Petition filed for Grade, Curb & walk on Milton Avenue from Michigan street to Fellows street. Hearing on the Assessment Roll and final estimate for the grading on Michigan avenue held over until June 9th, 19051-at 10 A. M. Deeds received from"the Studebaker Bros Mfg Co for alleys in Swygarts addition Clerk was instructed,to have the same recorded. Hearing given on Asse�-sment Roll for awards of damages and assessment cif benefits in the matter of the appropriation of property for the opening of an alley from Sample street to Ohio street, under Condemnation Resolution No. 17 A. adopted on the 4th day of March, 1905. In the above matter a remonstrance was filed by Laura E. Harvey, et al. The Board find that the property affected is damaged and benefitted respectively in the amounts shown on the assessment roll adopted on thF loth day of May, 1905. The Board therefore find that the above remonstrance should be and the same is hereby in all things overrulled. The Board further find that the assessment roll adopted on the s loth day of May, 19052 should be and the same is hereby in all things ratified, confirmed and approved. Messrs McInerny and Papczynsk_i voting Aye and Capt Nicar voting Naye. The Board having under consideration the matter of the amounts of benefits and damages in the Robertson street vacation under Vacation Resolution No, 36. The Board find that the property of the Studebaker,Bros Mfg Co is benefitted in the amount of Fifty ($50.00) Dollars. Come now said Studebaker Bros Mfg Co and waiving all hearing or notice of hearing in the matter, pay into the Treasury of the City of South Bend the sum of Fifty ($50.00) Dollars so assessed and the Board declare said proceedings terminated. Permission granted G. J. Hoffman to temporarily close alley just South of Vistula and East of Michigan street owing to construction of the Kamm & Schellinger Building. Petition received from E. LaSalle avenue property owners asking that double inspection be put on the E. LaSalle avenue Birck Pavement. Same was granted. Petition filed asking for a public haymarket on N. Emerick street between LaSalle avenue and Madison street. Same was granted. Bond of Paul J. Haas filed and approved for Quimby street Curbs & Walks and Fisher street Grade, Curb & Walk. Contracts signed for same. Bond. of Headley Bros filed and approved for the 14arietta street Grade & Curb. Con- tract signed for same. Bona of"John Baer filed and approved for Wayne street Falk & Curb, Eddy street Side- walks, Frances street Curb & Walk.and Florenoe avenue Sidewalks. Contracts signed for same. t Clerk was instructed to advertise for sealed bids for the sale of any or all of the Three dwelling -houses situated on the Matthew Property on Colfax avenue and Matthew Ct. Bids to be received up to 10 a. m. on the-20th, day of June, 1905. A President. TUESDAY EVENING SPECIAL SESSION AT 7:15 P. M. JUNE 6TH2 1905. The Board met in Special Session at 7:15 P. M..All members present. Hearing given on Assessment Rolls and final estimate's for the following Water Connections,- Monroe street from Michigan street to Vistula avenue, Hill street from Jefferson street to Corby street, Scott street from, Colfax avenue to Michigan avenue. No remonstrators appeared and no _-emonstrances were filed, The Board therefore find that the property assessed in said rolls filed May 24th2 1905, is benefitted in the amount of assessments as shown on said rolls and the Board find that the assessment roll filed May 24th, 1905, and the final estimate allowed May 24th, 1905m should be and the same are hereby in all things ratified, confirmed and approved. Hearing given on the Kosciuszko street Grade, Curb & Walk Improvement. Declaratory. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvements that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improve- ment and the same are hereby in all things ratified, confirmed and approved. Petition filed for an Electric Light at the corner of Vistula avenue and May St. Remonstrance filed against the Tutt street Pipe Sewer. Indiana Norther R. R.. Company were notified to bring their tracks to grade on Arnold street. Engineer filed Assessment Rolls and final estimates -:'or the following improve- ments, to -wit; - Brick Pavement on Robertson street from Prairie avenue to Chapin street, Pipe Sewer on Notre Dame street from Wayne street to South end of street. Under Improvement Resolutions Nos. 229 and 23Q. Also Water Connections on Arnold street from Division street to Sample street, Sewer connections on Portage avenue from Leland. avenue to I. I. & I. R. R. Viaduct, E. LaSalle ave-nue from St. Joseph River to Eddy street. Resolved, that notices as to the amount of assessments be published for six consecutive days in the South Bend.Daily