The Hon Board of Public Works.
Gentlemen: --
When the Fassnaeht avenue trunk sewer was started, I had the line laid out for the
center line of Brick avenue, but when the contractor excavated his trence to the depth
of -the old sewer returning into Brick avenue from Michigan avenue, we found the old sewer
curved to a point Four feet from the center line and in order to join the old sewer
properly I had to shift the line of the new sewer four feet at the south line of
Michigan avenue, running to nothing attthe manhole in the center of Euclid avenue.
The change required extra excavation, placing of sheeting and lengthening of braces
and I recommend tha allowance of the following amount to Peter Suzio Contractor, for
extra work done and for full and complete renumeration for the same.
With regard to the use of extra cement used in concrete, such cement was used at the
instance of the contractor for various reasons and not on the order of the Engineer
and no a1ik_:_wance could be properly made for the same.

street from Washington street to Linden avenue, Brick Pavement on alley east of
Michigan street from Mayne street to Grand Trunk Alley, Trunk Sewer on South Bend
avenue from St. Joe River to Arthur street.

Resolved that notices as to the amount of assessments be published for six
consecutive days in the South Bend Daily Times and the South.Bend Daily Tribune, com-
mencing on the 5th day of December 1904, stating that this Board will give a hearing
on the amount.of such assessments at its office in the City Hall on the 13th day
of December, 1904, at 7:15 P. M.
Resolved further that the entire work under the above contract be accepted
and approved and,the final estimate thereon allowed. Notice of this resolution
shall be published on the 5th day of December 1904, in the South Bend Daily Times
and the South Bend Daily Tribune, stating that this Board will give a hearing upon
the acceptance of such work at its office in the City Hall on the 13th day of
December 1904, at 7:15 P. M.
VACATION RESOLUTION NO. 33.
Resolved by the Board of Public Works of the City,of South Bend, Indiana. That
It is desirable to vacate the following: --

2nd, Addition. Begin at the south west corner of Lot 7 in Coquillard's 2nd addition,
thence east 165 feet to the south east corner of lot 7 in said addition, thence south

Notice of this resolution shall be published on the 6th day of December and on the
13 day of December 1904 in the South Bind Daily Times.
This Board at its office in the City Hall on the 20 day of December 1904 at
10 A. M. Will hear and receive remonstrances from all persons interested in or affected
by these proceedings.

Hearing given on assessment rolls and final estimate for the following
improvements, to —wit; --
Brick pavement on Napier street from Chapin street to Walnut
street, Pipe Sewer on Robertson street from Prairie avenue to alley east of
Chapin street. All under improvement resolutions Nos. 209,224 respectively.
Also Water connections on Napier street from Chapin street to Walnut street.
No remonstrators appeared and no remonstrances were filed. The Board therefore
find that the property assessed 1n said rolls filed November 23, 19042 is benefitted
in the amount of the assessments as shown on said rolls and the'Board of Public
Works find that the assessment rolls filed November 23, 1904 and the final estimate
allowed November 23, 1904 should be and the same are hereby in all things ratified,
confirmed and approved.

THIS AGREEMENT made this 9th day of December A. D. 19042 by andbetweenthe City
of South Bend, by and through its Board of Public Works, party of the first part, and
the South Bend and Southern Michigan Railway Company, a corporation organized under and
by virtue of the laws of the states of Michigan and Indiana, as party of the second part,
WITNESSETH: For convenience, the South Bend and Southern Michigan Railway Company,
its successors, lessees and assigns, will be hereinafter be spol,,en of and designated in
this contract by the wort. "Company".
That the party of the first part does hereby grant unto the said company, its
successors, lessees and assigns, the right to"operate or have operated, its cars over
and along the following tracks of the Indiana Railway Company, within said City of
South Bend, as follows;
Commencing at the intersection of the tracks of the two companies, at or near
the south bank of the St. Joseph river in the said City of South Bend, thence south
through Michigan street to Jefferson street; thence east through Jefferson street to
St. Joseph street; thence north through St. Joseph street to Vistula avenue; thence
northwest on Vistula avenue to Washington street; thence west on Washington street to
Michigan street; thence north on Michigan street to the place of beginning. The cars
of said company shall run over the tracks -and use the power and wires of said Indiana
Railway Company upon such terms as may be agreed upon between the said companies.
Provided, however, that said company shall transport local passengers to and from
points, within the City limits, reached by its lines and not reached by lines of
the Indiana Railway Comapny, at a rate not to exceed five cents per passenger for a
continuous trip; said company to issue transfers -to and receive transfers from the
Indiana Railway Company, upon such terms as may be agreed upon between said companies;
which agreement in reference to transfers shall be satisfactory to, and filed with the
Board of Public Works of said City.,Provided further, that in case the said company shall
operate a local car over its lines, then this last foregoing clause with reference to the
transportation of passengers and the issuance of transfers within the City limits, shall
not be held to apply to the interurban cars of .said company.
Said company shall not have authority to lay any tracks, or erect any poles or string
any wires in the City of South Bend, under the provisions of this contract.
This contract shall take effect and be in force, provided, within thirty days
from the confirmation of the same by ordinance of the Common Council of the City of
South Bend, said company shall file with the City Clerk, a written acceptance of the
same; and the said Indiana Railway Comapny shall likewise file with the City Clerk
its written consent for the operation of the cars of the said company over its tracks
as designated herein; and upon the filing of said acceptance and consent, this contract
shall take effect, and be and remain in full force.
IN TESTIMONY WHEREOF, we have hereunto set our hands and seals this 9th day of
December A. D., 1904, in duplicate.

opening and widening, under Condemnation resolution No. 16 adopted on the 23rd day of
August 1904.
The Board being fully advised in the matter. It being unanimously resolved that
this Condemnation Resolution No. 16 be and is hereby in all things recinded and
no further action to be taken on same.
