ORDINANCE NO. 77K7- 77
AN ORDINANCE DELETING CHAPTER 14.5 OF THE
SOUTH BEND MUNICIPAL CODE, ENTITLED "PROPERTY."
STATEMENT OF PURPOSE AND INTENT: The City of South Bend and its
various agencies are required to follow provisions of Indiana statutes
with regard to sale of real property, including but not limited to I.C.
36-1-11, et seq. In order to bring the South Bend Municipal Code into
conformity with current law, it is necessary to delete Chapter 14.5 in
its entirety.
NOW, THEREFORE, BE IT ORDAINED BY THE SOUTH BEND COMMON COUNCIL, as
follows:
Section 1. Chapter 14.5 of the South Bend Municipal Code, entitled
Property, is deleted in its entirety and reserved for future use.
Section 2. This ordinance shall be in full force and effect from
and after its adoption by the Common Council and approval by the Mayor.. \AL, ''''

Dear Council Members:
The attached proposed ordinance deletes Chapter 14.5 of the South Bend
Municipal Code, entitled "Property," since Indiana statutory provisions
now govern this area of municipal law.
By deleting Chapter 14.5 of the South Bend Municipal Code in its
entirety, we are merely removing potentially confusing and conflicting
provisions of the Municipal Code, which, in any case, are no longer
valid law.
If you have any questions about this matter, I will be happy to answer
them.
