Qoj(,-gi AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA CERTAIN LAND LOCATED IN GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT A petition for voluntary annexation of approximately 75. 45 acres located in German Township, St. Joseph County, Indiana has been filed by the owners of 100% of territory to be annexed: It is the intent and purpose of this ordinance to annex the territory to the city of South Bend, Indiana Therefore be it ordained by the Common Council of the City of South Bend, Indiana as follows SECTION I. That the following described Real Estate in St. Joseph County, State of Indiana being contiguous to the present boundaries of the City of South Bend is hereby annexed to and brought within the city of South Bend. A parcel of land being a part of the Southwest Quarter of Section 17, Township 38 North, Range 2 East in German Township, St. Joseph County Indiana and being more particularly described as follows; VIZ Commencing at the Southwest corner of said Section 17, thence North 0°-04 '-03" East (all bearings in this description are based on the East line of the Southwest Quarter of said Section 17, said line having an assumed bearing of North 0°-00 '-00" East) along the West line of said Southwest Quarter a distance of 200.00 feet to the point of beginning; thence continuing North 0°-04 "-03" East along said WEst line a distance of 2468. 50 feet to the Northwest corner of said South- West Quarter; thence South 89°-31 '-43" East along the North line of said Southwest Quarter a distance of 1303. 80 feet to the Northeast corner of the West half of said Southwest Quarter; thence 0°-03'-49 West along the east line of the West half of said Southwest Quarter a distance of 2465. 70 feet to a point which is North 0°-03'-49 East a distance of 200.00 feet from the Southeast corner of the West half of said Southwest Quarter; thence North 89°-39 '-06" West, parallel with South line of said Southwest Quarter, a distance of 400 .00 feet; thence South0°-03'-49" West, parallel with the East line of the West half of said Southwest Quarter, a distance of 200.00 feet to the South line of said Southwest Quarter; thence North 89°-39 '-06" West, along said South line a distance of 375. 75 feet; thence North 0°-22 '-38" East, a distance of 205. 00 feet; thence North 89°-39 '-06" West, parallel with said South line a distance of' 138.00 feet; thence South 0°-22 '-38" West a distance of 205.00 feet to said South line; thence North 89°-39 '-06" West along said South line a distance of 60 .00 feet; thence North 0°-22 '-38" East a distance of 200 .00 feet; thence North 89°-39 '-06"West, parallel with said South line a distance of 330 .00 feet by deed (331. 30 feet measured distance) to the point of beginning, containing 75. 844 acres, more or less. Subject to the legal rights of a public highway and any easements covenants, or restrictions of record. SECTION II. Be it further ordained that the Boundaries of the City of South Bend, Indiana are hereby declared to be extended so as to include the real estate of the above desctibed parcel as a part of the City of South Bend, Indiana SECTION II. This ordinance shall be in full force and effect from and PETITION FOR VOLUNTARY ANNEXATION TO: COMMON COUNCIL CITY OF SOUTH BEND, INDIANA The undersigned hereby petition the Common Countil of the City of South Bend, Indiana for voluntary annexation to the City of South Bend, Indiana of a certain parcel of real estate situated in St. Joseph County, Indiana and in support of which allege and affirm as follows; 1. They are at least fifty-one percent (51%) of the owners or the owners of at least seventy-five (75%) of the total assessed value of a certain parcel of land more particularly described on Exhibit "A.1! hereto, which is incorporated herein by this reference as if fully set forth (hereinafter "the Parcel") 2 . The Parcel is located in St. Joseph County, Indiana, outside of but contiguous to the City of South Bend, Indiana 3. They desire that the Parcel be annexed to the City of South Bend, Indiana by proper ordinance 4 . They agree to the voluntary annexation subject to the approval by the Common Council. Donald & Carmelo Ritschard request to rezone the Parcel to Industrial "A" Height &Area. If the Common Council denies the request for rezoning the parcel to Industrial "A" Height & Area, then Donald & Carmelo Ritschard withdraws the Parcel from any further consideration for annexation to the City of South Bend, Indiana 5. They affirm, under the penalities for perjury, that the forgoing statements are true.
