AN ORDINANCE AMENDING CHAPTER 20 OF THE SOUTH BEND MUNICIPAL CODE
ENTITLED "TRUCK ROUTES"
STATEMENT OF PURPOSE AND INTENT
The Common Council and the City administration has determined that an
amendment is necessary to the Truck Route Ordinance. The following bill
incorporates the amendment which is deemed to be in the best interest of
the City of South Bend.
NOW, THEREFORE, BE IT ORDAINED. BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AS FOLLOWS:
SECTION I . Chapter 20, Article 8, Section 20-106 is amended to read as
follows:
Section 20-106. Definitions.
As used in this Article, the following terms shall mean:
(a) "Truck" as the term is used in this Section, is a vehicle
having three ( 3 ) axles with-an-eves}}-Iength-ef-twenty-4-29}-feet-mere;
er-ever-ene-fi}-ten-eapaeity; or a vehicle over ten thousand ( 10,000)
gross vehicle weight, and includes semi-trailer trucks and either the
tractor pulling the same, or the trailer itself. Truck includes every
self-propelled commercial vehicle designed, used or maintained for the
commercial transport of goods or property.'-desefbed-as-feiiews-
(b) "City block" as the term is used in this Section is that portion
of a public street bounded by the highest and lowest numbers within any
sequence of 100s, such as 200 to 299, 300 to 399, etc.

(c) This Article also applies to any vehicles manufactured, assembled
or modified on a commercial or military basis and transported or operated
on/in the streets of the City of South Bend. Such vehicles must be so
operated on truck routes in accordance with this ordinance. This shall
include any and all vehicles manufactured, assembled, modified,
transported or operated singularly or in quantity by any business
operating in or through the City of South Bend.

SECTION II. Chapter 20, Article 8, Section 20-107 is
amended to read as follows:
(a) No person shall operate a truck or vehicle as
defined in Section 20-106 within the corporate limits of the
City of South Bend, except upon the following streets and
parts of streets shown upon a map entitled "Schedule A-1",
incorporated herein by reference, or if the specific
conditions of Section 20-108 (c) are met. At least two (2)
copies of said map shall be on file in the Office of the
Clerk for public inspection.
Such streets and parts of streets are hereby designated as
official truck routes:

(b) All trucks or vehicles as defined in Section
20-106 shall follow state or national highways and City
truck routes as shown on "Schedule A-i". They shall not
travel upon anv other public streets of the City, except as
provided in Section 20-108 (c) .
SECTION III. Chapter 20, Article 8, Section 20-108 is
amended to read as follows:
Section 20-108. Restrictions.
(a) No person shall drive anv truck or vehicle as
defined in Section 20-106 upon any public streets not
designated as a truck route in "Schedule A-1" of the City at
any time; provided that such trucks or vehicles may be
permitted upon such other public streets of the City, upon
the direction of a City or State police officer, to follow a
marked and established City detour, to obtain necessary
emergency mechanical repairs, or if for safety reasons upon
the prior approval of the City Engineer and the Police
Department.
(b) All trucks and vehicles as defined in Section 20-
106 shall proceed by the shortest combination of State and
Federal highways and City truck routes shown upon "Schedule
A-i", and shall be prohibited from driving upon any other
City streets unless said vehicle is in the process of
delivering or picking up goods as further addressed in sub-
section (c) herein or is itself in the process of being
delivered. A written bill of lading or similar document
must be produced by the driver if stopped while driving on a
City street which is not designated as a City truck route as
shown in "Schedule A-i", or detour route to verify such
pickup or delivery.
(c) All trucks within-the-eity, as defined in this
artiele Section 20-106 when finished delivering or picking
up goods within the City shall return to the nearest truck
route by the most direct route, This-inelades-sueh-traeks

(1) The driver has in his or her possession a written bill of lading
or similar document for the next subsequent delivery or will have a
pick-up order upon reaching said subsequent pick-up location(s) ; and
(2) The driver has in his or her possession a written manifest or
similar document which shows in clear and plain English all of the
scheduled delivery or pick-up location(s) for that day; and
( 3) The distance from the first delivery or pick-up location off the
truck route to the next subsequent delivery(s) or pick-up location(s) is
not greater than a total of nine (9) city blocks from the first delivery
or pick-up location.
So long as the conditions of this section are met, it is the intent of
this section to permit as many subsequent deliveries or pick-ups from the
initial location which was off of the designated truck route so long as
such subsequent deliveries or pick-ups are within the maximum nine (9)
city block distance from the initial delivery or pick-up location. It is
the further intent of this section to permit subsequent deliveries or
pick-ups by the truck if such subsequent deliveries or pick-ups are on the
most direct route back to the designated truck route.
(d) Any truck driver who is stopped by a Police Officer on a street
which is not designated as a truck route, and who does not have a written
bill of lading and a written manifest or similar documents as required by
sub-paragraph (c) herein, shall be in violation of this section and shall
be issued a citation.
(e) The Board of Public Works may designate from time to time by
proper resolution specific streets or blocks thereof, where trucks are
expressly prohibited due to safety reasons or engineering standards. The
city shall post signs prohibiting trucks in such designated locations.
Any truck driving in such prohibited areas shall be in violation of this
section and shall be issued a citation.
(f)-fd} No person shall stop, stand or park a truck as defined in.
this-artiele Section 20-106 on any street, other than for the expeditous
loading or unloading of freight, except in cases of emergency when such
truck is broken down and unable to move, and except also in the event a
moving van is loading or unloading furniture and household goods, or the
furniture and equipment and goods, wares and merchandise of a business, in
either or which events the operator of such truck will have a reasonable
time in which to complete his loading or unloading and move his truck.
SECTION IV. Chapter 20, Article 8, Section 20-109 is amended to
read as follows:

this Article do not apply to vehicles ( 1) licensed to operate upon tracks,
(2) licensed to carry passengers for hire, (3) municipal government
vehicles operating on official business or ( 4) public utility vehicles
operating on official business.
SECTION V. This ordinance shall be in full force and effect from and
after its adoption by the Common Council, approval by the Mayor and legal
publication.
