April 18, 1988 PAGE 1 Mr. Oxian made a motion that due to a lack of quorum for any unanamious approvals a fifth member be contacted for their vote for• approval of the issue and for a decision that was not unanmious, the issue is• to be postponed until the next monthly meeting; Mr•=_•. Environmental Impact Statement 1) 1055 Riverside Drive Owner seeks approval of landscape plan (see Staff Report and landscape plan - Appendices B and C). Mrs. Choitz moved to approve; Mr. Oxian seconded; vote 4-0; motion null and void - lack of quorum. 2) 16021 Cleveland Rd. - LL Owner requested approval of parking lot plan in rear of house. Mr. Oxian moved to approve; Mrs. DeLaruelle seconded; vote 4-0; motion null and void - lack of quorum. Owner also requested approval of temporary sign for joint businesses; Mr. Oxian moved to approve the present sign temporarily until August, 1988 when owner would present his design for• a permanent directory sign; Mrs. DeLaruelle seconded; Mrs. Sporleder and Mrs. Choitz voted no; vote 2-2; motion null and void - lack of quorum. 3) 14912 Brick Rd. - LL Owner proposes to demolish deteriorated block garage adjacent to the schoolhouse; Mrs. Choitz moved to approved the demolition; Mrs. DeLaruelle seconded; vote 4-0; motion null and void - lack of quorum. Owner pr•opos•es to construct a 30'x 32' garage/workshop of lapped cedar siding with an asphalt shingle roof, 100' SE of the schoolhouse (see staff report - Appendix D). Mr. Oxian moved to approve with the condition that the original landscape be retained; Mrs. Choitz seconded; vote 4-0; motion null and void - lack of quorum. Ms. Jentoft-Nilsen requested the agenda be adjusted to accommodate the visitors. ® 4) 19109 Johnson Rd. LL - Report Mr. Poland reported staff has reviewed and approved several plans for new construction in the Southland Development on Johnson Road. April 18, 1988 PACE 2 5) 1111 Riverside Dr. - RV - Report Mr. Poland reported an in -Kind roof replacement was approved by staff. 6) Streetlight - Leland & Riverside Dr. - RV Mr. Cartwright of the Indiana °c Michigan Power Co. requested approval, after the fact, of a streetlight replacement pole and luminaire which was destroyed in an auto accident. Mrs. Choitz moved to approve replacement; Mrs. DeLaruelle seconded; vote 4-0; motion null and void - lack of quorum. Mr. Oxian directed staff to send a letter to the City Engineer regarding possible installation of a stop sign at the intersection of Leland, California and Riverside Dr. as well as a letter to the appropriate department regarding possible "No Parking" signs at Shetterly Park. Mr. Bennett, of the Riverside Dr. Liaison Committee, announced that there will be a potluck picnic at 2:00 p.m., on ..Tune 12, 1988 at Leeper Park for residents of the Riverside Dr. Historic District. The HPC members and staff were invited. 7) 553-557 Edgewater Drive - ED - Report Mr. Poland reported staff approved an in -kind replacement of shared concrete drive. b. Budget & Finance 1) Proposed Budget for 1988 Ms. Lynette Jentoft-Nilsen stated that she is waiting to hear from the Department of the Interior concerning the grants for the next period as well as the establishing of a indirect cost rate by the city. C. Historic Districts 1) East Wayne Street - Liaison Committee Mrs. Choitz stated that the Liaison Committee list is complete and that a copy of the list of members was sent to each Commission member. Ms. Jentoft-Nilsen stated that the standards booklet was ready to go to print except for the addition of the names of the Steering Committee. April 18, 1988 PAGE 3 d. Historic Landmarks 1) 19109 Johnson Rd.-LL - 2nd Reading Tabled 2) 12594 SR 23 -LL - 2nd Reading Mr..Poland read into the record that Mrs. Goff requested Lot 3 of the Goff Estates be removed from landmark status. Mr. Oxian moved that Lot 3, Goff Estates (with proper legal description) be deleted from landmark status; Mrs. DeLaruelle seconded; vote 4-0; motion null and void - lack of quorum. Owner requested deletion of Lot 1 and part of Lot 2, Goff Estates from landmark status. Mr. Oxian moved to reject the owners request to reduce the landmark description of Lot i and part of Lot 2 and to retain all of Lots 1 and 2 under landmark status; Mrs. Choitz seconded; Mrs. Sporleder abstained; vote 3-0-1; motion null and void - lack of quorum. 