REGULAR MEETING APRIL 13, 2021
The Regular Meeting of the Board of Public Works was convened at 9:35 a.m. on Tuesday, April
13, 2021, by Board President Elizabeth A. Maradik. The meeting was streamed live to the public
with Board President Elizabeth A. Maradik and Board Members Gary Gilot, Jordan Gathers, and
Joseph Molnar present. Clerk Anne Fuchs confirmed the presence of the members with a roll call
and noted that new Board Member Murray Miller would likely be joining later, at which time
she would state his attendance for the record. Also present was Board Attorney Clara McDaniels.
Ms. Maradik reminded virtual attendees to use the Teams Live Q&A feature and to please
include their name for the record.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Molnar, seconded by Mr. Gathers and carried by roll call, the
minutes of the Regular Meeting of the Board held on March 23, 2021, were approved.
OPENING AND AWARD OF BIDS — APPROVE CONTRACT — 2020 COMMUNITY
CROSSINGS ROUND 2 — PROJECT NO. 120-059 (PR-00007707)
This was the date set for receiving and opening of sealed bids for the above referenced project.
The Clerk tendered proof of publication of Notice in the South Bend Tribune, which was found
to be sufficient. The following bids were opened and publicly read:

Upon a motion made by Mr. Molnar, seconded by Mr. Gathers and carried by roll call, the above
bids were referred to Engineering for review and recommendation. After reviewing those bids
during the meeting, Mr. Scott Kreeger, Engineering, provided a memo to the Board
recommending award of the contract to the lowest responsive and responsible bidder Rieth Riley
Construction Co., Inc. in the amount of $282,343.20 for Divisions A and B. Therefore, Mr.
Molnar made a motion that the recommendation be accepted, and the bid be awarded, and the
contract approved as outlined above. Mr. Gathers seconded the motion, which carried by roll
call.

Mr. Zach Hurst, Engineering, advised the Board that on March 23, 2021, quotations were
received and opened for the above referenced project. After reviewing those quotations, Mr.
Hurst recommended that the Board award the contract to the lowest responsive and responsible
bidder, Rieth-Riley Construction Co., Inc., 25200 State Road 23, South Bend, IN 46614, in the
amount of $39,396. Therefore, Mr. Molnar made a motion that the recommendation be accepted,
and the quotation be awarded, and the contract approved as outlined above. Mr. Gathers
seconded the motion, which carried by roll call.

WHEREAS, it has been determined by the Board of Public Works that the following property is unfit for
the purpose for which it was intended and is no longer needed by the City of South Bend:
Three (3) Bomb Suits from Police Department
WHEREAS, pursuant to Indiana Code § 36-9-6-1 et. seq., the Board of Public Works ("Board")
has the duty and authority to have custody, control, use, and to dispose of all real and personal property
owned by the City of South Bend, Indiana; and
WHEREAS, the City, acting by and through the Board, desires to dispose of the personal
property that is more particularly described at Exhibit "A" attached hereto and incorporated herein
("Property"); and
WHEREAS, in accordance with Indiana Code § 5-22-22-4, the Board may engage an auctioneer
to conduct a public auction in order to dispose of the City's surplus personal property if the property to be
sold is one (1) item with an estimated total value of $1,000 or more, or is more than one (1) item with an
estimated value of $5,000 or less; and
WHEREAS, the Board has determined that the Property has an estimated value of less than
$5,000, and the Board has further determined that the property is unfit for the purpose for which it was
intended, and is no longer needed by the City of South Bend; and
NOW, THEREFORE, the Board of Public Works of the City of South Bend hereby finds that the
Property listed at Exhibit "A" is no longer needed by the City; the Property is unfit for the purpose for
which it was intended, and has an estimated value of $5,000 or less.
BE IT RESOLVED that the Property may be transferred or sold at public auction. However, if
the Property is deemed to be worthless, such Property may be demolished By Davy Textiles LLC.

