AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED IN THE 1000 BLOCK OF
BENDIX DRIVE BETWEEN HARTZER STREET AND BONDS
AVENUE IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
SECTION I : Ordinance No. 4990-68, as amended, which
Ordinance is commonly known as the Zoning Ordinance of the City
of South Bend, Indiana, be and the same hereby is amended in
order that the zoning classification of the following-described
real estate in the City of South Bend, St. Joseph County, State
of Indiana:
Lot 28 as shown on the Plat of Westchester
First Unit, South Bend, Indiana, and the
north 1/2 of the first north-south alley
east of Bendix Drive, running south from
Bonds Avenue a distance of approximately
114 .93 feet to the east-west alley between
Bonds and Hartzer, in the City of South
Bend, Indiana,
be and the same is hereby established as B-Residential "A" Height
and Area District.
SECTION II : This Ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor, and legal publication.

The undersigned hereby makes application and petitions
the Common Council of the City of South Bend, Indiana, to amend
the Zoning Ordinance as herein requested.
(1) The property sought to be rezoned is vacant land adjacent to
Petitioner's existing private clinic located in the 1000
block of Bendix Drive between Hartzer Street and Bonds
Avenue, South Bend, Indiana, in the "Westchester First Unit"
subdivision.
(2) Name of property owner: Saint Joseph' s Medical Center,
Inc. , 811 East Madison, South Bend, Indiana 46617; tele-
phone: (219) 237-7222.
(3) Petitioner owns Lots 22 through 28 . Lots 23 through 27,
inclusive, are currently zoned B-Residential and Lots 22 and
28 are currently zoned A-Residential. The north one-half of
the first north-south alley east of Bendix Drive is
immediately adjacent to the western edge of Lot 28, and is
being vacated by tile Petitioner. Petitioner seeks to

rezone Lot 28/Only from A-Residential "A" Height and Area to
B-Residential "A" Height and Area.
(4) This rezoning is requested so as to allow the following
uses: Additional future parking for public or private
clinics and principal offices of physicians or dentists.
(5) Attached is a copy of (a) legal description of the property;
(b) a list of names and addresses of all property owners
within 300 feet of the petitioned property; (c) self-
addressed, stamped envelopes of all property owners within
300 feet of the petitioned property; (d) five copies of a
site development plan.
(6) By signing this Petition, I understand that if the Council
approves this Petition for Rezoning, it may be approved
subject to the submittal of a final site plan. A final site
plan must be submitted to the Area Plan Commission within
one year of the Council ' s action. Failure to admit a final
site plan within that time period causes the zoning of the
petitioned property to revert to the initial zoning class-
ification. Time extentions on the submittal of the final
site plan may be requested.

RE: A proposed ordinance and site development plan of St. Joseph's Medical
Center to zone from "A" Residential, "A" Height and Area to "B"
Residential, "A" Height and Area property located on the east side of
Bendix Drive between Hartzer Street and Bonds Avenue, City of South Bend -
APC #1195-88
Gentlemen:
The above referenced ordinance and site development plan of St. Joseph's
Medical Center was legally advertised September 8 and- September 10, 1988. The
Area Plan Commission gave it a public hearing on September 20, 1988 at which
time the following action was taken:

Upon a motion by Robert Lehman, being seconded by
Charles Roger, and unanimously carried, the proposed
ordinance and site development plan of St. Joseph's
Medical Center to zone from "A" Residential, "A" Height
and Area to "B" Residential, "A" Height and Area
property located on the east side of Bendix Drive
between Hartzer Street and Bonds Avenue, City of South
Bend is sent to the Common Council with favorable
recommendation; as tendered
PLEASE NOTE that the Ordinance has been amended by the petitioner to include a
legal description different than that used for the Common Council's first
reading. The amended Ordinance was the Ordinance legally advertised and heard
by the Area Plan Commission.

REQUESTED ACTION: The petitioners are requesting a zone change from
"A" Residential , "A" Height and Area to "B"
Residential , "A" Height and Area to allow
additional future parking for public or private
clinics and principal offices of physicians or
dentists.
EXISTING LAND USE: The property is currently vacant.
SURROUNDING LAND USE AND ZONING: Located to the north is a bank zoned "C-1"
Commercial; to the east is a single-family home
zoned "A" Residential ; to the south is vacant land
zoned "A" Residential ; to the west is St. Joseph
Medical Center zoned "B" Residential .
ACCESS: Access to the site is from Bonds Avenue on the
north , and an alley off Hartzer Street to the
south.
DRAINAGE: The drainage has been addressed by the
petitioners.
DATA: The total site to be rezoned is 6,770 square feet.
Of that , the parking and drives will occupy 4,060
square feet, or 607. of the site, and 2,710 square
feet or 40% of the site will remain as open space.
SITE PLAN: The site plan meets the requirements of a final
site plan.
AGENCY COMMENTS: The City Engineer noted that the site plan
conforms to City Engineering Department
requirements.
