RE: Encroachment into Public Right-of-Way – 924 South Bend Ave.
Dear Mr. Wielgos:
At its June 22, 2021 meeting, the Board of Public Works approved your encroachment request to
allow staging of construction equipment and materials to be placed in the right-of-way at 924 South Bend
Ave, subject to the following conditions:
1. South Bend Avenue right-of-way must remain open and accessible to protect the City’s
underground utilities in the old South Bend Avenue Right-Of-Way.
2. Plating must be provided over the right-of-way to protect the underground infrastructure.
3. There should be no heavy equipment or loading over the right-of-way but it can be used for access
(i.e., to drive over).
4. No large cranes, equipment, piling of materials, or heavy trailers should be stored in the right-of-
way.
5. If any access is required by City staff to maintain the sewer or water main, access should be
provided upon this request for access immediately.
Enclosed please find copies of the permit and application. The encroachment will be permitted
to remain and continue until such time as the Board of Public Works of the City of South Bend shall
determine that such encroachment is in any way impairing or interfering with the highway or with the
free and safe flow of traffic thereon. Said encroachment shall not in any way prejudice or preclude the
City’s rights with respect to the future use of that portion of the right-of-way.

PLEASE INSERT YOUR RECOMMENDATIONS IN THE APPROPRIATE FIELD BELOW,
BASED ON THE FOLLOWING CRITERIA:
1.It has been determined that this encroachment in no way impairs the highway or
with the free and safe flow of traffic thereon, and it is recommended that the
encroachment be permitted to remain.
2.Said encroachment shall not in any way prejudice or preclude the City’s rights with
respect to the future use of the portion of the right-of-way.

The SB Avenue ROW would need to remain open and accessible due to protect the City’s
underground utilities in the old South Bend Ave ROW.
There would need to be plating over the ROW to protect the underground infrastructure in the
ROW. There should be no heavy equipment or loading over the ROW but can be used for access (i.e.
to drive over). No large cranes or other equipment, piling of materials, trailer to be stored in the
ROW. My understanding is that the encroachment area submitted is incorrect and that the ROW
area is the area being requested for the encroachment and that occupancy in the city’s parcel would
be handled in a separate request to RDC. If any access is required by City staff to maintenance the
sewer or water main, access should be provided upon this request for access immediately. See
attached.
