Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots 19, 20, 21 & 22, & the W. 7.00' of Lot 18, University Place; The N 198.00' of Lot 151, Part of Sorin's Second Addition, located E. of the 1st N/S alley located W. of Lawrence St. ; The S. 198.00' of Lot 146, Part of Sorin's Second Addition, located E. of the 1st N/S alley located W. of Lawrence St. , except the E. 90.00' of the S. 54.00' . Lots 2, 4, & 6, Hickey's Sub. SECTION VI. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the mayor, and legal publication. September 8 and September 10, 1988. The Area Plan Commission gave it a public hearing on September 20, 1988 at which time the following action was taken: Upon a motion by Joseph Serge, being seconded by Willie Morgan and unanimously carried, the proposed ordinance initiated by Councilman Ann Puzzello to rezone a portion of the Northeast Neighborhood from "B" Residential and "C" Commercial, "A", "B", "D" and "E" Height and Area, to "A" Residential, "A" and "B" Height and Area, "B" Residential, "A" Height and Area, "C" Commercial, "B" and "D" Height and Area, and "C" Commercial, "A" and "E" Height and Area, generally described as: The four corners of Howard St. and Lawrence St. , except the very NW corner; the SE and SW corners of South Bend Ave. and Notre Dame St.; the area S. of Corby Blvd., W. of the first N/S alley E. of St. Peter St., E. of the first N/S alley W. of St. Louis Serving: South Bend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph County, IN September 21, 1988 The Honorable Common Council City of South Bend Page Two St., and N. of the lots fronting onto South Bend Ave. ; the area W. of Eddy St. , S. of Campeau St., extended, E. of the first N/S alley W. of Frances St. , and N. of Sorin St.; the triangular area bounded on the W. by Eddy St. , on the S. by the lots fronting onto South Bend Ave., and on the N. by land owned by the University of Notre Dame; and the triangular area bounded on the S. by Corby Blvd. , on the E. by Jacob St., extended, and on the N. by the lots fronting onto South Bend Ave, City of South Bend is sent to the Common Council with a favorable recommendation, as amended PLEASE NOTE that the Ordinance has been amended by the petitioner to include a legal description different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Johnson RSJ/sr Attachment C STAFF REPORT INITIATED BY COUNCILMAN ANN PUZZELLO #1144-87 September 13, 1988 City of South Bend REQUESTED ACTION: This petition was initiated by Councilman Ann Puzzello on behalf of the residents of the northeast neighborhood. The majority of the property is zoned "B" Residential, which allows multi—family dwellings and certain office uses. Residents have expressed a desire to change the zoning to "A" Residential which would allow only single—family residences, since this is the predominent use of the neighborhood. Changing the zoning of the residential area to "A" Residential will not affect the existing duplex, multi-family office, or commercial uses, as these would all have legal vested rights to operate. The ownership of these parcels may also change without having to rezone to operate legally. The East Bank area south of Corby Blvd. will remain unchanged as well as the commercial area at the northwest corner of Eddy St. and Miner St. The commercial area at the four corners of Lawrence St. and Howard St. will be reduced to only a small parcel at the northwest corner. The size of the commercial area at the intersection of South Bend Ave. and Eddy St. will be slightly reduced by eliminating the area north and east of the intersection of South Bend Ave. and Howard St. The size of the commercial area south of South Bend Ave. and east of Notre Dame Ave. will be slightly increased to include existing businesses. Also, the northwest corner of Sorin St. and Eddy St. will be changed to commercial because of an existing business.
