GAMMON Approved and signed by me. -z-ZA L\ z°) 19 gS Mayor Substitite Bill No. 55-88 Ordinance No. %90 O AN ORDINANCE FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS OF THE SOUTH BEND FIRE DEPARTMENT FOR THE CALENDAR YEARS 1989 and 1990 STATEMENT OF PURPOSE AND INTENT The South Bend Common Council has the responsibility for fixing by ordinance the annual compensation of all members of the Fire Department, pursuant to Indiana Code 36- 8-3-3 (d) . A six-person City Negotiating Team was authorized by the South Bend Common Council, Board of Public Safety, and the City Administration to negotiate on behalf of the City all pay and monetary fringe benefits. The City Negotiating Team and the Wage Committee of the South Bend Firefighters Association, Local No. 362 have held several negotiating sessions concerning annual pay and monetary fringe benefits. Members of the South Bend Firefighters Association, Local No. 362 voted on July 25, 1988 and July 26, 1988, and ratified the City's final offer on wages and benefits. The following ordinance sets forth the details of the City's accepted offer which is the best possible wage and benefit package for the Firefighters, which the City can afford. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. (a) The South Bend Common Council recognizes the Wage Committee of the South Bend Firefighters Association, Local No. 362, as the sole bargaining unit for the annual pay and monetary fringe benefits for sworn members of the South Bend Fire Department excluding the Fire Chief, Assistant Chiefs, and Battalion Chiefs. (b) The Fire Chief, Assistant Chiefs and Battalion Chiefs of the South Bend Fire Department are designated in this ordinance as "Officers." SECTION II. (a) Annual pay for the officers and other sworn members of the South Bend Fire Department, by rank, for calendar years 1989 and 1990 shall be as follows: RANK 1989 1990 Fire Chief 37,750 38,350 Assistant Chiefs 34,250 34,850 Battalion Chiefs 30,250 30,850 Specialists 23,869 24, 669 Captains 23,519 24,319 Engineer 10+ vrs. of service 22 ,469 Engineer after 3 complete yrs. of service from date of hire to 5 yrs. Firefighter 1st Class 18,969 19,869 Firefighter, Probationary 16,919 17,419 SECTION III. OVERTIME, RECALL, AND SPECIALTY PAYS. (a) Overtime and Recall: Any sworn member required to work overtime or who is recalled shall be paid at the rate of one and one-half (1 1/2) times his normal rate of pay. (b) Drivers pay: For regularly assigned drivers of fire trucks and other heavy equipment, the tillerman, and the personnel assigned to drive ambulances on regular or rotation basis, the following percentage of the Engineer (3- 9 years) in 1989, and percentage of Engineer (10+ years) in 1990, shall be paid: 1989 (Dollar Equivalent: ) 1990 (Dollar Equivalent) 1.5% ($318.00) 2.0% ($461. 00) (c) Emergency Medical Technician: For persons certified by the State of Indiana as a certified Emergency Medical Technician, the following annual amounts shall be paid: 1989 1990 $350.00 $350.00 (d) Scuba Divers: For regularly assigned scuba divers, the following percentage of the Engineer (3-9 years) in 1989, and percentage of Engineer (10+ years) in 1990, shall be paid: 1989 (Dollar Equivalent) 1990 (Dollar Equivalent) 2.25% ($477.00) 2.5% ($577. 00) (e) Paramedics: For sworn members performing paramedic duties, the following percentage of the Engineer (3-9 years) in 1989 and percentage of Engineer (10+ years) in 1990, shall be paid: 1989 (Dollar Equivalent) 1990 (Dollar Equivalent) 5.5% ($1, 167.00) 5.5% ($1,269.00) (f) Hazmat: For regularly assigned members of the Hazardous Materials Handling Team, the following percentage of the Engineer (3-9 years) in 1989, and percentage of Engineer (10+ years) in 1990, shall be paid: 1989 (Dollar Equivalent) 1990 (Dollar Equivalent) 3% ($637.00) 3% ($692.00) (g) Pro-rated Specialty Pay. All of the above- described specialty pays shall be pro-rated to the date of the regular assignment for such special duty or duties and paid accordingly. • paid to each officer or sworn member regardless of whether the holiday is worked. (i) Clothing allowance. Officers and all other sworn members shall receive an annual clothing allowance of Seven Hundred Ninety-Nine Dollars ($799.00) , one-half (1/2) of which shall be paid on or before June 15th and one-half (1/2) of which shall be paid on or before December 15th. SECTION IV. OTHER MONETARY FRINGE BENEFITS. (a) Dependent Health Insurance. For 1989 and 1990, the bi-weekly contribution by the officers and sworn members for dependent health insurance costs for the City's self-funded health insurance plan shall not exceed Fifty Dollars ($50.00) per month. (b) Health Care Insurance Cost Reduction Program. For 1989 and 1990, the Board of Health Care Insurance Oversight, shall continue to operate in and advisory capacity to and under the direction of the City Controller. This Board shall be composed of representatives of the South Bend Firefighters Association, Local No. 362 and employees of the Department of Administration Finance of the City of South Bend. It shall be the responsibility of the Board to review, under the direction of the City Controller, on a regular basis, the activities of the City's Health Care Insurance Program. (c) 1989 Health Insurance Program. In addition, in an effort to control health care costs, the City's current health insurance package shall be modified to provide a program containing comprehensive major medical health insurance which would provide for first dollar after a One Hundred Dollar ($100.00) deductible per year is met by the sworm member or officer, deductibles of ten percent 10% of the cost of such major medical expense, with maximum claims annual cost to the sworn member or officer for such coverage being Five Hundred Dollars ($500.00) . The City shall pay Twenty Four Dollars ($24.00) per month to any sworn member or officer who elects to leave the City's insurance program to be covered by another program for which the City makes no contribution. This election shall not be mandatory and the sworn