3) 929 E. Milton - 2nd Reading Mr. Oxian moved to recommend local landmark status for this property and that it be forwarded to the Common Council; tars. Legal 1) I &c M Power Co. - Streetlights Mr. Oxian moved to table the letter to Mr. Cartwright of the I &c M Power Co. concerning replacement of two streetlfight=_• in the East Wayne Street Historic District which the Commission directed staff to prepare. Mr. Oxian also stated that staff should meet with the City Engineering Dept. in order to work out a system to replace streetlights. Staff Report 1) Mayor's Conference Ms. Jentoft-Nilsen announced the 6th Annual Mayor's Conference will be held on May 10, 1988, at the Union Station with the keynote speaker being Peter J. Aucella of the Lowell Historic Preservation Commission of Lowell, MA. 2) Urban Preservation Colloquium - Chicago, IL Mr. Poland handed out a meeting report to Commission members and staff regarding the colloquim on urban preservation which he attended on April 13, 1988 in Chicago, IL. 3) Quarterly HLFI Meeting Mr. Poland distributed invitations to the Regional Quarterly Meeting for Northern Indiana Historic Preservation Commissions and Review Boards on Thursday, May 12, 1988 in Hammond, It'd 7. The plan includes the use of existing plant material combined with new. Several trees are to be removed -- a box elder at the front that is in questionable health, a tree adjacent to the garage which is causinq some structural concern, a box elder at the SW corner which is growing into the eaves, and some "scrub" trees at the fence line. The owner intends to continue the historic motif of using brick as border material. This includes lining the planting beds and walkt"la •s. A new ground level brick patio will be established at the rear entrance using a tile similar to that of the front walk and lined with brick. A new fence will replace an existing stockade t-ype at the rear. Examples of the materials will be presented at the meeting. STANDARDS District Environment New plant material, fencing, walkways., streetlights, signs and benches_. shall be compatible with the character of the neighborhood in size, scale, material, and color. Plant materials and trees in close proximity to buildings, sidewalks or streets that are causing deterioration to those elements should be removed. RECOtvlMEPJDi ;T I ON Even though several trees are to be removed, most of them are not signficant or are causing deterioration to the buildings. The tree in the front yard is of questionable health and presents a potential safety. hazard. Replacement of this tree would be unnecessary due to the closeness of a tree in the adjacent yard. Recommendation continued: The use of the brick and tile appropriate1x continues the hi•_toric motif of the original landscaping. The plant materials are appropriate. Staff recommends approval of the landscaping plan. APPENDIX D historic reservation c®mmosso p on of south bend and st. joseph county ROOM 1123 COUNTY CITY BUILDING south bend, indiana 46601 (219) 284-9798 April 18, 1988 STAFF REPORT 14912 Brick Road Granger, IN 46530 PROPOSAL Part 1 The owner proposes to demolish an existing 2 car garage adjacent to the schoolhouse. The qaraqe is in deteriorated condition. Part 2 The owner proposes to construct a new 30' x 32' one level garage workshop with gable eaves to the street. The building is to have horizontal lapped cedar siding and asphalt shingle roof. There will be a single overhead garage door and two service doors as per the drawing. A new 10' gravel driveway will be constructed from Brick Road to the garage which is located at the SE corner of the lot approximately 100 feet SE of the schoolhouse. STANDARDS Part 1 D. Demolition Historic landmarks shall not be demolished. When a landmark poses a threat to the public safely, and demolition is the only alternative, documentation by way of photographs, measured drawings, or other descriptive methods should be made of both the exterior and interior of the landmark. Part 2 B. Treatment A treatment change . . . to the landmark or its environment may [not] . . . significantly alter the appearance of the landmark . . . [and] . . . the Commission should review the proposed treatment for character and style consistency . . . and [the treatment] should be added in a manner that does not disrupt the visual unity of the site. R EC OMM EN DAT I ON Part 1 The mid 20th century garage was not an original structure on the schoolhouse property and therefore has no historical significance. Its condition has rendered it to be unusable. Due to these factors, the staff recommends that the owner be allowed to remove this garage. Criterion c : The bu i 1 di ng has educational value as a. good example of a small congregation Gothic Revival church of the late 15130 `s Depression Era. Criterion d: The building retains many of its original features and is generally in good condition. Thus