SUBJECT: Award Memo #121-001: Curb and Sidewalk Construction 2021
DATE: June 11th, 2021
On June 8th, 2021, the Board of Public Works opened and read bids for the above project.
The bid is subdivided into 9 divisions, and the city reserves the right to award each division to
the lowest responsive and responsible bidder for that division. The attached bid tabulation
enumerates each bidder’s amount per division.
The bid submitted by TX Concrete did not contain a bid bond nor the documentation required by
the Responsible Bidder Ordinance. Evidence of MWBE Good Faith Efforts in forms 1.0 and 2.1
was also not provided. TX Concrete’s bid shall be considered non-responsive and is
recommended to be rejected as such.
The bid submitted by Ziolkowski Construction omitted forms 1.0 and 2.1 pertaining to WBE
contact and utilization. M/WBE utilization goals were not met by the bidder, and a Good Faith
Effort was not fulfilled by the bidder due to a failure to advertise subcontracting opportunities in
general circulation. Ziolkowski’s bid shall be considered non-responsive and is recommended to
be rejected as such. As a note for the record, Engineering found that the amount of each line
item in Ziolkowski’s bid was rounded to the nearest dollar. The attached bid tab fixes this slight
calculation error by tallying each line to the nearest cent. The corrected calculation records the
total of all divisions at $639,008.24, versus the bid’s written total of $638,970.00. This correction
results in an “increase” of $38.24 but is immaterial to the results of the award, due to
Ziolkowski’s bid being non-responsive.
In the bid submitted by Selge Construction, the MWBE utilization plan fell short of the
established percentage goals specified in the bid documents. However, a Good Faith Effort was
fulfilled by the bidder, and this bid is considered responsive in accordance with the City’s MWBE
Inclusion Program Plan.
The bids by Rieth-Riley and Milestone Contractors North were both found to be responsive,
including all required documentation and meeting the established goals for MWBE utilization.

PUBLIC WORKS CONTRACT
This Agreement is made and entered into this 22nd Day of June, 2021, by and between Rieth-Riley
Construction Co., Inc., 25200 State Road 23, South Bend, IN 46614 (the “Contractor”), and the
Board of Public Works (the "Board”).
The Contractor covenants and agrees to make the following improvement, as fully set out in the
Request for Quotations, Standard Specifications, Special Provisions, Plans, and Bid Proposals, all
of which are set forth as a part of this Contract, for:
PROJECT NO. 121-001
DESCRIPTION: 2021 CURB AND SIDEWALK
COMPLETION DATE: SEE SPECIFICATIONS
AMOUNT: NTE $447,571.94
FUNDING: PR-00008879
The unit prices for this improvement were those prices as received and accepted by the Board on
the 8th Day of June, 2021.
The Contractor further agrees to notify the assigned Engineer when this improvement is
completed. This notification shall be in the form of a Project Completion Affidavit, signed by the
Contractor. Upon final acceptance of the improvement by the Engineer, the Contractor’s final
estimate will be presented to the Board for final Payment with one (1) copy of the Project
Completion Affidavit and one (1) copy of a Waiver of Lien.
Each of the Parties, by signing below, represents and warrants to the other Party that he/she/it has
the authority to bind the named person or entity to this Agreement.

Among the responsive bids received for this project, Rieth-Riley had the lowest amount for each
of the 9 divisions.
Engineering recommends award of a contract for all divisions (A1, B1 B2, B3, C1, D1, D2, E1,
and F1) for a total of $447,571.94 to the lowest responsive / responsible bidder, Rieth Riley
Construction.
Engineering recommends rejecting all other bids.
The Department of Public Works has appropriated sufficient funds through PR-00008879 from the
Motor Vehicle Highway fund: 202-06-602-505-431000—PROJ00000280.