Times and the'South Bend Daily Tribune, commencing on the 9th day of June, 1905, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 27th day of June, 1905, at 7:15 P. M. Resolved further, that the entire work under the move contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 9th day of June, 1905, in the South Bend Daily Times and the South Bend Daily Tribune, stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 27th day of June, 1905, at 7:15 p.m President. Friday June 9th. 1905. The Board met in regular session at 10 A. M. All members present. Hearing on Assessment Roll and final estimate for the Michigan avenue grading held over until Wednesday June 14th, 1905, at 10 A. 14I. Notice served on Contractor Joseph Swiatowy and his Bondsman Martin Kubiak to finish the Michigan avenue grading within Five (5) days or the same will be done by the City, looking to the bondsman for the payment of same. Petition filed by Alfred Kling el and others for permission to use part of Howard Park for religious services. Petition granted under directions of Park Sup't. Contract signed with Wm. N. Bergan for the lease of a strip of land on N. Emerick street for a Public Haymarket. Plat of Kaley's Third Addition approved. Hearing on Assessment Roll for Grade, Curb & Walk and Gravel Road on Lawrence street held over until Saturday June loth, 1905, at"10 a. m. Hearing given on Assessment Roll and Final Estimate for Grade, Curb & ?Talk & Gravel Road on Lawrence street, under Improvement Resolution No. 199. No remonstrators appeared and no remonstrances were filed. The Board therefore find that the property assessed in said rolls filed May 5th2 19052 is benefitted in the amount of assessments as shown on said rolls and the Board find that the assess- ment roll Piled May 5th, 1905, and the final estimate allowed May 5th2 1905, should be and the same is hereby in all things ratified, confirmed and approved. The Board net in Special Session at 7:15 P. M. Mr. McInerny absent. Hearing given on Declaratory Resolutions for the following improvements, to -wit; - Grade, Curb & Walk on Marion Boulevard,Grade, Curb & Walk on'N. Eddy street from South Bend avenue to -St. Vincent Street, Walks on Johnson street from Bertrand street to Longley avenue, Pipe Sewer on Harrison avenue from Michigan avenue to Freubringer street. All under Improvement Resolutions Nos. 268, 2692 270 & 272 respectively. In`the above matter No remonstrators appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvements that the benefits to the Property and to the City of.South Bend are equal to the estimated cost of said improvement and the same are hereby in all things ratified, confirmed and approved. Remonstrance filed by the property owners on Foote street against paying for the street intersections on the Foote street Improvement. The Lake Shore & Michigan Southern R. R. Co were given permission to excavate in the street for Railroad gates at Christian and Sample street. Hearing given on Declaratory Resolutions for the following improvements, to-wit;;P_60fe5f" Grade,. Curb,.Walk and Macadam, Scott & Lindsey street Pipe Sewer, Tutt street Pipe Sewer All under improvement resolutions Nos. 2672 271 & 273 respectively. Engineer filed his estimated cost as follows; - Foote street Grade, Curb, Walk & Macadam $22500.00 Scott & Lindsey street Pipe Sewer 42000.00 Tutt street Pipe Sewer 22000.00 In the above matter no remonstr-antors appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvements that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improvements and the sa7h6 are hereby in all things ratified, confirmed and approved. Clerk was instructed to advertise for bids for the above improvements;also for Pipe Sewer on Harrison avenue, Grade, Curb & Walk on Kosciuszko street, Marion Boulevard, Eddy street, Walks on Johnson street. Be it r4solved that notices be published in the South Bend Daily Times on the 19th clay of June and on the 26th day of June, 1905, to the effect that this Board will receive bids for said improvements up to 10 a. m. on the 5th day of July.-1905. Hearing on Condemnation Resolution No. 20 deferred until Friday June 23rd, 1905 at 10 a. m. Clerk was instructed�to notify the County Commissioners and the County Engineer to appear before the Board on at the meeting of June 23rd, 1905. Communication received from J. B. Arnold asking for street signs at the corner of LaPorte avenue and LaSalle avenue. Clerk was instructed to notify the %Michigan Central Railroad Co to lay pavement on Emerick street where their team track has been removed. President. 