I. Call to Order- The IPC Board is now called to order on February 2, 2021 @ 5pm

V. Keana Baylis- Brief Introduction
Keana gave a brief introduction
VI. Diversity of Inclusion- Michael Patton
o 2019 Inclusive and Procurement Report (for additional information review
report; document was sent to board)
● Finance, legal, and public works worked to pull the report together
● Provides brief description of City of South Bend
● Overall and Annual Spend is a large portion of the report
○ BPW Construction-total MBE annual spend was $0.00
■ Want to increase these numbers for year 2021
■ Recognize these are only prime contractors
■ Goal is to increase within the next 4 years
○ Board recognizes the good work of collecting information
○ Increase between 2018-2019, a specific contract lended to the
significant growth

VII. Board of Public Works- Kara Boyles
● 1st Quarter: Projects
○ Bid for roof repairs at salvation army building (composite goal: 2.7%)
■ NAICS Code is used for calculation, as well percentage is based
on disparity study, contractors in geographic marketplace (State of
Indiana)
○ Intersection improvement sample and mayflower(composite goal: 7.2%)
○ Streetscape project, South Michigan St. (composite goal: 7.3%)-is in
progress
○ Tracking around 25 potential projects in 1st and 2nd quarter
VIII. Procurement- Michael Schmidt
January MWBE Spend Report
● January is a slow month
● PO System is opened in the 2nd week of January
● $148,000 total that has been spend of that over 50% towards (premium
concrete services-women owned business)
● New Black Owned Business-Right Quality Office Supplies-based in
Kokomo, IN
● City maintaining relationship with Carothers Printing, spent at least
$20,000.
● New Toys Leisure (Women Owned) under $40,000 spent by city-VPA
purchased playground equipment
IX. Old Business-
o Goal Waiver & Good Faith Efforts Procedure/Process- Larry King
● Definitions of goal waiver & Good faith
● Provides more detail of what happens when you get to goal waiver
& good faith effort.
● New process is consistent with contractors being able to request
goal waivers
● Accept a contract that is based on good efforts
● Will be implemented in the new ordinance immediately.
● Review Section 8b 3d of document that outlines the process in
which the waivers are governed.
Ordinance Definition:
Goal Waiver means a petition process whereby a contractor can seek
partial or complete relief from a contract goal it is unable to meet despite
having made good faith efforts to do so.

Good Faith Efforts means actions undertaken by a contract goal, which,
by their scope, intensity, and appropriateness to the objective, can
reasonably be expected to fulfill the Program’s goals.
o Amended Ordinance- Michael Patton
*Ordinance previously approved November 12, 2019.
● New ordinance reflects new geographic footprint based on amended
disparity study
● Addressed who will be a board member (1 member appointed by the
AFL-CIO Chapter)
● Definition of women has been included (city accepting any woman owned
business who comes with a certification)
i. Confirm if the Amendments to the Ordinance have been approved by the
Common Council
o If the board approves the new ordinance it will be sent to council with
favorable recommendations
● All board members review the ordinance and provide feedback by March
meeting in public forum
● Provide the ordinance with track changes to clearly show the adjustments
● Formal presentation will be at next meeting