WHEREAS, the City of South Bend Board of Public Works (the "Works Board") exists and
operates pursuant to Ind. Code 36-8-3 and South Bend Municipal Code § 2-50; and

WHEREAS, the Works Board has exclusive control over all matters and property relating to the
South Bend Police Department (the "SBPD") pursuant to Ind. Code § 36-8-3-2(b)(2); and
WHEREAS, the SBPD possesses certain property, namely: used One (1) Bomb Suit which have
been retired from service in accordance with NFPA 1851 standards and deemed surplus property pursuant
to Ind. Code § 5-22-22-12; and
WHEREAS, Aaron M. Knepper, a St. Joseph County employee, has made known to the SBPD
the significant need for police and emergency services equipment for use by a smaller person for the
provision of emergency services; and
WHEREAS, the SBPD wishes to gift, under the supervision of and with the assistance of
Port of Seattle (WA) Bomb Disposal Unit, (the "Donees") all of which service areas located in the City of
South Bend; and
WHEREAS, pursuant to Ind. Code § 5-22-22-12(e), a governmental body may transfer title of
surplus property to a police department by sale, gift, or another arrangement acceptable to the
governmental body and the fire department.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND BOARD OF
PUBLIC WORKS AS FOLLOWS:
1. The Safety Board hereby approves the donation and transfer of the one (1) Bomb Suit
from the SBPD to (the "Donees"), and authorizes staff of the SBPD to work with Port of Seattle (WA)
Bomb Disposal Unit to carry out any and all actions necessary to facilitate the transfer.
2. This Resolution will be in full force and effect upon its adoption by the Safety Board.

A RESOLUTION OF THE SOUTH BEND INDIANA BOARD OF PUBLIC WORKS
ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY
WHEREAS, it has been determined by the Board of Public Works that the following property is unfit for
the purpose for which it was intended and is no longer needed by the City of South Bend:

WHEREAS, pursuant to Indiana Code § 36-9-6-1 et. seq., the Board of Public Works ("Board")
has the duty and authority to have custody, control, use, and to dispose of all real and personal property
owned by the City of South Bend, Indiana; and
WHEREAS, the City, acting by and through the Board, desires to dispose of the personal
property that is more particularly described at Exhibit "A" attached hereto and incorporated herein
("Property"); and
WHEREAS, in accordance with Indiana Code § 5-22-22-4, the Board may engage an auctioneer
to conduct a public auction in order to dispose of the City's surplus personal property if the property to be
sold is one (1) item with an estimated total value of $1,000 or more, or is more than one (1) item with an
estimated value of $5,000 or less; and
WHEREAS, the Board has determined that the Property has an estimated value of less than
$5,000,and the Board has further determined that the property is unfit for the purpose for which it was
intended, and is no longer needed by the City of South Bend; and
NOW, THEREFORE, the Board of Public Works of the City of South Bend hereby finds that the
Property listed at Exhibit "A" is no longer needed by the City; the Property is unfit for the purpose for
which it was intended, and has an estimated value of $5,000 or less.
BE IT RESOLVED that the Property may be transferred or sold at public auction. However, if
the Property is deemed to be worthless, such Property may be disposed of via the COSB Household
Electronic Waste program.

SHELTERS TO THE SOUTH BEND PUBLIC TRANSPORTATION CORPORATION
("TRANSPO")
Upon a motion made by Mr. Molnar, seconded by Mr. Gathers and carried by roll call, the
following Resolution was adopted by the Board of Public Works:

A RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS
APPROVING THE TRANSFER OF BUS SHELTERS TO
THE SOUTH BEND PUBLIC TRANSPORTATION CORPORATION ("Transpo")
WHEREAS, the South Bend Board of Public Works ("Public Works"), the contracting
body of the City of South Bend, Indiana (the "City"), which exists and operates under the
provisions of I.C. 36-9-6 (the "Act"), holds certain Bus Shelters; and
WHEREAS, Transpo is a political subdivision, operating and existing under the laws of
the State of Indiana, operates the public transit system (the "Transit System"); and
WHEREAS, pursuant to I.C. 36-1-11-8, Public Works and Transpo may transfer or
exchange property with one another upon terms and conditions agreed upon by the entities; and
WHEREAS, Public Works agrees to transfer the Bus Shelters described and attached
hereto as Exhibit A to Transpo; and

WHEREAS, Transpo agrees to accept the transfer of and full responsibility for the Bus
Shelters as described and attached hereto as Exhibit A from Public Works; and
WHEREAS, Transpo will adopt a resolution substantially identical to this Resolution
agreeing to accept the transfer of the Bus Shelters; and
NOW, THEREFORE, BE IT RESOLVED:
1. The Board of Public Works approves the transfer of ownership of the Bus Shelters listed
in Exhibit A to Transpo.
2. Transpo accepts ownership of the Bus Shelters listed in Exhibit A and agrees to assume
responsibility for maintenance and repair of such Bus Shelters as of the effective date of this
Resolution.
3. Transpo agrees to allow the City limited use of the advertising panel on the shelters to
promote City events and/or programming.
4. This Resolution shall be in full force and effect upon its adoption.

2021 held electronically as authorized by the Governor's Executive Order 20-09, as subsequently

INDIANA BOARD OF PUBLIC WORKS FOR SEWER AND WATER EXTENSION POLICY
FOR AREAS OUTSIDE OF THE CITY LIMITS
Ms. Maradik introduced Director of Planning Tim Corcoran to speak about the forthcoming
policy. He explained that there is currently no policy regarding these services, so the City wishes
to provide a fiscally responsible path forward that encourages compact and efficient development
and that encourages revitalization and reinvestment. He explained that the City wants to promote
annexation as number one way for new developments to connect to City services, but there
would be some exceptions considered. He shared that the City is also providing a map showing
areas where water and sewer extensions can take place. He thanked the Legal Department, City
Engineering, the Mayor's Office, and the County Health Department for their collaboration. Ms.
Maradik thanked Tim and the others for their collaboration on this policy.

LIMITS
AUTHORITY
The Board of Public Works (the "Board") of the City of South Bend (the "City") adopts this

statement of policy (this "Policy") pursuant to the Board's authority for supervision of streets,
alleys and City property under Indiana Code Section 36-9-6-2 and South Bend Municipal Code
Chapter 17.
STATEMENT OF PURPOSE AND INTENT
The City of South Bend provides sewer and water utility services to some unincorporated areas
of St. Joseph County. As the City of South Bend wishes to provide sewer and water services in a
fiscally responsible manner; promote compact and efficient development; through infill projects,
encourage revitalization and reinvestment in areas already serviced by municipal sewer and
water; and guide property owners, developers, and the public on which land is most appropriate
for future development and utility extensions, the City has created this Policy for extending and
connecting to its municipal sewer and water infrastructure for areas outside City limits.
CITY SEWER AND WATER EXTENSION FOR AREAS OUTSIDE THE CITY LIMITS
Sec. 1 Sewer and Water Services
Sewer and water services pertain to the system including water pressurized main lines and its
components and sewer gravity and forced main lines and its components.
Sec. 2 Sewer and Water Extension
The City, through the Board, shall not extend sewer and/or water services, including a
connection, to a parcel outside City limits unless:
(a) The parcel is annexed into the City, per criteria found in state law and the City's
annexation policy, or
(b) The parcel meets one of the exceptions listed in Section 3.
See.3 Exceptions
The parcel shall have an executed Consent to Annexation and Waiver of Right to Remonstrate in
place prior to a connection to City services. Exceptions listed below must be documented and
certified in the application process according to the Board's requirements.
(a) Established Subdivision Exception. A new house is constructed in an established
subdivision platted before April 13, 2021, where there is written agreement that the City
will provide sewer and/or water services. Unless exempted in accordance with the terms
and conditions of the agreement between the City and the subdivision, the parcel must:
1. Be adjacent to an existing City sewer and/or water utility infrastructure; or,
2. The sewer and/or water service(s) must be extended at no cost to the City and at a
size and depth to meet future needs as established by the City Engineer.
(b) Health Department Exception. The St. Joseph County Health Department, with
agreement from the Board, has declared a public health hazard due to contaminated wells
or failing septic tanks so that:
1. The connection to City sewer and/or water is in the best interest of public health;
and
2. The parcel must be adjacent to an existing City sewer and/or water utility
infrastructure; or
3. The sewer and/or water service(s) must be extended at no cost to the City and at a
size and depth to meet future needs as established by the City Engineer.
Sec. 4 Sewer and Water Extension Map
The City shall maintain a digital map as depicted in Exhibit A, which is incorporated herein by
reference and attachment, showing parcels outside of city limits that are:
1. Parcels serviced by City sewer and/or water.
2. Parcels where the City, through a written agreement, has committed to provide
sewer and/or water service.
3. Other parcels eligible for sewer and/or water connection(s).

