The Board of Public Safety met in the Executive Session on Friday, November 2, 2012 at 8:00 a.m.
The meeting was held in the Mayor's Conference Room, 14th Floor, County City Building, South
Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5- 6.1(b) 6(A) regarding Disciplinary Action.
Board President Patrick Cottrell and Board Members Laura Vasquez, Eddie Miller, and Luther
Taylor were present. Board member John Collins was absent. Also present was Attorney Andrea
Beachkofsky. Board members did not discuss any subject matter other than the subject matter as
specified in the Public Notice. The meeting adjourned at 8:27 a.m.
SPECIAL MEETING NOVEMBER 2 2012
The Board of Public Safety met in a Special Meeting a, 8:32 a.m. on Friday, November 2, 2012, with
Board President Patrick D. Cottrell, and Board Members Laura Vasquez, Eddie Miller, and Luther
Taylor present. Board member John Collins was absent. Also present was Board Attorney Andrea
Beachkofsky.
The meeting was held in the Board of Public Works Meeting Room, 13`h Floor County City
Building, South Bend, Indiana.
POLICE DEPARTMENT
APPROVE MOTION TO RECONSIDER — CHRISTOPHER BORTONE
Ms. Beachkofsky stated on October 24, 2012, the Board received a Motion to Reconsider from
Edward J. Merchant, Legal Counsel for Officer Christopher Bortone, requesting the Board reconsider
its modification of Mr, Bortone's status from administrative leave/relieved of duty with pay to
administrative leave-/relieved of duty without pay effective October 25, 2012. In his motion, Mr.
Merchant noted that the facts and circumstances that created the need for the continuance were not of
Mr. Bortone's doing, and completely out of his control. Upon a motion by Ms. Vasquez, seconded
by Mr. Taylor and carried, the Motion to Reconsider was approved and Mr. Bortone's status was
amended to administrative leave/relieved of duty with pay from October 25, 2012 to December 4,
2012.
ADJOURNMENT
There being no further business to come before the Board, Mr. Cottrell declared the meeting
adjourned at 8:3 8 a.m.

The Board of Public Safety met in a Special Meeting at 11:00 a.m, on Tuesday, December 4, 2012,
with Board President Patrick D. Cottrell, and Board Members Laura Vasquez, Eddie Miller, John
Collins and Luther Taylor present. Also present was Special Counsel Joseph Simeri, and Attorneys
Edward Merchant, and Andrea Beachkofsky, and Police Chief Charles Hurley. The meeting was held
in the Common Council Chambers, 4`h Floor County City Building, South Bend, Indiana.

- - HEARING OF CHARGES NO. 2012 -05 — CHRISTOPHER BORTONE
This was the date set for the Hearing of Charges No. 2012 -05 concerning the matter of Patrolman
Christopher Bortone, South Bend Police Department. A court reporter was present to record the
proceedings.
