'11 71.4 7 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY The 1st North-South Alley West of Ironwood Drive running South from Pleasant St. to the St. Joseph River for a distance of 136 feet more or less. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: the 1st North-South Alley West of Ironwood Drive running South from Pleasant St. to the St. Joseph River for a distance of 136 feet more or less. All being the East fourteen feet of vacated twenty first street and lying adjacent to and abutting Lot 49 of the orginal plat of River Park in the City of South Bend, St. Joseph County, Indiana. (See Exhibit A) hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION:' III. The following property may be injuriously or beneficially affected by such vacating: that portion of vacated 21st street south of Pleasant St. and Lot 49 of the original plat of River Park in the City of South Bend, St. Joseph County, Indiana. SECTION IV. The purpose of the vacation of the real property is to: provide safety for neighborhood children and security for adjacent home owners. SECTION V. OF IRONWOOD DRIVE RUNNING SO. FROM PLEASANT TO THE RIVER Dear Members of the Council: In accordance with Municipal Code Section 18-53.8, a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition filed by Ms. Mary W. Shafer, 2108 Pleasant Street, South Bend, Indiana, to vacate the following property: The 1st north/south alley west of Ironwood Drive running South from Pleasant Street to the St. Joseph River for a distance of 136 feet more or less. For your information, a Public Hearing concerning the Vacation Petition as filed was held by the Board of Public Works on June 16, 1987. Mr. Jeff Reece, Right-of-Way Agent for Indiana and Michigan Electric Company was present at the meeting and advised that the alley which Mrs. Shafer wishes to vacate contains a major tie line between I&M' s east station and the Ireland Station. He stated that I&M had no objections to the vacation with the understanding that no buildings would be erected which would prevent I&M from reaching their transfer station at that location. A copy of the excerpts of the minutes of the Public Hearing is attached for your information. Based on comments made by I&M and favorable comments received from the Area Plan Commission, the Engineering Department and the Department of Economic Development, the Board favorably recommends the vacation of the above referred to alley subject to any and all utility easements.
