request the County Council to delay the issuance of a demolition permit -
for the structure at 14912 Brick Road, St. Joseph County.

For a Temporary Delay in the issuance of
a Demolition Permit for the Historic
Landmark Structure at 14912 Brick Road,
St. Joseph County.
October 3, 1988
I. Purpose of Petition
The Historic Preservation Commission of South Bend and
St. Joseph County hereby petitions the St. Joseph County
Council, under the St. Joseph County Ordinance Section 26.78.
120, to temporarily delay the issuance of any demolition permit
for the purpose of preparing a preservation plan for the
structure(s) at 14912 Brick Road, Harris Township, St. Joseph
County. Said delay will not exceed one year from the date of
the Council's action. The Historic Preservation Commission
reserves the right at the end of that one year period to
petition the Council for a continuance of any such council -
approved delay.
II. Property Description
The subject property of this petition is located at 14912 Brick
Road, Harris Township, St. Joseph County. This property is a
one acre site containing the former District No.l School Building,
a circa 1920's garage, and a 1988 garage.
The former District No.l School was built in 1892 for the Harris
Township School District No.l. The school was built by D. Werst
and Sons in a simple Queen Anne Style. It functioned as a school
until the 1930's and was converted into a private residence at
that time.
The school was declared a local historic landmark by the St.
Joseph County Council on September 28, 1976. Prior to the recent
fire, the school was potentially eligible for listing on the
National Register of Historic Places and the Indiana State Register
of Historic Sites and Structures.
III. Purpose of the Preservation Plan
The purpose of the preservation plan will be:
1)• to provide additional time to develop a reasonable and
-economical plan to save one of St. Joseph County local

y,z;;_to provide for additional time for the determination
=fVhether the structure is salvageable, reconstructable
'.X,Z(ind/or restorable as to its deteriorated condition
resulting from a recent fire.
3),'�;xo provide additional time for a proper structural
evaluation of the structure -to be completed and to
investigate proper reconstruction and restoration
techniques.
4) to provide additional time for continued negotiations
by an interested third party with the current owner
for purchase of the property allowing for the potential
of reconstruction, restoration, and reuse of the
structure.
IV. Additional Information
Previous to this petition the Historic Preservation Commission
had petitioned the County Building Commissioner, under St.
Joseph County Ordinance Section 26.78.070 (F), to use the
legal means available to him to cause the maintenance and/or
repair of this Historic Landmark.
Further the Historic Preservation Commission has petitioned
the County Building Commissioner to use his means to require
the owner to stabilize the structure in order to eliminate
any potential threats to the public health, safety, or welfare.
Pertinent correspondence has been included in this petition.

All approved Certificate of
Appropriateness will be reported
by the Staff to the Historic
Preservation Commission at the
next appropriate meeting.
7. Denials of Certificates of
Appropriateness will be based on the
inappropriateness of the project
or if it violates the Historic
District's Standards and Guidelines.
The applicant will be informed of
specific reasons for denial by
letter (with a copy forwarded to
the Building Department) explaining
the action and suggestions for
changes. The owner may re -submit
his/her application with the
suggested changes to the Staff for
review at the next meeting. After
all proper procedures are exhausted,
the applicant does have the right
of appeal to the proper council
which will make a final deter-
mination on the application.

Ms. Jentoft-tali ls.en reported staff approved owner's
request to remove 2 trees; 1 dead elm in treelawn as
ordered by the Parks Department, and i dead blue spruce
in side yard and to replace them in -kind.
e) 14912 Brick Rd. - District No. I Schoolhouse - LL
Ms. Jentoft-Nilsen reported that the County Engineer
inspected the above property and made a preliminary
report that the walls of the schoolhouse were
structurally stable and able to withstand rebuilding.
Ms. Jentoft-Nilsen stated that the owner has done some
bracing of the walls as ordered by the County Building
Commissioner.
Ms. Jentoft-Nilsen also stated that the staff has
petitioned the County Council for a temporary demolition
delay of up to 1 year in order to prepare a preservation
plan for the property. Ms. Jentoft-Nilsen announced
first reading will be on October 11.

2. Budget & Finance
a) DNR Grants
Ms. Jentoft-Nilsen stated that she is finishing the
reports for the grant periods of 1987-88 for the DNR.
Ms. Jentoft-Nilsen also stated that she will be working
on the grants for 1989 and pursuing application for a.
RP3 grant.
3. Legal
a) Historic District Maintenance
Mr. Poland reported that Mr. Chapleau informed him that
he is working on a report in regard to amending the City
Ordinance to require maintenance in Historic Districts.
Mr. Poland stated that Mr. Chapleau will summarize this
material and forward it to the staff for review.
b) Facade Easements
Ms. Jentoft-Nilsen reported that staff has proceeded to
offer drafts for facade easements to certain parties that
have expressed interest.
4. Historic Districts
a) Edgewater Place Historic District - R
Mr. Poland reported that in response to the Commission's
request to have certain maintenance problems checked out
in the Edgewater Place Historic District, Code
Enforcement sent HPC a memo listing 13 properties with
code violations.

a) Habs/Haer Workshop - Indianapolis
Ms. Jentoft-Nilsen stated that she will send Commission
members a summary of these workshops.

b) Certificate of Appropriateness Procedures Brochure
Mr. Poland presented the proposed C of A Procedures
brochure for discussion. Several corrections and
additions were discussed. Revisions will be made and
reviewed again at the next meeting.
c) Landscape Consultant Contract
Ms. Jentoft-Nilsen announced that Mr. Barncord, HPC's
landscape consultant, has a contract up for renewal in
October, 1986. Mrs. Choitz moved to approve renewal of
Mr. Barncord's contract; Mr. Newburn seconded; motion
approved.
d) Roster of Potential HPC Board Members
Ms. Jentoft-Nilsen requested that HPC members submit
names of individuals who would be interested and
qualified to serve on the HPC board.
