GAMMON Approved and signed by me � � ig �? / I [1 0 Mayor ORDINANCE NO. -777740 AN ORDINANCE AMENDING SOUTH BEND MUNICIPAL CODE CHAPTER 21 , ARTICLE 6.5, ENTITLED HISTORIC PRESERVATION COMMISSION STATEMENT OF PURPOSE AND INTENT: It is the intent of this Ordinance to amend Chapter 21 of the Municipal Code of the City of South Bend in order to authorize the Historic Preservation Commission to process appli- cations for nominations to the National Register of Historic Places. NOW, THEREFORE, BE IT ORDAINED by the Common Council of South Bend, Indiana, as follows: SECTION I . Section 21 -117 .2 in Article 6 . 5 of Chapter 21 of the Municipal Code of the City of South Bend, Indiana, is hereby amended by the addition thereto of the following new subsection ( 1) : ( 1) The Historic Preservation Commission, as the local government certified by the Indiana State Historic Preservation Officer and the Secretary of the Interior of the United States, shall process National Register of Historic Places Inventory - Nomination Forms in accordance with regulations established by the Historic Preservation Comission consistent with the Indiana Certified Local Government Regulations. SECTION II. The purpose of the amendment is to allow the Historic Preservation Commission to review National Register applica- tions for South Bend properties. Recently, South Bend was designated a Certified Local Government by the U.S. Department of Interior to allow us to assume some of the preservation tasks previously done by the Indiana State Historic Preservation Office and to have more of a role in local preservation issues. One of those tasks is review of National Register applications. Passage of the attached ordinance will enable us to begin that program. The Area Plan Commission gave it a public hearing on June 16, 1987, at which time the following action was taken: Upon a motion by Robert Lehman, being seconded by Theodessa Earles and unanimously carried, the proposed ordinance initiated by Councilman Joseph Serge amending South Bend Municipal Code Chapter 21, Article 6.5, entitled Historic Preservation Commission, City of South Bend is sent to the Common Council with a favorable recommendation The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report.
