ORDINANCE NO. 7816-87
AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR
PROPERTY LOCATED AT APPROXIMATELY 460 FEET WEST
OF THE SOUTHWEST CORNER OF THE INTERSECTION OF
MAYFLOWER AND SAMPLE STREETS IN THE CITY OF
SOUTH BEND, INDIANA.
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
SECTION I . Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification
of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
Part of the East Half of the Northwest Quarter of Section 17,
Township 37 North, Range 2 East, described as follows: Beginning
457.86 feet West of the intersection of the West line of Route
Number 123 , otherwise known as Mayflower Road and the South line
of Grant Road (Sample Street) ; thence South parallel with said
State route Number 123 , 420 .00 feet; thence West, parallel with
the south line of Grant Road, a distance of 442.14 feet; thence
North 420 .00 feet to the south line of Grant Road; thence East
, 442. 14 feet to the place of beginning.
be and the same is hereby established as D-Light Industrial, A-Height and
Area, excepting here from the northern one hundred and sixty feet ( 160 ' )
of said parcel which shall be established as C-Commercial, A-Height and
Area.
SECTION II. This rezoning ordinance is subject to the petitioner
recording in the Recorder' s Office of St. Joseph County, in a form
acceptable to the Council Attorney and the Common Council, a covenant
limited the use of the D-Light Industrial area heretofore described to
mini-storage warehousing or any use listed in the C-Commerical District
category of the South Bend Municipal Code.
SECTION III. This ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the mayor, and
legal publication.

South Bend Common Council of the City of South Bend, Indiana to
amend the zoning ordinance as herein requested.
1) The property sought to be rezoned is located at:

the City of South Bend.

4) It is desired and requested that this property be rezoned
from A-Residential, A-Height and Area to D-Light
Industrial, A-Height and Area.
5) This rezoning is requested to allow the following uses :
For the construction of mini-warehouse storage and
retail center.
6) Attached is a copy of (a) legal description of the
property; (b) a list of names and addresses of all property
owners within 300 feet of the petition property; (c) five
(5) site plans; and (d) addressed, stamped envelopes for
all property owners within 300 feet of the petition
property.
7) By signing this petition, we understand that if the County
Council approves this petition to rezone, it may be
approved subject to the submittal of a final site plan. A
final site plan must be submitted to the Area Plan
Commission within one (1) year of the Council ' s action.
Failure to submit a final site plan within the time period,
causes the zoning of the petitioned property to revert to
the initial zoning classification. Time extensions on the
submittal of the final site plan may be requested.

RE: A proposed ordinance and site development plan of William J. Veldman to
zone from "B-1" Residential,"A" Height and Area to "D" Light Industrial,
"A" Height and Area, property located approximately 460 feet west of the
southwest corner of the intersection of Mayflower and Sample Streets, City
of South Bend - APC #1127-87
Gentlemen:
The above referenced ordinance and site development plan of William J. Veldman
was legally advertised October 9 and October 10, 1987. The Area Plan
Commission gave it a public hearing on October 20, 1987, at which time the
following action was taken:
Upon a motion by Joseph Serge, being seconded by Chuck
Sausman, and unanimously carried, the proposed
ordinance and site development plan of William J.
Veldman to zone from "B-1" Residential, "A" Height and
Area to "D" Light Industrial, "A" Height and Area,
property located approximately 460 feet west of the
southwest corner of the intersection of Mayflower and
Sample Streets, City of South Bend is sent to the
Common Council with a favorable recommendation subject
to a Final Site Development Plan showing the required
setback
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

REQUESTED ACTION: The petitioners are requesting a zone change from
"B-1" Residential , "A" Height and Area to "D"
Light Industrial , "A" Height and Area for the
- construction of mini-warehouse storage and retail
center.

EXISTING LAND USE: The property is currently vacant.
SURROUNDING LAND USE AND ZONING: Located to the north, across Grant Road, are
single-family homes zoned "R" Residential ; to the
east is Bob's Furniture Appliances and Video zoned
"C" Commercial ; to the south is a mobile home park
zoned "B-I" Residential and to the west is vacant
land also zoned "B-1" Residential .
ACCESS: Access to the site is proposed to be from Grant
Road.

DRAINAGE; The drainage has not been addressed by the
petitioner.
•
DATA: The total site to be rezoned is 185,698.8 square
feet. Of that, the buildings will occupy 43,500
square feet, or 23% of the site; the parking and
drives will occupy 92,550 square feet , or 50% of
the site, and 49,648 square feet or 27% of the
site will remain as open space.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer made the following comments:
"City water , and sanitary sewers are available.
Drywells or retention pond will be necessary to
retain storm water on site. "
