Certificates of Appropriateness 1) 1228 Lincolnway East -LW Owner proposes to construct a 2 car garage, 20'x 24'x 12' with a gable roof canopy section at rear of new garage. Owner also proposes to install lattice type fence on east and west lines of rear yard as well as asphalting an existing concrete slab. Mr. Newburn moved to approve; Mr. Hayes seconded; motion passed. 2) 62290 Miami Road - LL Owner proposes to replace a rear extension of the house with a room addition with a wrap -around deck. Owner also proposes to landscape around house and buildings on site, including driveway (see staff report - Appendix 6). Mr. Hayes moved to approve C of A according to staff recommendation which is to seek alternative appropriate material, but to allow glass block if no appropriate material can be found; Mr. Nimtz seconded; motion passed. Mr. Poland reported staff approval was granted for request to replace chainlink fence with 3'high/6'high wrought iron fencing in front of church property. IV. Regular Business A. Wayne - EW Mr. Poland reported staff approval of the removal of two trees at this property which will be replaced with similar varities within a year. e) 14912 Brick Rd. - District No. 1 Schoolhouse - LL (see report - Appendix D) Ms. Jentoft-Nilsen reported a petition was sent to Don Fozo, County Building Commissioner to use the means available to cause the maintenance and repair, to the point of rebuilding if necessary, of the landmark school at this address. Ms. Jentoft-Nilsen proposes to request a structural anaylsis of the schoolhouse by a qualified engineer. Mr. Oxian moved to approve staff request with the stipulation that staff go through the County Building Dept. and the County Engineering Dept. to determine if the building is structurally sound and to obtain a demolition stay. f) 14297 State Road 23 - LL Ms. Jentoft-Ni 1 s•en reported staff approval of in -kind replacement materials: 1) brick and mortar on porch corner footings; 2) replacement of crawl space door; S) reflooring and reroofing porch and replacement of railing. g) Edgewater Place Hist. Dist. - Lightpole replacement Indiana and Michigan Power Co. requests a C of A for replacement of light pole #J259-1842 with a fiberglass replacement pole. Mr. Oxian moved to approve; Mr. Nimtz seconded; motion passed. h) East Wayne St. Hist. Dist. - Lightpole replacement Indiana and Michigan Power Co. requests a C of A for replacement of light pole #J260-751 with a black fiberglass pole and lantern. Mr. Oxian moved to request that Indiana & Michigan Power Co. replace pole #J260-751 with an available concrete pole and a compatible light fixture; Mr. Hayes seconded; motion passed. September 19, 1988 PAGE 3 2. Budget & Finance a) City and County Budgets Ms. Jentoft-Nilsen reported that the County approved the HPC's budget request for an increase. Ms. Jentoft-Nilsen stated that the HPC had also applied to the City but the request was rejected. 3. Legal No Report 4. Historic Districts a) Edgewater Place Historic District - R Mrs. DeLaruelle reported some maintenance problems in the Edgewater Place Historic District. 5. Historic Landmarks a) Muessel-Drewerys/Brewery Complex Mr. Oxian reported that he has prepared a letter of items regarding landmark status in response to the meeting with the owner of the Muessel-Drewerys/Brewery Complex. b. Public Relations. & Community Education No Report 7. Director's Report a) Survey Records Management Grant Ms. Jentoft-Nilsen reported that since the Historic Preservation Activities Grant .was not reinstated, a shift of duties onto the SRM Grant was necessary for Mr. Poland and Mrs. Fountain. New contracts effective September 1, 1988 are in effect for Mr. Poland as Survey Manager and Mrs. Fountain as Records Manager. b) Department of Natural Resources Workshop . Old Business No Report Ms. Jentoft-Nilsen requested permission for she and Mr. Poland to attend the DNR Workshop on HABS Photography in Ind anapol is on October 3 thru 5 : Ms. Jentoft-Ni 1 sen requested approval of travel expenses not to exceed $125. APPENDIX B E hostoriCpreservation cornmessoon of south bend and st. joseph county ROOM 1123 COUNTY CITY BUILDING south bend, indiana 46601 (219) 284-9798 September 19, 1988 STAFF REPORT 62290 Miami Road South Bend, IN 46616 Local Landmark Proposal The owner proposes to replace a rear extension of the house with room addition and wrap -around deck. Landscaping is proposed for the five plus acres surrounding the house and barns. Standards II. Treatment - Landscaping Treatment shall be defined as any change of surface materials that will not alter the style or original form. Such improvements which include . . . landscaping lawns involve a change that can potentially enhance or detract from the character of the landmark. . . . review the proposed treatment for character and style consistency with the original . . . . III. Renovation and Additions Additions to landmarks should not detract from the original form and unity of the landmark and should not cover singular examples of architectural detail. Additions to landmarks should be added in a manner that does not disrupt the visible unity of the site. The proportions, materials and ratios of the existing structures should be carried through in the additions. The proposal is for a small storage extension (12 x 10) and rear stoop at the rear of the house to be replaced by a 14' x 24' room addition to the house with a wrap -around deck. The design of the addition includes the use of similar materials as well as three sliding glass doors with transom windows above. A hip roof covers a small bay window. The deck begins at the southern end of the original side porch and wraps around the new addition. The deck has a railing of capped posts and turned banisters, and has a patterned brick skirt under it which matches those found on the porches around the house. Landscaping plans call for