Ordinance No. 4990-68 , as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St . Joseph County, State of Indiana . A parcel of land 371/2 feet in width, East and West, taken off of the entire width of the West ends of Lots Numbered One (1 ) and Two ( 2) as shown on the recorded plat of Rockstroh' s Subdivision of Lots 42 , 43 , 44, and 45 of Rockstroh' s Second Addition to the City of South Bend, recorded in Plat Book 9, page 15 . Lot Numbered Four (4) as shown on the recorded plat of Rockstroh' s Subdivision of Lots Numbered 42 , 43 , 44, and 45 in Rockstroh' s Second Addition to the City of South Bend, recorded in Plat Book 9, page 15 in the Office of the Recorder of St . Joseph County, Indiana . The 1st. North-South alley west of St . Joseph Street running South from Navarre Street for a distance of 110 feet; thence running west a distance of 80 ' more or less to the intersecting North-South alley. None 4) It is desired and requested that this property be rezoned from B--residential Height & Area to C--Commercial , 85 ' Height & Area 5) This rezoning is requested to allow the following use: Build a new 64 ' x 64 ' building for Art & Crafts, with 2 offices, a layout room, shipping area and bathrooms . 6) Attached is a copy of (a) legal description of the property; (b) a list of names and addresses of all property owners within 300' of the petition property; (c) five ( 5) site plans; and (d) ad- dressed, stamped envelopes for all property owners within 300 ' of the petition property. 7) By signing this petition, I and any contingent purchaser under- stand that if the Council approves this petition to rezone, it may be approved subject to the submittal of a final site plan. Navarre Street, City of South Bend - APC #1128-87 Gentlemen: The above referenced ordinance and site development plan of Eugene and Shar Sosh Forsythe was legally advertised October 9 and October 10, 1987. The Area Plan Commission gave it a public hearing on October 20, 1987, at which time the following action was taken: Upon a motion by Chuck Sausman, being seconded by Theodessa Earles and carried, with Joseph Serge voting "nay" the proposed ordinance and site development plan of Eugene and Shar Sosh Forsythe to zone from "B" Residential, "C" Height and Area to "C" Commercial, "F Height and Area, property located at the first 87 1/2 feet west of 124 and 126 E. Navarre Street, City of South Bend is sent to the Common Council with an unfavorable recommendation. The use proposed under "C" Commercial, "F" Height and Area is incompatible with the "B" Residential zone which surrounds the property and will add to traffic congestion which is already bad because of the hospital The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Navarre Street City of South Bend • REQUESTED ACTION: The petitioners are requesting a zone change from "B" Residential , "A" Height and Area to "C" Commercial , "F" Height and Area to allow the construction of a building for arts and crafts with two offices, a layout room and shipping. EXISTING LAND USE: "Th-e property is currently vacant. SURROUNDING LAND USE AND ZONING: Located to the north across Navarre Street are single-family houses zoned "B" Residential ; to the east is a single-family house zoned "B" Residential; to the south and west are parking lots also zoned "B" Residential . ACCESS: Access to the site is proposed to be from Navarre Street. DRAINAGE; The drainage has not been addressed by the petitioners. DATA: The total site to be rezoned is 8,506 square feet. Of that, the buildings will occupy 4,096 square feet, or 48% of the site; the parking and drives will occupy 2,470 square feet, or 297 of the site, and 1 ,940 square feet or 23% of the site will remain as open space. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: The City Engineer made the following comments: "City water, and sanitary sewers are available to site; drywells will be necessary to retain storm water on site at a rate of 30 gal . per 100 sq. ft. of roof and paved areas.
