MEMORANDUM OF UNDERSTANDING AMENDMENT #3
This Memorandum of Understanding Amendment #3 is entered into by and between The Trustees
of Indiana University (“IU”) and the City of South Bend, Indiana Venues, Parks, and Arts Department
(“VPA”), by and through its Board of Park Commissioners (“BPC”), (collectively referred to hereinafter
as the “City”) and is made effective as of August 1, 2021.
WITNESSETH:
WHEREAS, IU and City are parties to that certain Memorandum of Understanding Between the
City of South Bend and The Trustees of Indiana University for IU’s use of the City’s Leeper Park Tennis
Center located at 837 N. Lafayette Blvd., South Bend, Indiana, 46616, which MOU has been amended
and extended by that certain Memorandum of Understanding Amendment #1 and that certain
Memorandum of Understanding Amendment #2 (the MOU as amended is hereinafter collectively referred
to as the “Original MOU”); and
WHEREAS, the Original MOU expires on July 31, 2021; and,
WHEREAS, IU and City wish to extend the term of the Original MOU.
NOW, THEREFORE, in consideration of the mutual obligations contained herein, and other good
and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, IU and the
City hereby agree as follows:
1. The Term of the Original MOU shall be extended for an additional one (1) year term,
beginning August 1, 2021, and expiring July 31, 2022.
Except as amended herein, all of the terms and provisions of the Original MOU shall remain in
full force and effect.
IN WITNESS WHEREOF, the parties have executed this Memorandum of Understanding
Amendment #3 effective as of the date indicated above.