The map may be amended from time to time by the Board following conference with and
recommendation from both the Department of Public Works and the Department of Community
Investment.

A RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA, BOARD OF PUBLIC
WORKS AUTHORIZING THE TRANSFER OF REAL PROPERTY TO THE SOUTH
BEND BUILDING CORPORATION
WHEREAS, the City of South Bend, Indiana, Board of Public Works (the 'Board")
exists pursuant to Indiana Code Section 36-4-9-5, holds real property owned by the City of South
Bend, Indiana (the "City") pursuant to Indiana Code Section 36-9-6-3, and is authorized to
transfer such property to another governmental entity pursuant to Indiana Code Section 36-1-11-
8; and
WHEREAS, the Common Council (the "Council") of the City has given consideration to
the financing and refinancing of all or a portion of the costs of (1) repairing or reconstructing all
or any portion of the City streets listed at Exhibit A attached hereto which will consist of all or
any of the following activities: full -depth reconstruction, mill and overlay, microsurfacing and
crack sealing, and spot repairs of brick streets in historic neighborhoods (collectively, the "Street
Projects") and (2) completing certain improvements as more fully described at Exhibit B
attached hereto (collectively, the "Infrastructure Projects") (clauses (1) and (2), collectively, the
"Projects") in the City; and
WHEREAS, the City of South Bend Building Corporation (the 'Building Corporation")
has heretofore been incorporated as a nonprofit corporation for the sole purpose of serving as an
"on behalf of issuer" for federal income tax purposes to assist the City in financing public
improvements; and
WHEREAS, the Street Projects will include improvements to certain real property in the
City which the Board owns acting for and on behalf of the City and which is generally described
at Exhibit C (the "Property"); and
WHEREAS, following a public hearing, the Council adopted an ordinance at a meeting
held on March 22, 2021, which ordinance approved a form of lease with the Building
Corporation pursuant to which the Building Corporation will lease to the City the Property and
the City will pay rentals to the Building Corporation which the Building Corporation will use to
pay the principal of and interest on bonds to be issued by it for the purpose of financing the costs
of acquiring the Property and paying for the costs of the Projects and costs related thereto; and
WHEREAS, the Building Corporation desires to acquire an interest in the Property for
the purpose of leasing the Property pursuant to the terms of the Lease and has adopted a
resolution substantially identical to this Resolution agreeing to accept the transfer of the
Property; and
WHEREAS, the City, as the owner of the Property, seeks and concurs in the transfer of
an interest in the Property to the Building Corporation for a purchase price equal to $8,600,000,
and the Board desires to approve such transfer;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND,
INDIANA, BOARD OF PUBLIC WORKS AS FOLLOWS:
1. The Board hereby approves of the conveyance of the Property to the Building
Corporation in accordance with Indiana Code 36-1-11-8 at a purchase price equal to $8,600,000
(the "Purchase Price"). Following the issuance of the Bonds by the Building Corporation and
upon receipt of cash in an amount not less than the amount of the Purchase Price, the President
of the Board (the "President") is authorized and directed, in the name of the City, to execute and
deliver a quit claim deed conveying title to the Property to the Building Corporation.
2. The Board authorizes such other actions as may be necessary to effect the recording of
the Deed in the Office of the Recorder of St. Joseph County, Indiana, and further authorizes the
execution of such other documents and any other actions which may be necessary to effectuate
the transfer of the Property to the Building Corporation.
This resolution will be in full force and effect upon its adoption by the Board.

APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — 350 E. LASALLE AVE.
Ms. Maradik stated an application for an Encroachment and Revocable Permit has been received
from F.A. Wilhelm Construction for the purpose of allowing railing and raised sidewalk for
ADA access to be placed in the right-of-way at 350 E. LaSalle Ave. The encroachment shall
remain in the right of way until the time as the Board of Public Works of the City of South Bend
shall determine that such encroachment is in any way impairing or interfering with the highway
or with the free and same flow of traffic. Upon a motion made by Mr. Molnar, seconded by Mr.
Gathers and carried by roll call, the Revocable Permit was approved.
APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — ONE (1) PEDESTRIAN

Ms. Maradik stated an application for an Encroachment and Revocable Permit has been received
from Burkhart Sign Systems for the purpose of allowing two (2) Joe Kernan Memorial Trail
directional signs to be placed in the right-of-way one (1) at the pedestrian bridge/overlook and
one (1) at the East Bank Trail/Northside Blvd. The encroachment shall remain in the right of way
until the time as the Board of Public Works of the City of South Bend shall determine that such
encroachment is in any way impairing or interfering with the highway or with the free and same
flow of traffic. Upon a motion made by Mr. Molnar, seconded by Mr. Gathers and carried by roll
call, the Revocable Permit was approved.
UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE ALLEY

Ms. Maradik indicated that Joshua Barthuly, 1125 Blaine Ave., South Bend, IN 46616, has
submitted a request to vacate the above referenced alley. Ms. Maradik advised the Board is in
receipt of unfavorable recommendations concerning this Vacation Petition from Engineering and
Community Investment, stating the vacation fails to meet three (3) of the I.C. 36-7-3-13 Criteria.
Therefore, Mr. Molnar made a motion recommending submission of an unfavorable
recommendation to Common Council for the request for vacation. Mr. Gathers seconded the
motion which carried, by roll call.

Each claim is fully supported by an invoice; the person receiving the goods or services has
approved the claims; and the claims have been filed with the City Fiscal Officer and certified for
accuracy. Therefore, upon a motion by Mr. Molnar, seconded by Mr. Gathers, and carried by roll
call, the Board ratified the preapproved claims payments.
PRIVILEGE OF THE FLOOR
Ms. Maradik stated that there were questions in the Live Q&A regarding bid openings read into
the record that she asked Attorney McDaniels to address. Ms. McDaniels responded by
confirming information read into the record regarding bids in the Live Chat.
Ms. Maradik asked Board Clerk Anne Fuchs to provide an update regarding the award of the
2020 Community Crossings Round 2 Bid. Ms. Fuchs provided the memo from Engineer Scott
Kreeger to the Board Attorney and Ms. Maradik, recommending the bid award. Ms. Maradik
read the memo into the record, as outlined earlier in these minutes.
Ms. Maradik took a moment to thank and welcome new Board Member, Murray Miller.
Mr. Gilot raised the previously denied alley vacation, adding that although the vacation is not the
answer to this resident's concerns, the issue should be referred to the South Bend Police
Department to find out if the area is a hot spot or valid crime issues to be remediated. He
extended his empathy to this resident.
