'7 7 '( - 7 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR THE PROPERTY AT ( 1244 Lincoln Way East, South Bend, IN. 46613 ) IN THE CITY OF SOUTH BEND, IN BE IT ORDERED by the Common Council of the city of South Bend, Indiana. SECTION I. Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots Six (6) and Seven (7) as shown on the recorded Plat of Jacob Leer's Survey, as recorded in Plat Book 5, page 11, in the Re- corder's Office of St. Joseph County, Indiana. be and the same is hereby established as "c-1" Commercial , "A" Height and Area district. SECTION II . This ordinance shall be in full force and effect from and after its passage by the Common Council , approval by the mayor, and legal publication. Brunson to zone from "B" Residential, "A" Height and Area to "C-1" Commercial, "A" Height and Area, property located at 1244 Lincoln Way East, City of South Bend - APC #1080-87 Gentlemen: The above referenced ordinance and site development plan of Carl F. Brunson was legally advertised March 6 and March 7, 1987. The Area Plan Commission gave it a public hearing on March 17, 1987, at which time the following action was taken: Upon a motion by Joseph Serge, being seconded by William Limerick and unanimously carried, the proposed ordinance and site development plan of Carl F. Brunson to zone from "B" Residential, "A" Height and Area to "C-1" Commercial, "A" Height and Area, property located at 1244 Lincoln Way East, City of South Bend is sent to the Common Council with a favorable recommendation, subject to a Final Site Development Plan PLEASE NOTE that the Ordinance has been amended by the petitioner to include a legal description different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. BRUNSON #1080-87 March 9, 1987 1244 Lincoln Way East City of South Bend REQUESTED ACTION: The petitioner is requesting a zone change from "B" Residential to "C-1" Commercial in order to establish an antique shop and real estate office. EXISTING LAND USE: The property contains a vacant structure. SURROUNDING LAND USE AND ZONING: Located to the north across Lincolnway East is the St. Joseph River, to the east across Leer Street is a duplex zoned '"B" Residential ; to the south are the Penn Central Railroad tracks; and to the west is a Montessori school zoned "B" Residential . ACCESS: Access to the site will be from both Lincoinway East and Leer Street. DRAINAGE: The drainage has not been addressed by the petitioner. DATA: The total site to be rezoned is 54,226 square feet. Of that, the buildings will occupy 3,676 square feet, or 6.81 of the site; the parking and drives will occupy 11 ,200 square feet, or 20.77. of the site, and 39,350 square feet or 72.51 of the site will remain as open space. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: The City Engineer made the following comments: 1. "City water and sanitary sewers are available to this site; 2. Site storm water must be retained on site with drywells at a rate of 30 gallons/100 square feet of paved area; 3. Will need Indiana Department of Highways approval and permit for curb cut on LWE. The City Building Department noted that the proposed uses are allowable in the "C-1" district, and that the property is in the Lincoinway East Historic District. .'
