Ordinance No . 4990-68 , as amended , which ordinance is commonly known as the Zoning Ordinance of the City of South Bend , Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St . Romine, et al to zone from "A" Residential, "A" Height and Area to "C" Commercial, "A" Height and Area, property located at 4100 South Main Street, City of South Bend - APC #1085-87 Gentlemen: The above referenced ordinance and site development plan of Otis S. Romine, et al was legally advertised April 10 and April 11, 1987. The Area Plan Commission gave it a public hearing on April 21, 1987, at which time the following action was taken: Upon a motion by William Limerick, being seconded by Rene Vandewalle and unanimously carried, the proposed ordinance and site development plan of Otis S. Romine, et al to zone from "A" Residential, "A" Height and Area to "C" Commercial, "A" Height and Area, property located at 4100 South Main Street, City of South Bend is sent to the Common Council with a favorable recommendation, as tendered PLEASE NOTE that the Ordinance has been amended by the petitioner to include a legal description different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. ROMINEI ET AL #1085-87 April 7, 1987 4100 South Main Street City of South Bend REQUESTED ACTION: The petitioners are requesting a zone change from "A" Residential , "A" Height and Area to "C" Commercial , "A" Height and Area to establish an office and conference room. EXISTING LAND USE: The property is currently vacant. SURROUNDING LAND USE AND ZONING: Located to the north is a single-family home zoned "A" Residential , to the east is a single-family home and some parking lots for businesses along Michigan Street zoned "A" Residential ; to the south across Metalmation Drive is a printing business zoned "D" Light Industrial ; and to the west is Ames of South Bend zoned "E" Heavy Industrial . ACCESS: Access to the site will be from Metalmation Drive. DRAINAGE: The drainage will be accommodated by drywells. DATA: The total site to be rezoned is 57,000 square feet. Of that, the buildings will occupy 2,880 square feet, or 5. 107. of the site; the parking and drives will occupy 8,220 square feet, or 14.407 of the site, and 45,900 square feet or 80.57. of the site will remain as open space. SITE PLAN: The site plan is preliminary but does meet final site plan requirements. AGENCY COMMENTS: The City Engineer made the following comments: "1. City water and sanitary sewer are available to site. 2. Drywells must be used in lieu of City storm system at a capacity of 30 gal/100 sq. ft of paved and roof area. 3. Ingress/egress must have a minimum width of 22 feet. " STAFF COMMENTS: The Staff would note that this site went through the rezoning process in November of 1982 for the same use and was granted approval by both the Area Plan Commission and the Common Council .