member or officer may return to the City's program without contribution of Twenty Four Dollars ($24.00) per month if and when the sworn member or officer loses such coverage or during open enrollment, provided that the conditions of the City's insurance plan are met. (d) 1990 Health Insurance Program. The City shall pay Twenty Four Dollars ($24.00) per month to any sworn member or officer who elects to leave the City's insurance program to be covered by another program for which the City makes no contribution. This election shall not be mandatory and the sworn member or officer may rpfurn to the ri tv'c nrncrram wi fhntit nnnfri hiiti nn of Twenty • • • shall remain on the present vacation schedule which is as follows: Years of Service Days of Vacation 6 months through 1 year 3 working days 1 year through 7 years 6 working days 8 years through 15 years 8 working days 16 years through 19 years 10 working days 20 years and over 11 working days (b) New sworn members hired after December 31, 1986, and working 24-hour shifts shall have the following vacation schedule: Years of Service Days of Vacation 0 - 1 year 1 working day 1 - 7 years 4 working days 8 - 15 years 6 working days 16 - 19 years 8 working days 20 years + 10 working days (c) Officers or sworn members hired before December 31, 1986 working non-24-hour shifts shall remain on the present vacation schedule which is as follows: Years of Service Days of Vacation 6 months through 1 year 5 working days 2 years through 7 years 10 working days 8 years through 15 years 15 working days 16 years through 19 years 20 working days 20 years and over 25 working days (d) New sworn members hired after December 31, 1986, and working non-24-hour shifts shall have the following vacation schedule: Years of Service Days of Vacation 0 - 1 year 1 working day per month after 8 months 1 - 3 years 6 working days 4 5 years 10 working days 6 10 years 12 working days 11 - 15 years 15 working days 16 - 19 years 18 working days 20 years + 21 working days (e) The above terms shall be subject to approval by the Board of Public Safety. SECTION VI. PAID SICK LEAVE (a) Officers or sworn members hired before December 31, 1986, working non-24-hour shifts shall have eight (8) sick days per calendar year with a maximum accrual of one hundred (100) sick days in a sick leave bank. (b) New sworn members hired after December 31, 1986, and working non-24-hour shifts shall have eight (8) paid sick days each calendar year with a maximum accrual of forty-five (45) paid sick days in a sick leave bank. • • each calendar year and shall be able to accumulate a maximum of twenty-one (21) paid sick days in a sick leave bank. (e) The current sick leave buy-back program in effect shall continue in effect for sworn members and officers of the Fire Department with the specific details being set forth in the Collective Bargaining Agreement. Newly sworn members may not sell back sick days until a bank of ten (10 days are accrued. (f) The above terms shall be subject to approval by the Board of Public Safety. SECTION VII. FLSA, THE RIGHT TO ARBITRATE FLSA, QUINT- MIDI PAY, DEPARTMENT AND SHIFT STRENGTH, AND THE FITNESS AND WELLNESS PROGRAM (a) The foregoing pay and monetary fringe benefits provisions of this Ordinance were proposed and accepted in light of reaching specific agreements and understandings which affect particular sections of the Collective Bargaining Agreements of 1985 and 1986. (b) The City and the South Bend Firefighters Association, Local No. 362 agree to work together to prepare appropriate language to modify said Agreements in light of the understanding reached between them regarding the Fair Labor Standards Act (FLSA) , the Right to Arbitrate FLSA, Quint-Midi pay, Department and Shift Strength, and the Fitness and Wellness Program. More particularly the following articles shall be amended: 1. FLSA and Department and Shift Strength. Modification of Article 9 and 20 of the December 31, 1986 Collective Bargaining Agreement and the preparation of a new Memorandum of Understanding addressing an Advisory Labor Management Committee, 27-day work cycle, 212 sworn members, 64 24-hour personnel per shift, 55 24-hour shift strength, and 9 vacation groups. 2. The Right to Arbitrate FLSA. Deletion of Article 7 of the May 8, 1985 Collective Bargaining Agreement and paragraph 5 addressing said Article in the December 31, 1986 Memorandum of Understanding "Exhibit C" which is a part of the December 31, 1986 Collective Bargaining Agreement, all of which shall be null and void as of December 31, 1988. 3. Quint-Midi Pay. Deletion of Article 23 of the December 31, 1986 of the Collective Bargaining Agreement and shall be null and void as of December 31, 1988. 4. Fitness and Wellness Program. Preparation of a Memorandum of Understanding setting forth the details of the Fitness and Wellness Program whereby the City agrees to pay the sum of $150.00 per year to one of three facilities selected by the City. i.e. Health & Lifestyle • (c) All of the above described items shall be properly addressed in the new Collective Bargaining Agreement for calendars 1989 and 1990 which shall be subject to approval by the Board of Public Safety and subsequent modification. SECTION VIII. SERVICE YEAR FOR PAY AND BENEFITS ADDRESSED IN ORDINANCE. The first service year for a member of the Fire Department commences upon his or her being sworn in before the Board of Safety as a member of that department. His or her second service year shall begin on the next succeeding first day of January and service years shall continue to increase until the member attains the maximum salary for the particular rank he or she may hold. However, promotion to Engineer shall be dependant upon the completion of three full years of service from date of swearing in, and compliance with state law governing promotions through the Board of Public Safety. SECTION IX. EFFECTIVE DATE This ordinance shall be in full force and effect from and after its passage by the Council and approval by the Mayor. Memb=r of the Common Council nt READING / - (� P..
