RESOLUTION 3855-08 Passed by the Common Council of the City of South Bend, Indiana April 28, 2008 Attest: .~-^ City Clerk President of Common Council Presented by me to the Mayor of the City of South Bend, Indiana April 29, 20 08 Approved and signed by me May 2 ~ 20 0 8 City Clerk ~Y~' RESOLUTION NO. ~ ~S S - ~~ A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 4315 South Lafayette Boulevard AS AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A (5) FIVE-YEAR REAL PROPERTY TAX ABATEMENT FOR Heraeus Kulzer, Incorporated WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 4315 South Lafayette Blvd., South Bend, Indiana, and which is more particularly described as follows: 2E Parcel l: 314 X 675.6" BEG 628' W NE COR SE'/4 NE 1/4 4.86AC SEC 26 37 Parcel 2: 314 X 628' BEG NE COR SE '/4 NE '/4 4.528 A SEC 26 37 2E and which has Key Numbers 23-1013-075802 (Parcel 1) and 23-1013-075801(Parcel 2) presently, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrance's and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of five (5) years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et seq. SECTION III. Dear Council Member Dieter: On April 14, 2008, the Common Council approved a Designating Resolution for a tax abatement for the subject firm. At that time the firm had not completed a list of construction contractors and suppliers for its proposed project as called for in the petition forms. In approving the Designating Resolution it was noted that the firm would qualify for no more than an eight-year tax abatement term. The firm agreed to provide the required information prior to the Council considering its confirming resolution. The project entails the renovation of an existing building located at 4315 South Lafayette Boulevard, South Bend, to be used for the firm's corporate headquarters. The firm has now completed the list of contractors and suppliers and submitted it to me. I have reviewed the information and found that the firm qualifies for a tax abatement term of five years. A copy of the Public Benefit Points Summary used to calculate the abatement term is attached together with a complete copy of the tax abatement petition. A representative of the firm plans to attend the Council's public meeting on Apri128, 2008, to present the firm's Confirming Resolution. DATE: March 20, 2008 On March 19, 2008, a petition for real property tax abatement consideration for property located at 4315 South Lafayette Blvd. was filed with the City Clerk by Heraeus Kulzer, Incorporated. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY Heraeus Kulzer, Inc. is proposing to renovate a 25,000 square foot existing building in order to combine their managerial/administrative staff with their manufacturing facility that is already on the site. The building is the eastern most of three connected buildings and fronts on South Lafayette Boulevard. This move will improve the efficiency of both operations. The company manufactures and distributes dental consumable products on the site. The estimated cost of the project is $1,800,000. The manufacturing facility has been at this location since 1989 and under current ownership since 1995. The previous owner was Bayer. The company has just begun collecting information on potential suppliers and contractors for the project. For this reason they were unable to answer the questions related to suppliers of construction materials and construction contractors. At that time final points will be awarded and the length of the abatement term set. Based on current information, the company will score sufficient points for afour-year term. If they score all of the points for construction they would have enough for seven years. For purposes of consideration of the Declaratory Resolution we are estimating the term at eight years to allow for any extra adjustment. Anything less will result in a reduction in the amount of tax revenue abated. Assuming aneight -year abatement term is approved at the Confirming Resolution, the total taxes to be abated during that term are estimated at $277,908. Total taxes to be paid during the eight-year term are estimated at $213,964. For comparison purposes, if the term remained at four years total taxes to be abated are estimated at $153,710. Total taxes to be paid over the four-year term are estimated at $92,226. EMPLOYMENT IMPACT Per the petition, it is estimated that the total project will create thirty-five (35) new, permanent, full- time jobs representing a new annual payroll of $2,922,953. The project will also retain sixty-one (61) existing, permanent, full-time jobs representing an annual payroll of $3,211,500. ABATEMENT QUALIFICATION 1. A review of the tax abatements previously granted finds that the petitioner has not been granted or associated with any previous tax abatements: 2. The Building Commissioner has reviewed the petition and finds the property to be properly zoned for the proposed project. 3. A review of the South Bend Redevelopment designation areas finds that the property is located in the South Side Development Area, which is a Tax Incremental Allocation Area; therefore, the petition for real property tax abatement must first be approved by the South Bend Redevelopment Commission. 4.
