ORDINANCE NO. 77 ,4-e7 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING THE SOUTH BEND HAZ-MAT FUND. STATEMENT OF PURPOSE AND INTENT: The South Bend Common Council believes that it is in the best interest of the public safety and welfare to establish a Haz-Mat Fund to receive monies generated by the South Bend Fire Department' s response to hazardous materials incidents and that such monies be used to defray expenses related to Haz-Mat activities. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: SECTION I . A new Sec. 2-168 shall be added to the South Bend Municipal Code as follows: Sec. 2-168 . Haz-Mat Fund. (a) The South Bend Haz-Mat Fund is established to receive monies generated by the South Bend Fire Department' s response to hazardous materials incidents. (b) The monies accumulated in this Fund may be expended for the replacement, repair, or purchase of Haz-Mat equipment, for training and supplies and to defray the expense of Haz-Mat related activities. (c) Monies remaining in the Fund at the end of the fiscal year shall not revert to the General Fund. SECTION II . TAYLOR April 7, 1987 Fire Chief South Bend Common Council County-City Building South Bend, IN 46601 Dear Council Members : I am proud to say that the operation of the Haz/Mat Team is going well and we are looking forward to the Team' s continual growth.. With the investment the city has put into the Haz/Mat Team thus far, I think it is important that we start looking at some of the expenses that we will incur this year. Some expenses could come as a sur- prise since nothing has been budgeted for the ongoing costs. One of the expenses next year will be the replacement of two (2) chemical suits. They were originally purchased in 1980. The new suits will allow us to use the old suits for practice. Last year we had five (5) responses in the county that were not collected. I think we could restructure the cost system to include a retainer fee per year to the entire county. This would be to their advantage as well as ours. It is my recommendation that the funds generated from Haz/Mat re- sponses be put into a Fire Department Special Fund to purchase Haz/Mat equipment, suits, etc. If I can answer any further questions please call me.
