Home My WebLink About05/07/08 Board of Public Safety MinutesPUBLIC AGENDA SESSION ME The Board of Public Safety met in the Public Agenda Session at 8:03 a.m. on Wednesday, May 7, 2008 with President Donald Alford present. Board Members Juanita Dempsey, Patrick D. Cottrell, Bruce I. BonDurant, and Jack Reed were present. Also present were Police Chief Darryl Boykins, Fire Chief Howard Buchanon and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13"' Floor County City Building,, South Bend, Indiana. Board members discussed the following items from that list: Addition to the Agenda - Police Department - Bequest for Retirement Mr. Bodnar informed the Board of an addition to the agenda of a request for a retirement for Corporal Tony Macik. Mr. Bodnar noted that Corporal Macik has been on the force less than twenty years, so is subj ect to retesting at the discretion of the State, should he desire to return to the department. Martial, C16rl,- REGULAR MEETING MAY 7, 2008 The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, May 7, 2008, with President Donald Alford and Board Members Juanita Dempsey, Bruce I BonDurant, Patrick D. Cottrell, and E. Jack Reed present. Also present were Police Chief Darryl Boyl,-,ins, Fire Chief' Howard Buchanon and Board Attorney Thomas Bodnar. The meeting was held in the board of Public Works Meeting Room, 13"' Floor, County City Building, South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS President Alford advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Police Selection Panel, Executive Session, and Regular meetings of the Board held on April 16, 2008, and the Police Selection Panel and the Special Meeting of April 21, REGULAR MEETING 2008 would be accepted and approved. FIRE DEPARTMENT ACCEPT AND APPROVE REQUEST FOR PROMOTIONS - GRANT BAKER In a letter to the Board, Chief Buchanon recommends the promotion of the above listed Firefighter's ZD to I st Class Firefighters. In his letter Chief Buchanon stated these promotions will be effective May 25, 2008 in conjunction with satisfactorily completing one year on the job. Upon a motion by Mr. BonDurant, seconded by Mr. Cottrell and carried, the request for the promotions was accepted and approved. ADOPT RESOLUTION NO. 29-2008 — COMMENDATION FOR MEMBER OF C-SHIFT, ENGINE 4 U])on a motion made by Mr. BonDurant, seconded by Mr. Cottrell and carried, the following Resolution was adopted by the Board of Public Safety: RESOLUTION NO. 29-2008 Commendation for Tracey Cannady Member of C-Shift Engine 4 'WHEREAS, the Board of Public Safety wishes to issue a commendation to an individual that performed a meritorious service on behalf of the citizens of this community; 'WHEREAS, such service shall be recognized by the Board of Public Safety and an appropriate commendation shall be presented to the individual performing the meritorious service-, NOW, THE REFORE, BE IT RESOLVED, that commendation is given to: Engineer Tracey Cannady t_� RE GULAR MEETING MAY 7, Be it further resolved that Engineer Tracey Cannady, be commended and recognized for his quick actions, dedication, and professionalism. Martin, Clerk RESOLUTION NO. 31-2008 A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA, APPOINTING AN AGENT/NEGOTIATOR TO REPRESENT THE BOARD OF PUBLIC SAFETY( FOR THE UPCOMING FIRE DEPARTMENT NEGOTIATIONS WHEREAS, the Board of Public Safety has the "exclusive control over all matters and property relating" to the Fire Department pursuant to Indiana Code §36-8-3-2(b)(2); and WHERE-AS, pursuant to Indiana Code § 36-8-3-3(d), the Common Council has until September 30, 2008 the exclusive authority to fix by ordinance the annual compensation for 0 members of the South Bend Fire Department before; and WHEREAS, the Common Council and the City Administration have for the last twenty (20' ) years agreed upon a Chief Negotiator or Negotiating Team to negotiate with South Bend Firefighters Local 362 concerning such items as annual compensation, monetary fringe benefits, working conditions, and other items related to the South Bend Fire Department, all of which negotiations resulted in an agreement; and WHERE-AS, the South Bend Common Council has already passed Resolution 3861-08 naming Kathleen Cekanski-Fai rand as the Council's Chief Negotiator; and WHERE-AS, the 2005-2008 Collective Bargaining Agreement between the City of South Bend and the South Bend Firefighters' Association Local No. 362 of the International Association of Firefighters AFL-CIO expires at the end of this year, along with Ordinance No. 9620-05, which establishes salaries and other animal compensation for members of the South Bend Fire Department for calendar years 2006 through 2008; and WHEREAS, mindful of past successes when there is a joint negotiating team or joint advisory team, the Board of Public Safety desires to appoint a Chief Negotiator who would appoint his or her own advisory City Negotiating Team to represent it and to provide updates during executive sessions called for the purpose of discussing strategy with regard to collective bargaining pursuant to Indiana Code § 5 -14-1.5 -6 . I (b)(2)(A); and REGULAR MEETING MAY 7, 2008 WHEREAS, the Advisory City Negotiating Team shall not be considered a "governing body" or "public agency" under Indiana Code § 5-14-1.5-2; and WHEREAS, the City of South Bend Administration and the Board of Public Safety believe that this Resolution is in the best interest of promoting positive and harmonious labor negotiations. -NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Safety of the City of South Bend, Indiana, as follows: Section II. Ever respectful of the Common Council's legitimate interest with respect to , an aitial compensation, Mr. Leone shall attempt to coordinate with Mrs. Cekanski-Farrand strategy, negotiation times, scheduling of executive sessions, advisory team membership, and other matters pertaining to negotiations. Section III. This resolution shall be in full force and effect from this date until a Collective Bargaining Agreement is signed by this Board or until October 1, 2008, whichever occurs first. Mr. Leone shall be the City's Chief Spokesperson and Negotiator concerning all matters related to the working conditions and other matters addressed in the Working Agreement except the annual compensation of the Police Officers. Section 11.