making it suitable for designation. Criterion e: No significant historical event has occurred at this site. Criterion f: This buildinq is identified with moderately successful Akron, OH architect. Recommendation: The subject building meets the minimal landmark ratings criteria. Its association vjith the architect as one local example of his work and its architectural character and integrity makes it worthy of designation. Therefore the staff recommends local landmark designation. Milton South Lend, IN 46613 Proposal : Local landmark status is being requested for the Emmaus Evangelical Lutheran Church. The building is rated an S!11 on the Indiana Historic Site and Structures 'Inventor•,.. (The rating was raised from C/10 by the HPC at the March 1988 meeting.) It is designed in the Gothic Revival style. Standards.: A landmark must be rated at least an Sill on the Indiana Historic Site=. and Structure•_. Inventory and must be evaluated according to the following criteria: a. Its character, interest, or value as part of the development, heri tame, or culture of the City of South Lend, St. Joseph County, the State of Indiana, or the United States of America; b. its embodiment of elements of architectural design, detai 1 , materials, or craftsmanship which represents an architectural characteristic_ or innovation; C. it=_. educational value; d. its sui tabi 1 i ty for preservation; e . its location as the site of a significant historical event; and/or f . its identification with the 1 i fe of a. person or persons of historical significance. Evaluation: The subject building is rated Sf`11 on the Indiana Historic Sites and Structures. Inventory. Criterion a: The church k-oas constructed in 1938 by Hal 1 et Meyers of Elkhart from a desion by J. Adam Fichter. It is located in the South side neighborhoods once populated by employees of the Studebaker Corporation. Criterion b: The building has exhibits many distinguishing features of the Gothic Revival Style including pointed arch vi i ndovis, steeply pitched gable roofs, and buttresses. The lot will be for 11 cars and located in the rear yard. Access will be off Gumwood Road. The lot does comply with the 40 foot building setback. The owner is seeking approval of new sign located at the southeast corner of the property at the intersection of Cleveland and Gumwood Roads. The sign is consists of two 4'x8' panels in a "V" shape. STANDARDS B. Treatment A treatment change of any surface whether on the landmark or its environment may require a Certificate of Appropriateness if it significantly alters the appearance of the landmark . . . and should [be] reviewed] for character and style consistency with the original. F. Signs Only one appropriate identifying sign will be permitted per business. RECOMMENDATION The site plan was approved by the Area Plan Commission in December 1987. Since the parking lot is located in the rear yard and complies with the building setback, Staff recommends approval of the plan. The design of the sign is inconsistent and incompatible with the historic character of the landmark house. Since two businesses are proposed at this property, a single directory sign would be more appropriate. The staff gives an unfavorable recommendation for this sign. Johnson Read South Bend, IN 46614 Lot 8 Southland Section 1 PROPOSAL The ouiner• requests construction of one single family residence on Lot S Southland Section 1. RECOMMENDATION Staff recommendation is for approval of the addendum. historicpreservation cammossmn of south bend and st. joseph county ROOM 1123 COUNTY CITY BUILDING south bend, indiana 46601 (219) 284-9798 April 15, 1988 STAFF REPORT 12594 S.R. 23 Granger, IN 46540 Proposal The owner proposes to amend the legal description of the Landmark designation to delete a portion of the property. The property was subdivided into 3 lots in 1987. The reduced boundaries will include all of Lot 1 which contains the Goff House, and part of Lot 2 which contains the barn and the new landscape building. Standards A treatment change ... on the landmark or in its environment may [not]... significantly change the appearance of the landmark...