HomeMy WebLinkAbout07-25-05 Zoning & Annexation Zoning and Annexation Committee 2005 South Bend Common Council The July 25, 2005 meeting of the Zoning and Annexation Committee was called to order by its Chairperson, Council Member Ervin Kuspa at 3:30 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members Dieter, Pfeifer, Puzzello, Kelly, Kuspa, Kirsits, Varner, White and Rouse; Citizen Member Martha Lewis, Brad Poulan, Mrs. Kopola, Sharon Kendall,Robert Palmer,James A.Masters,Larry Magolizzi, City Clerk John Voorde and Kathleen Cekanski-Farrand,Council Attorney. Council Member Kuspa noted that the Committee consists of Council Members Rouse, Dieter and himself. Council Member Kuspa reminded any one wishes to address the committee to state their name and address for the record. Council Member Kuspa asked that persons wishing to testify before the Committee give their name and address for the record. Council Member Kuspa then called for a presentation on Bill No. 05-87 which is a proposed. resolution which would adopt a written fiscal plan and would establish a policy for services to the LT Leasco Annexation Area in Centre Township. Larry Magliozzi of Community and Economic Development made the presentation. He reviewed the Fiscal Plan "Exhibit A" which is attached to the proposed resolution (copy attached). He noted that the property in question is on the south side of Kern Road, approximately 200' east of US 31 South. The 0.59 acres meet the contiguity requirements. Council Member Kuspa then called fora presentation on Bill No. 10-5 which is a proposed ordinance and site development plan of LT Leaseco,LLC to zone from"R"Residential (county) and "SF1" Single-Family (city) to "CB" community business (city), with the property being located at 6306 US 31 South and two (2) lots on the south side of Kern Road adjacent to 6306 US 31 South,which is a companion bill to Bill No. 05-87. Robert stated that the county land is currently vacant. The Area Plan Commission held a public hearing on June 21, 2005 and send the Bill to the Council with a favorable recommendation. He noted that two (2) citizens spoke against the bill at the Area Plan meeting citing traffic and drainage concerns. James A. Masters, an attorney representing the petitioner with offices in downtown South Bend made the presentation. He noted that the two (2) lots currently in the county have a ditch running through them and are unbuildable. The proposed project with not interfere with the ditch and there will not be any development within 75' of the ditch. He noted that the development will result in an significant improvement over what it here currently. No one from the public spoke in favor of the Bills. Rita Kopola of Lakeville spoke in opposition stating that she has drainage concerns. July 25,2005 Zoning and Annexation Committee of the 2005 South Bend Common Council -page 1- In response to a question from Dr. Varner, Mr. Masters stated that there will be no drainage into the ditch and that city sewers will be utilized, as well as dry wells in the parking lot. All water will be retained on site. Following discussion, Council Member Dieter made a motion, seconded by Council Member Kirsits that Bill No. 05-87 be recommended favorably to Council. The motion passed. Council Member Dieter then made a motion, seconded by Council Member Kirsits that Bill No. 10-05 be recommended favorably to Council. The motion passed. There was no miscellaneous business.
