCE APPROVING PARKING RATES FOR PARKING
GARAGES AND PARKING LOTS OWNED, LEASED AND
OPERATED BY THE BOARD OF PUBLIC WORKS OF THE CITY
OF SOUTH BEND, INDIANA.
STATEMENT OF PURPOSE AND INTENT: I.C. 36-9-11-7 authorizes the
Board of Public Works to fix the rates and charges to be collected for
parking vehicles in parking facilities owned and operated by the City
and for other use of those parking facilities so as to promote the
maximum use of the facilities by the public in a safe, orderly, and
efficient manner. Such rates fixed by the Board of Public Works are
subject to the approval of the Common Council. The Council has
received Resolution No. 35-1987 of the Board of Public Works, a copy of
which is attached hereto and made a part hereof, which establishes
rates for city-owned parking facilities, both parking garages and
parking lots.
NOW, THEREFORE, BE IT ORDAINED by the South Bend Common Council, as
follows:
Section I. The following monthly rates shall be charged for
individual vehicles parked at City owned and operated parking lots:
Rate
(a) Municipal services facility, $16.00 per mo.
700 block of West Sample.
Section II. The following monthly rates shall be charged for
vehicles parked at City owned and operated parking garages:
Rate
(a) Per vehicle, on a month to month basis $35.00 per mo.
(b) Per vehicle, on a three year contract $38. 00 per md.
(c) Per vehicle on a five year contract $42.00 per mo.
(d) Group rates on a monthly contract
5 to 19 vehicles $32.00 per mo.
20 to 49 vehicles $29. 00 per mo.
50 or more vehicles $25.00 per mo.
(e) Priority for committing parking spaces within a City owned and
operated parking garage shall be given to vehicles with the longest
term parking contract and the highest monthly rental rate. Commitment
of spaces within a parking garage within a particular rate structure
shall be determined based upon (1) the number of parking spaces
committed per single billing; ( 2) the length of time the person has
committed spaces within that garage; and (3) the payment experience of
the account.

Section IV. This ordinance rescinds and supersedes all prior
ordinances and resolutions setting rates for municipal parking
facilities, including but not limited to Ordinance no. 7662-86.
Section V. Nothing herein shall affect rights and liabilities
accrued prior to the effective date of this ordinance.
Section VI. If any portion of this ordinance shall be declared
illegal or unconstitutional, that determination shall not affect the
balance thereof.
Section VII. This ordinance shall be in full force and effect from
and after its passage by the Common Council and approval by the Mayor.

Dear President Serge:
The enclosed ordinance amending the parking rates for City owned
lots and garages is being filed for first reading at the November 23,
1987 Council meeting.
It is my hope the public hearing and second reading would then
take place at the December 7, 1987 Council meeting. As you and the
Council are aware, the administration has been reviewing parking
rates in the downtown area and. Redevelopment is contemplating the
construction of a new parking facility on the northwest corner of the
intersection of Wayne Street and St. Joseph Street. In order to
provide parking at a price reflective of the cost in that facility,
the other two garages, and flat lots, I would suggest that parking
rates be amended as proposed in the ordinance.
A recent survey of the privately owned garages in the downtown
area shows the following:
Valley American Garage $50.00 per month
1st Source Bank Garage $40. 00 per month
First Interstate Garage $35.00 per month
The rates for the municipally owned garages would still result in
a lower monthly parking rate than the other facilities. Group
monthly rates would still be available although they have been
increased slightly.

As you are aware, the downtown area is being pressured daily to
provide more parking to prospective business tenants. The situation
is reaching the point where the City is being asked to make longer
term parking commitments to either individuals or firms owning
buildings or portions of them. For that reason, longer term parking
rates have been proposed as follows, 3 year minimum contract per
vehicle $38.00 per month, 5 year minimum contract per vehicle $42.00
per month. As well as providing rates that address longer term
year-to-year parking, the ordinance also proposes that individuals
making this type of a commitment to the City would be given priority
for parking spaces in the individual garages. Hourly parking rates
have been equalized in all the garages.
Finally, in reviewing the financial condition of the garages,
clearly additional funding and, therefore, an increase in parking
rates is justified. The two existing municipal garages are currently
running a deficit of approximately $150,000 annually when expenses
and debt service are compared to revenue.
While parking is becoming more in demand and clearly must be
provided if the downtown area is to continue its growth, the City can
not continue to subsidize it at the current rate. For these reasons,
I am requesting your approval of the rate ordinance and, therefore,
the new rates.
