North- South alley west of St. Joseph Street running South from Navarre Street for a distance of 110 feet; thence running west a distance of 80 ' more or less to the intersecting North-South alley. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12 , the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I . The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: The 1st. North-South alley West of St. Joseph Street running South from Navarre Street for a distance of 110 feet; thence running west a distance of 80 ' more or less to the intersecting North-South alley. All being in Rockstroh' s Sub of lots 42-43-44-45 Rockstroh' s 2nd. Add in the City of South Bend, Indiana . hereby determines that it is desirable to vacate said property. SECTION II . The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities , including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities . SECTION III . The following property may be injuriously or bene- ficially affected by such vacating: Lots 1 , 2 , 3 , 4, 5 and 6 of Rockstroh' s Sub of lots 42-43-44- and 45 of Rockstroh' s 2nd. addition to the City of South Bend, Indiana, St. Joseph County. SECTION IV. The purpose of the vacation of the real property is to: make adjacent properties continuous for construction of a new building and improve the neighborhood. SECTION V. RUNNING SOUTH FROM NAVARRE Dear Members of the Council: In accordance with Municipal Code Section 18-53 .8, a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition filed by Eugene Forsythe and Shar Sosh-Forsythe, 216 East Navarre Street, South Bend, Indiana, to vacate the following alley: The 1st north/south alley west of St. Joseph Street running south from Navarre Street for a distance of 110 feet; thence running west a distance of 80 feet more or less to the intersecting north/south alley. All being in Rockstroh' s Sub of lots 42-43-44-45 Rockstroh' s 2nd. Add. in the City of South Bend, Indiana. For your information, a Public Hearing concerning the Vacation Petition as filed was held by the Board of Public Works on September 22, 1987 . Mr. Eugene Forsythe, 216 East Navarre Street, South Bend, Indiana, Petitioner, addressed the Board and spoke in favor of the vacation of the above referred to alley. A copy of the excerpts of the minutes of the Public Hearing is attached for your information. Based on favorable comments received from the Area Plan Commission and the Engineering Department, the Board favorably recommends the vacation of the above referred to alley subject to any and all utility easements.
