At its March 23, 2021 meeting, the Board of Public Works awarded the above referenced
bid to you in the amount of $440,100 for the base bid plus alternate number 1. Enclosed please
find a signed Bid/Proposal form.
Please forward the following documents in one submittal by April 13, 2021 to my
attention for Board of Public Works approval at lhensley@southbendin.gov :
1) One (1) signed original of the Public Works Contract (enclosed)
2) Labor & Material Payment Bond
3) Performance Bond (125% of Bid Amount)
4) Certificate of Insurance naming the City of South Bend as an additional insured
5) Item #4 for all subcontractors that you use

Dear Mr. Longerot:
At its March 23, 2021 meeting, the Board of Public Works awarded the above referenced
bid to Midland Engineering Company, Inc. in the amount of $440,100 for the base bid plus
alternate number 1.
Please be advised that Slatile’s bid was rejected as being non-responsive. A MWBE goal
of 2.7% was set for this project. Slatile Roofing did not meet the MWBE goal and disclosed that
no advertisement was placed in a general circulation and/or trade association publications
concerning subcontract opportunities, while indicating on the Minority and Women Business
Enterprise Form [MWBE 2.0] that such an advertisement was placed.

Former Salvation Army Building Roof Repairs

On February 9, 2021, the Board of Public Works opened and read bids for the above project.
A summary of the bids is below:

In accordance with I.C. § 36-1-12-4, in determining whether a bidder is responsive, the board
may consider: (a) whether the bidder has submitted a bid or quote that conforms in all material
respects to the specifications; (b) whether the bidder has submitted a bid that complies
specifically with the invitation to bid and the instructions to bidders; and (c) whether the bidder
has complied with all applicable statutes, ordinances, resolutions, or rules pertaining to the
award of a public contract. In determining whether a bidder is a responsible bidder, the board
may consider: (a) The ability and capacity of the bidder to perform the work; (b) the integrity,
character, and reputation of the bidder; and (c) the competence and experience of the bidder.
A MWBE goal of 2.7% was set for this project (note: this project was advertised before goals
were split between Minority and Women). Slatile Roofing did not meet the MWBE goal and
disclosed that they did not advertise in general circulation and/or trade association publications
concerning subcontract opportunities, while indicating on the Minority and Women Business
Enterprise Form MWBE 2.0 that they did place such an advertisement. As such, the
recommendation is that Slatile’s bid be rejected as being non-responsive with respect to this
bid. A copy of that correspondence is attached to this memo.
Midland Engineering met the MWBE goal and provided a complete, responsive bid. I
recommend award of a contract for the BASE BID plus ALTERNATE for the Roof Repairs for
Former Salvation Army Building to the lowest responsive / responsible bidder, Midland
Engineering Company, Inc. in the amount of $440,100.00. Funds have been appropriated from
River West DA TIF (PR-00008097).

Good Morning,
Here is response received back from Gerald Longerof‐President of Slatile Roofing regarding GFE. My conclusion is they
made an attempt by contacting North Coast for roofing products, but he could not provide any other business contacts. I
suggested using a local MBE vendor for removal of roofing shingles and other debris. Kennedy Express or M&L Taylor
Made Trucking service.
Hello Larry;
Thank you forwarding the memo in reference to MWBE contacts for the salvation Army roofing project.
As discussed in our conversation today, I followed up with the Slatile commercial project administrative assistant,
Michael Albert, who typically is responsible to contact and request any qualified MWBE contractors for all projects
Slatile is bidding that will require a phase of a project that Slatile will not be self performing.
I was informed by Michael that he did not place a specific newspaper ad for the Salvation Army project, because the
project is for roofing only, and Slatile would be self‐performing all the roofing work.
He did say hSlatile keeps a computer generated file on all certified MWBE contractors listed in Indiana, so he can call to
request an estimate for a specific project Slatile is bidding , which is not a portion of the scope of work which Slatile is
not self performing.
He said he did call two contractors on the list, pertaining to the Salvation Army, which are dumpster companies, but
he did not receive a reply from either of the two he called.
I did make a call to one of the Slatile roofing suppliers who in the past had been MWBE certified to furnish certain
portions of the roofing products thru a 3rd party. However I was told by the new manager that NorthCoast supply no
longer participates in the MWBE program.
In short there was no further need for Slatile to pursue a MWBE roofing company to subcontract the Salvation roofing
project to because Slatile Roofing & sheet metal Inc. was
Self‐performing all of the roofing work and the entire project was roofing only.
Slatile has very much always encouraged & hired MWBE certified contractors to participate
in any projects that Slatile does not already self perform, and continues to do so in the future.
I hope this explanation helps verify what is needed for the Salvation Army project, but please feel free to contact me
with any clarifications or questions.

HEREINAFTER called the Contractor, and the Board of Public Works herein called the "Board".
WITNESSETH: That the Contractor covenants and agrees to make the following improvement,
as fully set out in the Request for Quotations, Standard Specifications, Special Provisions, Plans,
and Bid Proposals, all of which are set forth as a part of this Contract, for:

The unit prices for this improvement were those prices as received and accepted by the Board on
the 9th Day of February, 2021.
The Contractor further agrees to notify the assigned Engineer when this improvement is
completed. This notification shall be in the form of a Project Completion Affidavit, signed by the
Contractor. Upon final acceptance of the improvement by the Engineer, the Contractor’s final
estimate will be presented to the Board for final Payment with one (1) copy of the Project
Completion Affidavit and one (1) copy of a Waiver of Lien.
Each of the Parties, by signing below, represents and warrants to the other Party that he/she/it has
the authority to bind the named person or entity to this Agreement.
