Ordinance No. --)-7q6-t7 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA TO CREATE AN EAST WAYNE STREET HISTORIC PRESERVATION DISTRICT. STATEMENT OF PURPOSES AND INTENT TO ESTABLISH an Historic Preservation District , to be known as the East Wayne Street Historic District , with such uses as permitted in Section 21-36. 1 of the Municipal Code of the City of South Bend, such District having been recommended by the Historic Preservation Commission of South Bend and St . Joseph County, for the purpose of preserving the architectural , historical , and cultural significance and educational value of the described area. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION 1 . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St . Joseph County, State of Indiana: A parcel of land being a part of Section 7, Township 37 North , Range 3 East , Portage Township ; City of South Bend, all within Whitcomb & Keller's Sunnymede First Addition ; Being more particularly described as follows: Beginning at the intersection of the centerlines of Eddy Street and Jefferson Boulevard; thence running South along the Centerline of Eddy Street to a point of intersection with the South line of Lot 136 extended West ; thence East along said extended line and the South line of Lots 136 through 138 to the Southeast corner of Lot 138; thence Southwesterly 7 feet , more or less, along the East line of Lot 264 to the point of intersection with the Centerline of the first East-West alley South of East Wayne Street extended West ; thence Southeasterly along said Centerline to the West Right-of-Way line of Sunnyside Avenue ; thence Easterly 60 feet , more or less, to the point of intersection of the East Right-of-Way line of Sunnyside Avenue with the Centerline of the first East-West alley South of East Wayne Street South ; thence Easterly along the Centerline of said alley to the point of intersection of the Centerline of the first vacated North-South alley East of Sunnyside Avenue ; thence Easterly along the Centerline of the first vacated South of the Northeast corner of Lot 170 ; thence South 25 feet along the said East line to the Centerline of said vacated alley South of East Wayne Street ; thence East along said Centerline to the West Right-of-Way line of Twyckenham Drive; thence East to the Centerline of Twyckenham Drive ; thence North along said Centerline to the point of intersection with the Centerline of the first vacated East-West alley South of East Wayne Street extended West ; thence East along said Centerline to the Centerline of Greenlawn Avenue ; thence North along said Centerline to the point of intersection of the North line of Lot 39 extended East ; thence Westerly along said extended line and the North line of Lots 39 through 45 to the East Right-of-Way line of Esther Street ; thence West' to the Northeast corner of Lot 46; thence West 110 .8 feet , more or less, along the North line of Lots 46 and 47 to a point 23 feet West of the Southeast corner of Lot 32; thence Northwesterly to a point 15 feet North of the North line of Lot 47 and 24 feet West of the East line of Lot 32; thence Westerly 100 feet , more or less, along a line parallel to the South line of Lots 31 and 32; thence South 15 feet along a line parallel to the East line of Lot 31 to the North line of Lot 49; thence West along the North line of Lots 49 through 57 to the East Right-of-Way line of Twyckenham Drive; thence West to the Centerline of said Drive ; thence South along said Centerline to the point of intersection of the North line of Lot 59 extended East ; thence West to the Northeast corner of Lot 59; thence West along the North line of Lots 59 through 63 to the Northwest corner of Lot 63; thence North 1 degree East a distance of 133 feet to the North line of Lot 64; thence North 7 feet , more or less, to the Centerline of the first East-West alley South of Jefferson Boulevard; thence West along said Centerline to the East Right-of-Way line of Jacob Street ; thence West to the Centerline of said Street ; thence North along said Centerline to the point of intersection with the North line of Lot 72 extended East ; thence Westerly to the Northeast corner of Lot .72; thence West along the North lines of Lots 72 through 78 to the East Right-of-Way line of Sunnyside Avenue; thence West to the Centerline of Sunnyside Avenue ; thence Northerly along said Centerline to the Centerline of Jefferson Boulevard; thence Westerly along said Centerline to the Point of Beginning. BE AND THE SAME IS HEREBY established as an Historic Preservation district with such uses as permitted in Section 21-36. 1 of the Municipal Code of the City of South Bend, Indiana, and shall be designated the East Wayne Street Historic District . SECTION 2. The Historic Preservation Commission of South Bend and St . Joseph County shall adopt guidelines for the East Wayne Street Historic District . SECTION 3. South Bend, IN 46601 Honorable Council Members: Attached please find a proposed amendment to the Historic Preservation Commission's ordinance. The purpose of the amendment is to designate the East Wayne Street area as an Historic Preservation District. At the May 18, 1987 Historic Preservation Commission meeting, the East Wayne Street Steering Committee presented the vote tally of the ballots for designation of the historic district which indicated that a majority of the residents were in favor of the designation. At that time, the Historic Preservation Commission moved to send to the Common Council a favorable recommendation to designate East Wayne Street as an Historic Preservation District. The Area Plan Commission gave it a public hearing on July 21, 1987, at which time the following action was taken: Upon a motion by Chuck Sausman, being seconded by Rene Vandewalle, and carried with Brian Crumlish voting "nay", the proposed ordinance initiated by Councilman Joseph Serge amending the Zoning Ordinance of the City of South Bend, Indiana to create an East Wayne Street Historic Preservation District, is sent to the Common council with no recommendation The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report.