23 Tu e pc14yJune 20th, 1905. The Board net in regular session at 10 A. M. All members present. Remonstrance Piled against the Street Sprinkling on So. Lafayette street in the 400 block. .Petition filed by Studebaker Bros Mfg Company asking permission to construct a bridge across Tutt street to connect their buildings, said bridge to be no less than 50 feet above the street line. Same was granted. Petition filed by the South Bend 1A1holesale Grocery Company asking permission to place and maintain a side track across Carroll street from the errand Trunk R. R. to their new building. Same was granted. Engineer reported grade on Andersons Court. Same was approved. Engineer filed Assessment Rolls and final estimates for the following improvements, to -wit; - Pipe Sewer on Fellows street from Monroe street to L. S. & M. S. R. R. and from Monroe street to a point 353 feet North of Monroe street, Brick Pavement on Laurel street from Washington street toColfaxavenue, Studebaker street from Wa-hington street to Linden avenue; all under Improvement Resolutions Nos. 237, 2492 230 & 232 respectively; Also Sewer Connections on Arnold street from Sample street to Division street. Resolved, that notices as to the amounts of assessments be published for.six con- secutive days in the South Bend Daily Times and the South Bend Daily Tribune, commencing on the 21st day of June, 1905, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the llth day of July, 1905, a 7:15 P. Bids were received for the sale of -the houses on William street and Matthew Court. The East house on Matthew Court No. 351 was sold to Mr. Schelling for $275.00. The West house on Matthew Court was sold to Max Winkowski for the sum of $325.00. All bids for the Colfax avenue house were rejected and the Clerk was instructed to re- advertise for the sale of the same at same future date. ( over) Tuesday June 20th, 1905. It is hereby stipulated by and between the parties in the above entitled cause that the title to the following described property, to -wit: All of that part of lot four(4) in the partition pl'9t of Samuel Leer Estate, which lies between the following described lines, and claimed by Casimir Major et al, as Mot being a part of the Vistula Road (Avenue) but belonging to said Major, et al, t©-wit: _ Beginning at the point of intersection of the East line of said lot four (4), and the north line of Vistula avenue, as defined being thirty-three (33) feet at right angles from the center line of said Avenue, thence north 740 24' West One thousand one hundred ninety-nine and one half (12199 1/2) feet to a point 28.025 feet north of the center of Vistula avenue, thence north 5.8 feet, thence south 74° 47' East Six hundred twenty -Pour and one tenth (624.1) feet on a line parallel to and thirty-three (33) feet from the center line of Vistula avenue,, thence south'72* 37' east five hundred seventy-five and one tenth (575.1) feet on a line parallel to and thirty-three (33) feet from the center line of Vistula avenue to the place of beginning, shall be quieted in the defendant, the City of South Bend, Indiana, as and for a public'higriway, road and street, the same to be quieted at the cost of the Plaintiffs in said suit. Is is further stipulated and agreed that the street -car track, as now laid along and adjacent to.said property shall in no event be laid nearer to the North Street line, than they now are; that the said City shall not undertake to force said track to be laid closer to said north line of said Vistula avenue than they,are at the present time. (North It is further stipulated that if a side -walk should ever be placed upon the side of Vistula avenue, the same shall be made flush with the north curb of I said Avenue where the same passes along the property belonging to the Plaintiffs A in this case. It is further stipulated that the Plaintiffs in the above entitled cause shall be released and relieved by the City of South Bend from any assessment for the grading and curbing of said Vistula Avenue along their property as now assessed. It is further�stipulated that no,service poles shall be set between the sidewalk and curb line. It is further agreed that this stipulation be made a part of the order in suit now pending,,and spread upon the Records of the Board of Public Works of the City of South Bend, Indiana. It is further stipulated that -in case said street is paved, that the street car tracks shall be brought to the grade of said street, and the said pavement to extend to the north curb line of said street. No remonstrators appeared and no remonstrances were filed. The Board therefore find that the property assessed in said rolls filed May 9th2 19052 is benefitted in the amount of assessments as shown on said rolls and the Board find that the assessment roll filed May 9th 1905, and the final estimate allowed May 9th2 1905, should be and the same is hereby in all things ratified, confirmed and approved.
