Washington street, known as the Washington street Interceptor. Hearing on Cushing Addition Sewer System and Woodward & DeMaude avenue Pipe Sewer L nder Improvement Resolutions Nos. 198, 225 respectfully. Remonstrance filed by Edward Pfister against the Cushing Addition Sewer. The Board rind that the property assessed in said assessment rolls filed January 18th, 1905, is benefitted in the amount of assessments as shown on said amended assess- ment rolls and the Board of Public Works find that the assessment rolls filed January lFth 1905 and the final estimate allowdd January l9th, 1905, should be and the same are hereby in all things ratified, confirmed and approved. AGREEMENT FROM THE OLIVER CHILLED PLOW WORKS. South Bend Indiana, Jan. 29th, 1905. WHEREAS, the City of South Bend, by its board of Public Works, has contracted to lay pipe sewer from the foot of Washington street, in a northerly direction to the river at East Colfax avenue, in said City, and whereas, it appears that The work can be done to better advantage by laying the sewer through certain grounds belonging to the Oliver Chilled Plow Works situate between the streets above mentioned. Now, therefore, in consideration of the sum of one dollar, the receipt of which is hereby acknowledged, we do hereby grant unto the City of South Bend by its Board of Public Works permission to pass through and to lay and maintain said pipe sewer through said premises. The Board find that the property assessed in sailassessment roll filed JanuarV 31st, 1905, is benefitted respectively in the amount shown on said assess- ment roll as now amended, and the Board of Public Works find that said assessment roll as amended be adopted and said assessment confirmend. And the Board find that said sewer "and the work connected there- with io completed with the exception of certain minor details, and that said final estimate should be allawred, 'subject to the witholding by the City the sum of Fifteen hundred ( 1,5oo.00) Dollars to insure the completion of any work under said contract not completed at this time, or to pay for said work by the City should said Contractor fail so to do within a reasonable time. And comes now Peter Suzio, the contractor herein, and asserts the witholding of the sum of Fifteen hundred ($1,5o0.00) Dollars as above set forth, and the Board of Public Works find that subject to the above named conditions, the said final estimate should be and the same is hereby allowed and confirmed and approved. Peter Suzio makes verbal statements of certain amounts due him for extra work done on said Fassnacht Avenue Sewer.The Board requires said statement to be filed in wri ing. Resolved by the Board of Public Works of the City of South Bend, Indiana: That it is desirable to vacate the following: All of the alley in Creeds 2nd addition lying adjacent to and along:_ the,;east ends of lots.12, 13, 142& 15 and adjacent to and between lots 15 & 16 of said addition and running from the south line of Indiana I venue along said lots to the east line of south Lafayette street. The following property may be injurously or beneficially effected by such vacation. J. P. Creed. Indiana Anchor Fence Co. Terre Haute & Logansport Ry Co. Lots 12, 132 14, 15 & 16 Creed's 2nd addition. Lease interest in lots 12, 132 142 15 & 16. Right of way south from Indiana avenue along Creed's 2nd addition. Notice of this resolution shall be published on the 16th day of February and on the 23 day of February 1905 in the South Bend Daily Times. The Board met in Special Session at 7:15 P. M. All members present. Hearing given on the following Declaratory Resolutions for the following improvements, toQwit;- Brick Pavement on Robertson street, Laurel street & Studebaker street all under Improvement resolutions Nos. 229, 230 & 232 respectively. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvements that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improvements and the same are hereby in all things ratified., confirmed and approved. Engineer filed his estimated costs of the improvements as follows; - Robertson street Brick pavement ........ $12654.00 Laurel street Brick pavement.......... 1,658.00 Studebaker street Brick. pavement....... 4,616.00 Be it resolved that notices be published in the South Bend Daily Times and the South Bend Daily Tribune on the 25th day of February and on the 4th day of March 1905, to the effect that this Board will receive bids for said improvements up to 10 a. m. on the 15th day of March 1905. The Board reserves the right to reject any and all bids. Remonstrance filed aginst the Laurel street Pavement. Overruled. Remonstrance filed against the E. Monroe street Brick pavement. Mr. Wm Mack and Andrew Kener appeared in person and remonstrated against the Hill street Brick pavement. Petition filed for change of specification for Scott street pavement so as to narrow the street two feet and set the curbs out two fFet on the west side of the street, making said street uniform. Hearing on East -Monroe street, Hill street and Scott street Brick pavements, under Improvement resolutions Nos. 227, 228 and 231 respectively. Held over. uncoil Friday February 24th, 19052 at 10 A. Contractor Bond of John Baer filed and approved. South Bend Electric Company were notified to discontinue the light at the Park Skating Rinks. South Bend Electric Company were order th istall the following lights. Cor Grant & Ford street Cor Franklin street and Indiana avenue. Petition filed Tuesday February 21st, 1905 asking that Scott street be narrowed two feet so as to make both sides of t .,e street uniform, was GRANTED. Postponed hearing given on the following Declaratory resolutions for the following street improvements, to -wit; -- Brick pavement on N. Hill street, N. Scott street and E. Monroe street under Improvement Resolutions Nos. 229, 231 and 227 respectively. In the above matter remonstrances were filed and remonstrators appeared. After due consideration the Board find that said remonstrances should be over -ruled, and therefore find in each and. every case in said improvements that the benefits to the property and to the City are equal to the estimated cost of the said improvements and th same are hereby in all things ratified, confirmed and ap1-.roved. Engineer filed his estimated cost of the improvements as follows. Hill street Brick pavement.............$262163.00 Monroe street, Brick pavement........... 14,036.00 Scott street Brick pavement............ 4,774.00 Be it resolved that notices be published in the South Bend Daily Times and the South Bend Daily Tribune on the 25th day of February and on the 4th day of March 1905, to the effect that this Board will receive bids for said improvements up to 10 A. Hearing given on Vacation ResoluTion No. 35, vacating the following described property, to -wit; - All of the alley in Creed's 2nd addition lying adhacent to a d along the east ends of lots 12, 132 142 & 15 and adjacent to and between lots 15 & 1 of said addition and running from the south line of Indiana avenue along said lots to the east line of south Lafayette street No remonstrators appeared and no remonstrances were filed. The Board therefore declae the above described property in all things vacated. The property of the Indiana Anchor Fence Co is benefitted in the amount of $25.00 No property is injuriously affected. The property of the Indiana Anchor Fence Co is therefore assessed in the amount of .$25.00. Now comes W. H. Mack representing the Indiana Anchor Fence Co and waiving notice and hearing of assessment under Vacation Resolution No. 35, pays unto the.treasury of said City the sum of $25.00 President.
