AN ORDINANCE ANNEXING TO AND BRINGING WITHIN
THE BOUNDARIES OF THE CITY OF SOUTH BEND,
INDIANA, CERTAIN REAL ESTATE LOCATED WITHIN
GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA
STATEMENT OF PURPOSE AND INTENT
A Petition for Voluntary Annexation of property located
in German Township, St. Joseph County, Indiana, having been filed
by at least fifty-one percent (51%) of the owners or the owners
of at least seventy-five percent (75%) of the total assessed
value of the territory to be annexed, said owners being Jack M.
Hurwich and Betty Hurwich Zoss, and said territory to be annexed
being contiguous to the City of South Bend, Indiana, as required
by law, and said Petition being in form and substance in compli-
ance with all applicable requirements of Indiana law, and the
Common Council of the City of South Bend, Indiana, after full and
public hearing thereon, and being duly advised, now finds and
determines that the Petition for Voluntary Annexation should be
granted and that the territory should be annexed to the City of
South Bend, Indiana, by proper ordinance.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AS FOLLOWS:
Section 1 . That the Petition for Voluntary Annexation
executed by Jack M. Hurwich and Betty Hurwich Zoss for annexation
of certain territory to the City of South Bend, Indiana, be
incorporated herein and made a part hereof as Exhibit A attached.
Section 2. That the real estate petitioned to be
annexed is located in St. Joseph County, German Township, Indiana,
is contiguous to the boundaries of the City of South Bend, and
the petitioners are at least fifty-one percent (51%) of the
owners or the owners of at least seventy-five percent (75%) of
the total assessed value of the property, which is described as
follows:
That part of the East half of the Southwest
quarter of Section 22 and the East half of
the Northwest quarter of Section 27 all being
in T. 38 N. , R. 2 E. , German Township, St.
Joseph County, Indiana which is described as:
Beginning at the North quarter post of
Section 27 (South quarter post of Section 22;
thence S. 00°-13 '-48" E. along the North and
South quarter line of said Section, 364.33
ft. to the Southerly Right - of - Way line of
the East - West Indiana Toll Road; thence S.
89°-24'-03" W. along said line, 933. 15 ft. ;
thence around a 4,733.66 ft. radius curve to
the Right an Arc distance of 391. 86 ft. to
the end of a chord which bears N. 88°-13 '-39"
W. and having a distance of 391 .74 ft. ;
thence N. 00°-10 ' -52" W. along the West line
of the East half of the Northwest quarter of
Section 27, 351 . 89 ft. to the Northwest
corner of the East half of the Northwest
quarter of Section 27 (Southwest corner of
the East half of the Southwest quarter of
Section 22) ; thence N. 00°-36 '-50" W. along
the West line of the East half of the South-
west quarter of Section 22, 2650.88 ft. to
the Northwest Corner of the East half of the
Southwest quarter of Section 22; thence S.
89°-49 '-25" E. along the East and West
quarter line of said Section, 1322. 95 ft. to
the Center of Section 22; thence S.
00°-38 '-48" E. along the North and South
quarter line of said Section, 2422. 25 ft. to
a Point which is N. 00°-38 '-48" W. , 214.50
ft. from the Point of Beginning; thence S.
89°-33 '-51" W. , 99.00 ft. ; thence S.
00°-38 '-48" E. , 214.50 ft. ; thence N.
89°-33 '-51" E. along the South line of
Section 22 and the centerline of Cleveland
Road (North line of Section 27) , 99. 00 ft. to
the Point of Beginning.
and said real estate is now hereby annexed to and brought within
the City of South Bend, Indiana.
Section 3 . This Ordinance shall be in full force and
effect from and after its enactment, approval by the Mayor, and
legal publication.

TO: Common Council PETITION FOR
City of South Bend, Indiana VOLUNTARY ANNEXATION
The undersigned hereby petition the Common Council of
the City of South Bend, Indiana, for voluntary annexation to the
City of South Bend, Indiana, of a certain parcel of real estate
situated in St. Joseph County, State of Indiana, and in support
of which allege and affirm as follows :
1 . They are at least fifty-one percent (51%) of the
owners or the owners of at least seventy-five percent (75%) of
the total assessed value of a certain parcel of land more partic-
ularly described on Exhibit "A" hereto, which is incorporated
herein by this reference as if fully set forth (hereinafter "the
Parcel") .
2. The Parcel is located in St. Joseph County, Indiana,
outside of but contiguous to the City of South Bend, Indiana.
3 . They desire that the Parcel be annexed to the City
of South Bend, Indiana, by proper ordinance.
4 . They affirm, under the penalties for perjury, that
the foregoing statements are true.
WHEREFORE, the undersigned petition that the Parcel be
annexed to the City of South Bend, Indiana.

Pursuant to your request, the Board of Public Works has
reviewed the Petition for Voluntary Annexation submitted by
Jack M. Hurwich and Betty Hurwich Zoss and submits to you a
favorable recommendation regarding this matter.
For your information, the Board of Public Works did request
recommendations from various City departments and bureaus and
all recommendations received were favorable.
