ORDINANCE NO. -g7 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 16 , ARTICLE 2 OF THE MUNICIPAL CODE OF SOUTH BEND STATEMENT OF PURPOSE AND INTENT: In order to meet the rising costs for collection and disposal of garbage and trash by the City, the Common Council finds it necessary to increase the fees for such service. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend as follows : Section I . The fees established in Chapter 16 Article 4 Section 6 of the Municipal Code of South Bend shall be amended as follows : Sec . 16-6 . Garbage and trash collections : City fees , manner of collection; private party responsibility. (a) Every owner, occupant or lessee of any building, house or structure on grounds where garbage and trash accumulate shall provide for the collection and disposal of trash and garbage from his premises at least once a week. (b) The City shall not collect and dispose of garbage or trash from any residential unit unless said collection and disposal is requested by the owner, occupant, tenant or lessee of the residential unit , except as provided for in section 16-56 . (c) The City shall charge for the collection and disposal of garbage and trash according to the following schedule: (1) One-family dwelling with no limit on number of bags and bundles : Five-dollars-and-fifty-cents-f$5 756,- seven dollars ($7 . 00) per month. (2) One-family dwelling where the head of the household has submitted to the Board of Public Works proof of age sixty-five (65) or over: 'three-dollars-and-fifty-cents k$3 594 Four dollars and fifty, cents ($4.541 (3) Two-family dwelling with no limit on containers and bags : Six-deilars-F$6 769} seven dollars and fifty cents ($7 .50) per month. (4) Three-family dwelling with no limit on number of containers and bags : Eight-doiiars-(-$&-Qa) nine dollars and fifty cents ($9 .50) per month. (5) Four-family dwelling with no limit on number of containers and bags : 'Fen-deilars--F$}(}.:40-} eleven dollars and fifty cents ($11 .50) per month. • (6) Pickup of appliances , furniture and other mis- cellaneous items : Appliances , furniture and other mis- cellaneous items will be picked up as a part of the regularly scheduled solid waste collection at no additional charge to the city solid waste customer, provided that no special equipment is required to make the pick-up. Pick-up of such items which, in the opinion of the manager of the Bureau of Solid Waste, require special equipment or special scheduling, or pick-up requested by individuals who are not city solid waste customers shall be subject to the following charges : Eight dollars and fifty cents ($8.50) minimum for one piece item and three dollars and fifty cents ($3 .50) for each additional pieee item to be picked-up. When the extra items to be picked-up are items such as brush, construc- tion or demolition debris or items other than appliances and furniture, the manager of the Bureau of Solid Waste shall provide the customer with an estimated removal cost. This total cost shall replace the per item cost listed previously. (d) Charges for City collection of garbage and trash shall be added to the residential unit' s water meter charges and collected as are bills for water services . (e) It is the responsibility of the owners , occupants or tenants of abutting property to keep all alleys used by any sanitation vehicles clean, orderly and passable at all times . Leszczynski Director, Public Works (219) 284-9251 November 18 , 1987 Members of the South Bend Common Council 4th Floor, County-City Building South Bend, Indiana 46601 Attention: Mr. Joseph Serge, President Dear Councilman Serge: The attached ordinance requests an increase in fees for collection of garbage and trash by the City of South Bend. The increase is in the amount of $1.50 per customer per month. The reason for the increase is twofold. First is the landfill costs . These fees have already risen by 70(r per yard since the last rate increase and are expected to go up another 75(r per yard in March of 1988. We have been experiencing yearly increases in landfill costs . The second reason is we are attempting to make the Solid Waste collection program a totally self-supported program. Vehicle maintenance costs were previously handled by other departments and are now included in the proposed budget . Another change proposed in this ordinance is with added language to clarify charges associated with our extra pick-up program. I will be available to answer any questions you may have.
