The Board met in re gular session at 10 A. All members present.
Whereas *the City Civil Engineer did on the 1st, day of July, 1904, submit a
proposed change of grade on Portage avenue, and Whereas, it is the opinion of the
Board that. such change of grade is needed and will be beneficial to the public
interests.
It is unanimously resolved that said proposed grade be and the same .is hereby
adopted and approved.
.Engineer notified to prepare specifications for Grade, Curb & Walk on Portage Aie

Sidewalk, Marion Boulevard and East Navarre street Pipe Sever, Hine street Grade,
Curb & Walk, Keasey street pipe Sewer. under improvement resolutions Nos. 180, 156,
174; 189 respectively.
No remonstrators appeared and no remonstrances were filed. The Board find that
the property assessed in said rolls filed June 21th, i904 is benefited in the
amount of assessemnts as shown on said rolls, and the Board find that the assess-
ment rolls filed Ju.^e 29th and the ,final -estimate allowed June 29th, 1204 should
be and the same are hereby in all things ratified, confirmed and approved.

Company and the A. C. Staley Mfg Company were notified to remove ashes, cinders and
rubbish which they have been dumping into the St. Joseph river from tip to time
said ashes, cinders and rubbish to be removed within 5 days from date.

A local sewer in and along Bronson Street and Marietta street from. Vistula avenue
and Bronson street to Sample street.Said improvement shall be known and designated as
the Bronson street Sewer and shall be constructed according to the plans and speci-
fications prepared by the City Civil Engineer, -tiled Herewith. Notice of this reso-
lution and proposals for bids for the execution of the above work shall be publish-
ed on the 20 day of July, 1904 and on the 27th day of July 1904 in the South Bend
Daily Times and the South Bend Daily Tribune. This Board will give a hearing on this

The following communication was received from the Oliver Chilled Plow Works.
To the Board of Public Works
Of the City of. South Ben_, Ind.
We .acknowledge service this day of your notice dated July 16, 1904, concern—
ing our obstruction of the flow o;' the St. Joseph River and note your instructions
to remove same withing five days. We most cordially approve the action of the Board
in this respect and think it a wise and timely move.
In view of the fact, however, that we are engaged in the installation of an
extensive power plant on the West Race which wi'l require several months to complete
and the consequent necessary but temporary obstruction of the r iver front of our
property, we respectfu'.ly ask a suspension of the order in our case until this work
if finished. We promise to expedite the work all thdtis possible and when completed
we will promptly remove all coffer dams and uerb is of whatever character in compliance
with your order.
Trust ing that our request may not appear unreasonab le and hat t he same may b e

Resolved that the change of grade on Portage avenue from Hudson avenue to
City limits as reco=,ended by the City Engineer be and the same is hereby
adopted and approved.
Whereas, the change of- grade -on Portage avenue from Hudson avenue to t point
beyond the city limits, as recommended by the City Engineer, Ias thi day been
approved and adopted, and
Whereas, said change of grade entails the raising the tracks of the I. I." & I.
Ry to confora with the said grade, and the removal of the present viaduct over
said tracks.
Resolved that the Engineer submit plans immediately for the grading and
improving of said avenue to conform to this newly established grade and that the
I. I. & I. Ry Company be served with a copy of this resolution and be requested
to change the grade of their tracks to conform hereto. -

Resolved by the Board of Public Works of the City of South Bend, Indiana: That
an improvement be made of the kind size, location and.terminal points as follows:
The improvement of Lawrence street from Corby street to the South line of Napoleon
street. The improvement to consist of grading the street the Full width to .the
established sub -:grade, excepting Howard street already graded, 'also grading out the
approaches on intersecting streets and alleys and the end of Lawrence street at
Napoleon street for an approach, also the construction of ce ment sidewalks and
curbing and graveling the roadway with six inches of bank or pit , gravel of coarse
material suitable for highway purposes. Said improvement sha11 be known and
designated as "Lawrence street Grade, Curb M Walk" and shall be constructed ac:!ordiig
to the plans and specifications preparedby the City Civil Engineer filed herewith.

Resolved by the Board of Public, Works of the City of South Bend, Indiana: That
an improvement be made of the kind, size, location and terminal points as follows,,
The construction of Cement sidewalks where not already lain, on Jackson street
from Washington street to Linden avenue. Said improvement shall be known and
designated as the " Jackson street Cement Walks" and shall be constructed according
to the plans and specifications preparedby the City Civil Engineer, filed herewith.
Notice of this resolution and proposals forbids for the execution of the avobe work
shall be published on the 27 day of JUly 1904 and on the 3 day of AuP;ust 1904
in the South Bend Daily Times and the South Bend Daily Tribune. This Board will
give a hearing on this resolution at its office in the City Hall on the 9th day of
August 1904, at 7:15 P. M. and will receive bids- up to 10 A. on the 10 day of
August 1904.

The Board met in special session at 7:15 P. M. All members present.
Hearing given on the assessment rolls and final estimates for Pipe Sewer on
Hill street, Pipe Sewer on E. LaSalle avenue, Bridge St., Sycamore street, Grade,
Curb & Walk on Lindsey street Pipe -Sewer on Michigan avenue all under im:_ rovement
resolutions Nos. 173, 1519 178, 187 respectively.
In the matter of the Pipe sewer on Michigan avenue and the Grade, Curb & Walk
on Lindsey street. No remonstrators appeared and no remonstrances were filed The
Board therefore find the property assessed. in said roll is benefitted in the amounts
of the assess ments as shown on said rolls, and that the assessment roll filed on the
12th day of July 1904 and the final estimate allgwed on the 12th day of July 1904
should be and the same are hereby in all things ratified, confirmed and approved.
In the matter of the Pipe Sewer on 'mall street and LaSalle avenue, Bridge street
Sycamore street, Philip Strichler of Hill street remonstrated stating that he was
assessed for 3*,6 feet more ground than he had. The Board therfore rebated him 4.3.08
for the same. Mddge Leighton remonstrated stating that she had been assessed for
2 feet of ground which belonged to Sops is Becker. The Board there fore rebated her
fvr saiwe and charged the amount to the assessment of Sophia Becker. Emanuel R. Wills
of Sycamore street remonstrated stating that he .raving a river fronta ge should
be exempt from assessment. The Board after due consideration find that E. R. Wills
shouldbe rebated the amount of his aassessment but charged up for the tap same
costing $13.30.
The Bord find that the property described in said roll as amended is benefitted
in the amount of assessment as shown on said amended rolls and assessment roll
filed July 12, 1904 and final estimate allowen on the 12 day of July 1906, should
be and the same are hereby in all things ratified, confirmed and approved.
