This is EXHIBIT K, consisting of 4 pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated October 27, 2020. AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. __1___ 1. Background Data: a. Effective Date of Owner-Engineer Agreement: October 27, 2020 b. Owner: City of South Bend, Indiana c. Engineer: Black & Veatch Corporation d. Project: Water Hydraulic Modeling Assistance 2. Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: Task 104 – Project Management and Administration Engineer will provide project administration and management including budget and schedule control for the addition of Amendment 1. Task 105 – Maximum Day Model Scenario Update Due to recent improvement projects completed at a number of water treatment plants, the Owner would like to update their hydraulic model to reflect the current maximum day demand (MDD) operations. Engineer will review the appropriate SCADA data, production data, and/or other operational information provided by the Owner to determine the typical MDD operations. A teleconference with the Owner’s staff will be held and one representative MDD operational scenario will be agreed upon. Changes will be made to the operational controls within the model to reflect the selected MDD scenario. If necessary, demands in the model may be adjusted to reflect the selected MDD by adding a global multiplier. Engineer does not anticipate that demand allocation will require updates. A full model calibration to SCADA data is not included. The anticipated changes to the model are operational adjustments therefore recalibration is not required at this time. Updates to the MDD scenario will be summarized and documented in a brief memorandum that will be provided to the Owner. The water age and source trace analyses performed as part of the LCR Risk Management Project will be re-evaluated using this updated MDD scenario. Results from these analyses will be updated. b.The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: c.The responsibilities of Owner are modified as follows: d.For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: For professional services described under Paragraph 2.a for Tasks 104 and 105, Owner agrees to pay Engineer in accordance with the Agreement for Professional Services on a Standard Hourly Rate basis. The total compensation for Amendment 1 shall increase the not-to-exceed amount by $10,110 and shall not be revised without written authorization. e.The schedule for rendering services is modified as follows: Engineer will complete the work within 1 month of receiving a Notice to Proceed from the Owner. f.Other portions of the Agreement (including previous amendments, if any) are modified as follows: 5.