[and]... the Commission should review the proposed treament for character and style consistency... and [the treatment] should be added in a manner that does not disrupt the visual unity of the site. Recommendation The Goff farm is located in Granger surrounded by development including the gasoline tank farms to the south. The visual unity of the surrounding environment has suffered, therefore, the historic integrity of the site as a farm has already been greatly impinged. Lastyear the HPC approved the construction of a retail center to the east of the barn. It was determined at that time that since the retail center was to be set back from the road, the center would not further negatively visually impact on the historic complex. Since the area of the amended description encompasses the property of the original farmstead including the house, outbuildings and treeline on the south, staff recommends approval of the amendment provided that the retail center is constructed as per previous HPC approval and in recognition of the specific circumstances of this case which include, but are not limited, to the above discussion. BLP:e W Part 2 The owner has implied his concern about the historic setting by locating the proposed garage as far away as possible from the schoolhouse. Thus mitigating the effect of new construction in the historic setting. The use of wood material is more appropriate material than the use of metal. The design of the new structure should still relate somewhat to the overall characteristics of the schoolhouse such as massing, roof slope, coloring, etc. Secondly, the retention of existing landscaping elements and possibly augmented by additional screening would lessen the impact of the new QaraQe. Staff recommends that the new garage be approved with the condition that the original landscaping is retained (if practical) or appropriately augmented to screen the new building. W MACOG Conference Room llth Floor MEETING REPORT ISSUES IN URBAN PRESERVATION COLLOQUIUM April 13, 1988 Palmer House Chicago, IL Various urban preservation issues v.iere discussed at the colloquium. The colloquium vla.•_ a part of the annual meeting of the Society of Architectural Historians. Richard Longstr•e th from George Washington University made a. pr•esentat i on on why historic buildings should be saved. Historic organizations need to present a clear vie 1 1—defined case of reasons t'dh;ti' a building should be saved. He exemplified this by using the example of the Greyhound Station in Washington, DC and a 1930 __• retail center in Silver Springs, MD. These tvto mere cases vihere the historic value of the buildings vias not obvious. The Greyhound Station was covered over vji th metal facing material; but v)za . fully intact underneath. The retail center vtas an example of a retail "park and shop" fa.c i 1 i ty that had suffered some al ter•at i ons. Tared Sh l aes of Panne l 1 Kerr Forster , a Ch i cago account i ng firm, presented basic information about the value of the tax credit rehabilitation program and hove it vias negatively affected under the recent tax bill. Ne l 1 i e Lonc,_d•Uor•th of Preservation Action spoke to the value of the Section 106 review process in protecting National Register properties. She indicated that there are no controls for projects t,.iher•e private money is used. She encouraged local government attempts to establish means to protect historic properties in such cases. She discussed Preservation Action's efforts to push for changes in the tax bill to correct problems with the recent changes. Tobin Richter, attorney and President of Landmarks Preservation Council of I 1 1 i not s, presented information on the recent court challenge to the City of Chicago'= de —de s i gnat i on of the McCarthy Building. The McCarthy bu i 1 d i ng k,.tas designed by John Van Osde 1 , Chicago's first professional- arch i tect after the 1871 f ire (•y.nd the Second St. Joseph County Courthouse). Chicago de —designated the building viithout going through the set procedures because of pressure to develop the block. The city felt that the benefits of the development outweighed the historic value of the building even though early development plans included the preservation of the building. LPCI and National Trust chat1enged the de —designation but lost in court. The court ruled that a municipality has a. legal right to reverse itself by passing another ordinance. Supr• i s i ngl y, the court recocin i zed that the C:i tx had v i of ated i is procedure•_• but thatV vias not (apparently) a significant factor in the decision. The court teased its opinion on a recent case in Chicago that involved taxi cats rates in which i t w.ias upheld that the Ci t}• had the right to b>,pa.ss its owan procedures for setting the rates. LPGI and the National Trust is appealing the case on the reason that the app 1 i cat ion of the taxi cab case was inappropriate in zoning issues•. Zoning issues have a. sepa.r•ate 1 i ne of legal precedent in which a. c i t>, must fol 1 ow the rul es and procedures i t has prey., i oust y se t up .
