AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR FIVE (5)
PROPERTIES LOCATED AT THE SOUTHEAST CORNER OF WESTERN
AVENUE AND LOMBARDY DRIVE LYING IMMEDIATELY SOUTH OF THE
INTERSECTION AND IMMEDIATELY NORTH OF 450 LOMBARDY DRIVE,
COUNCILMANIC DISTRICT 6 IN THE CITY OF SOUTH BEND, INDIANA
STATEMENT OF PURPOSE AND INTENT
Petitioner, Preferred-South Bend LLC is seeking to rezone all of the properties
listed below to Community Business District (CB) for the purpose of constructing
a Walgreens Drug Store at the proposed location. A drug store is a permitted
use in a Community Business District, and rezoning of the property necessary to
support the store would not be inconsistent with the City of South Bend's City
Plan and would be consistent with the current and future use and development of
the surrounding area. The current zoning is as follows:

known as the Zoning Ordinance of the City of South Bend, Indiana, be and the
same hereby is amended in order that the zoning classification of the following
described real estate in the City of South Bend, St. Joseph County, State of
Indiana:

STATEMENT OF PURPOSE AND INTENT
Petitioner is seeking to rezone the subject properties to Community Business District (CB) for the
purpose of constructing and operating a Walgreens Drug Store at the proposed location. A drug store is a
permitted use in a Community Business District, and rezoning of the property necessary to support the
store would not be inconsistent with the City of South Bend's City Plan and would be consistent with the
current and future use and development of the surrounding area.
CB zoning is appropriate for this location, as it is located in a commercial district where there are
numerous existing retail and service businesses that serve the surrounding area, including single-family
residences and a large apartment complex located directly adjacent to the subject property.
The parcel on the corner of Western and Lombardy is currently zoned CB. The other zoned
parcels are MF-1 (Urban Corridor Multi Family District) and LB (Local Business District); and a rezoning
of these parcels to CB will not be inconsistent with the use of the surrounding properties and will unify
the entire area for future use under a single zoning classification consistent with current use.
Concurrent with the filing of this Rezoning Petition, Petitioner will be filing an Application for
Minor Subdivision, to bring the subject properties under a single legal description and common use. If the
new legal description based upon the minor subdivision application, which incorporates the subject
properties, is not issued or otherwise approved prior to the approval of this Rezoning Petition, Petitioner
requests that the rezoning be approved as to each parcel individually as requested. Further, if the new
legal description based upon the minor subdivision is issued or otherwise approved, Petitioner requests
that the rezoning be granted as to the property which comprises the single parcel pursuant to the minor
subdivision.

I hereby Certify that the above referenced ordinance of Barakeh Land Co., Inc, et al was legally advertised
on Thursday, Apri13, 2008 and that the Area Plan Commission at its public hearing on Tuesday, April 15,
2008 took the following action:
Upon a motion by John DeLee, being seconded by Karl King and unanimously carried, the
proposed ordinance and site development plan of Barakeh Land Co., Inc, et al to zone from
MF1 Urban Corridor Multifamily District, LB Local Business District, and CB Community
Business District to CB Community Business District, property located at the southeast corner
of Western Avenue and Lombardy Drive lying immediately south of the intersection and
immediately north of 450 Lombardy Drive, City of South Bend is sent to the Common
Council with a favorable recommendation. The site was previously occupied by several
business and is located within a commercial area. The rezoning will redevelop what has
become a series of underutilized commercial parcels. The rezoning fits well with the existing
commercial uses to the north and west of the site. The rezoning will require several variances
to meet the City of South Bend Zoning Ordinance.
The deliberations of the Area Plan Commission and points considered in arriving at the above decision are
shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of
this report.

The petitioner is requesting a zone change from MF 1 Urban Corridor Multifamily District, LB
Local Business District, and CB Community Business District to CB Community Business
District to allow the construction of a Drug Store.
Land Uses and Zoning:
On site: The site is currently comprised of five parcels: one zoned CB Community
Business District, one zoned MF1 Urban Corridor Multifamily District, and 3
zoned LB Local Business District.
North: To the north across Western Avenue are businesses zoned CB Community
Business District.
East: To the east are apartments zoned MF 1 Urban Corridor Multifamily District.
South: To the south is a vacant lot with an access easement zoned MF 1 Urban Corridor
Multifamily District. South of that are homes zoned SF1 Single Family and
Two Family District.
West: To the west are businesses zoned CB Community Business District.
District uses and development standards:
The CB Community Business District is established to provide a location for high volume and
high intensity commercial uses. Activities in this district are often large space users which may
include limited amounts of outdoor sales or outdoor operations.
Site plan description:
The site is approximately 1 acre. The site plan indicates a proposed 13,600 square foot building.
The building will cover approximately 29% of the site. 45 parking spaces are provided for the
development. Parking and drives will consist of approximately 60% of the site. The remaining
11% of the site will be open space. There are three proposed access points to the development;
two off of Lombardy Drive and one off of Western Avenue. The site will require 11 variances to
comply with the City of South Bend Zoning Ordinance.
Traffic and transportation considerations:
Western Avenue has five lanes at the Lombardy Drive intersection and narrows to four lanes east
and west of the intersection. Lombardy drive has three lanes at the intersection and narrows to
two lanes south of the intersection.
Utilities:
The site will be serviced by municipal utilities.

for new commercial development.
Recommendation:
Based on information available prior to the public hearing, the staff recommends this petition be
sent to the Common Council with a favorable recommendation.
