GAMMON Approved and signed by me /0 c)'(0 79ql Mayor SUBSTITUTE BILL NO. 96-9/4/ ORDINANCE NO. g51-/`-!(9 q AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,AMENDING CHAPTER 2,ARTICLE 8 OF THE SOUTH BEND MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 2-125 ENTITLED OPERATION SAFE NEIGHBORHOODS PROGRAM STATEMENT OF PURPOSE AND INTENT On July 8, 1994, the Members of the Fraternal Order of Police ratified the wage and fringe benefit package offered by the City of South Bend by a vote of 142 to 9. One of the component parts of that package was the creation of a new program "Operation Safe Neighborhoods"Program. The following Ordinance sets forth the criteria for qualifying officers and sworn members of the South Bend Police Department who legally establish residence within designated areas of the city to seek housing reimbursement on a quarterly basis. The following Ordinance establishes those specific criteria governing the "Operation Safe Neighborhoods"Program for the South Bend Police Department. Chapter 2, Article 8 of the South Bend City Code is hereby amended by the inclusion of new Sec. 2-125 which shall read in its entirety as follows: Sec. 2-125. "Operation Safe Neighborhoods Program" (a)Purpose. The City of South Bend desires to provide financial incentives for officers and sworn members of the South Bend Police department to live in designated inner city neighborhoods for calendar years 1995, 1996, and 1997. (b)Eligibility.All full-time sworn members and officers of the South Bend Police Department who live within the designated areas identified in"Exhibit A"entitled "Operations Safe Neighborhoods Areas"which is attached hereto and included herein by reference with one (1)copy being available for inspection during regular business hours in the office of the City Clerk, may be eligible to participate in the "Operation Safe Neighborhoods" Program. The maps depicted in "Exhibit A" shall also be posted in the classroom of the South Bend Police Department, along with a copy of the Ordinance. The "Operation Safe Neighborhoods"Program is available on a first come first serve basis to all sworn members meeting the criteria established herein. (c) Initial Requirements. The following criteria must be met in order for mortgage or rental assistance to be received in calendar years 1995, 1996, and 1997: 1)The sworn member or officer of the South Bend Police Department must complete the required application form for mortgage or rental assistance; 2)The sworn member or officer of the South Bend Police Department must purchase or rent a residential unit for his or her own personal use which is located within the "Operations Safe Neighborhoods" Area as designated by the South Bend Common Council in paragraph (b) herein, and provide an affidavit signed under penalties for perjury which verifies residency in the City, dates of such residency, and that liability insurance on the residential unit is in effect for each quarter; and 3)The sworn member or officer of the South Bend Police Department must reside in such designated area for a minimum of twelve (12) months or be subject to reimbursing the City for the last quarter where such officer or sworn member fails to meet • "Operation Safe Neighborhoods" Page 2 (d) Financial Incentives: A maximum of One hundred twenty-five dollars ($125.00) of the monthly mortgage or rental amount due and owing on qualifying residential units may be reimbursed to a qualifying officer or sworn member of the South Bend Police Department. Said qualifying officer or such member of the South Bend Police Department must file under oath an affidavit verifying residency and liability insurance coverage as set forth in paragraph(c)herein. Total monies available for the"Operation Safe Neighborhoods"Program shall be determined by the Common Council through the amount budgeted for each calendar year in calendar years 1995, 1996, and 1997. If the sworn member or officer of the South Bend Police Department moves from the qualifying residential unit, all financial incentives described herein shall immediately cease and such officer or sworn member of the South Bend Police Department may be subject to reimbursement requirements addressed in paragraph 3). The City of South Bend shall assume no financial liability for such residence except for the financial incentives described herein. In the event that a sworn member or officer of the South Bend Police Department currently lives within the "Operation Safe Neighborhoods" Program area described in Exhibit A, he or she may file for mortgage or rental assistance pursuant to the terms set forth herein. (e) Procedure. All sworn members or officers of the South Bend Police Department desiring to participate in the"Operation Safe Neighborhoods"Program must submit a completed application form to the Office of the City Controller and must cooperate with the processing of said application. The Office of the City Controller will review submitted documents, authorize payment(if warranted), and issue reimbursement checks on a quarterly basis to qualifying sworn members or officers. (f) Additional Regulation. The City of South Bend reserves the right to establish additional rules and regulations as deemed necessary, but in no event shall the City reduce the amount of the maximum monthly incentive during the budget year. Section II. Third District The attached Ordinance would formally establish and address the Ann Puzzello overall purpose of the program, the eligibility requirements, the financial Fourth District incentives, the procedures involved, as well as reserve the right for additional regulations to be established as the program evolves. Sixth District The Council will formally need to establish the exact boundaries of Sean Coleman the areas incorporated within the "Operation Safe Neighborhoods Areas" At Large throughout the City of South Bend. I would recommend that this Bill be sent to the Public Safety Committee for review and recommendation, and Loretta Duda have further input from the Council, Chief Marciniak, and Members of the At Large FOP.