replacement plantings around the house and screening plants on the front exposed sections of deck. A wrought iron fence currently in front of the house will be replaced with a higher fence with electric gates for security. The historic fence will be re -installed around a side entrance garden. An asphalt ovate drive will provide access to the front entrance. The paddock fence to the side of the small barn will be removed. The perimeter fence is to be replaced with a PVC board fence of similar design. Recommendation Staff recommends acceptance of this proposal with the stipulation that staff give final approval on new design of front wrought iron fence. The addition design allows for visual separation from the original house, but does not disrupt the visual unity of the site. Existing proportions and materials of the original house are respected. The landscaping plan allows for privacy screening and uses historic plantings. A flush treatment is requested in order to prevent children from climbing onto the roof by using the ledge for a foothold. STANDARDS B. RECOMMENDATION The proposed garage replaces a. previous structure lost in a recent fire. The fencing matches an design in an adjacent property previously approved by the HRC and is therefore appropriate to the existing surrounding site elements. The proposed paving is appropriately located in the rear yard and is not visible to the street. Recommendation The clapboard siding and front porch repair were approved by staff. The remaining item is the privacy fence around the south and west yards. The owner is submitting estimates for stockade type fencing and for dog-ear picket fencing. Stockade fencing is not an appropriate design type for this early federal house. Staff recommends approval for the dog-ear picket fence, which should be painted. Supporting members of this structure have been removed by the owner and it has recently been damaged by fire. It is necessary that immediate steps be taken in order to preserve this landmark and to carry out the intent of the Historic Preservation Commission ordinance. Sincerely, , Lynette Jentoft—Nilsen Director LJN:ef 0 10 historic preservation commEssEon of south bend and st. joseph county ROOM 1123 COUNTY CITY BUILDING south bend, indiana 46601 (219) 284-9798 September 14, 1988 14912 Brick Road - District No. 1 School The District No. 1 School was designated a Historic Landmark by St. Joseph County Ordinance on September 28, 1976. This designation recognized the historic importance and architectural significance of this 2 story brick structure; and provided for its' preservation under the powers of the Historic Preservation Commission to approve any proposed changes to its exterior and structural integrity. The District No. 1 School was built in 1892, replacing former wood frame schoolhouses on this site since the 1850's. The schoolhouse was converted into residential use by the early 1930's and was occupied until recently. This property was purchased in 1988 by Marvin Ward who applied for a Certificate of Appropriateness on April 12 to begin development of this site. His request for the removal of a deteriorated concrete block garage adjacent to the schoolhouse and to construct a new garage approximately 100' SE of the schoolhouse, at the SE corner of the lot was approved. The owner further requested permission to remove brush overgrowth from the property and a landscape plan was approved on May 16, 1988. The owner did not demolish the old garage building before beginning the construction of the new structure. He violated the Historic Preservation Commission Certificate of Appropriateness and did not follow the plans he submitted. when he began the construction of the new garage. The Building Commissioner issued two stop -work orders on the site in June. The owner removed interior material from the schoolhouse from April through June. The owner did not respond to repeated attempts to contact him. An inspection in early August determined that the stop -work orders had been ignored, a Mishawaka building permit had been illegally posted, and that the structural support members and materials had been completely removed. The Building Commissioner responded and requested an immediate response from the owner to rectify this violation. During the September 11-12 weekend, the owner began emptying the old garage of warehoused materials and burning debris in three fires around the schoolhouse perimeter. Nearby residents have said that the fires were unattended and still burning through the night of September 11. On Sunday, September 12, another fire was begun behind the schoolhouse and was burning close to the building. The schoolhouse caught fire in this back area of the building and the roof was quickly engulfed by flames. Although the Harris Township Fire Department responded immediately and quickly brought the blaze under control, the structure sustained serious damage and was near collapse due to the lack of any supporting members. The roof collapsed on Tuesday, September 13, 1988. Throughout this period, area residents, the business community, the St. Joseph County Building Commissioner and the Historic Preservation Commission have all repeatedly attempted to gain the owner's compliance with the preservation, zoning and building ordinances related to this property. The owner's response has been to ignore official requirements and procedures, to continue to use the property as a business depot, and to deliberately abuse the landmark building. This series of actions by the owner appears to be a deliberate distruction of a landmark property and a clear violation of the St. Joseph County Preservation Ordinance. The Historic Preservation Commission is investigating legal action to require the owner to repair, to the point of rebuilding if necessary, and maintain this historic landmark according to the provisions of the ordinance.
