ORDINANCE NO. 7AW,2-ff t AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND BY AMENDING THE DEFINITION OF "FLOODPLAIN" STATEMENT OF PURPOSE AND INTENT A review was made of the City of South Bend's Floodplain Ordinance by the staff of the Division of Water, Indiana Department of Natural Resources of the State of Indiana. As a condition of continued eligibility in the National Flood Insurance Program, the City of South Bend has been directed to amend or supplement existing floodplain management measures to incorporate the modified flood regulations to comply with Section 60. 3 (d) of The National Flood Insurance Program Regulations. The following ordinance brings the City of South Bend into compliance with the federal requirements. NOW, THEREFORE, be it ordained by the Common Council of The City of South Bend, St. Joseph County, Indiana, as follows: SECTION I . Chapter 21, Article 1, Section 21-i of the Municipal Code of the City of South Bend, Indiana, is hereby amended by deletion of sub-section (a) (22 .5) in its entirety and by the substitution of new subsection (a) (22 .5) Which shall read in its entirety as follows: {a}{22-5} Floodplain-means-tie-area-adjoining-a-river ar-streamT-which-has-been-or-which-may-hereafter-be €leoded7-se-designated-in-tie-'!Fleed-Insurance-Study for-t ie-City-af-South-BendT-IndianaT!'-dated-February 17-19787-prepared-by-the-Federal-Insurance Administration: (a) (22 . 5) "Floodplain" means the area adjoining a river or stream which has been or which may here- after be flooded, so designated by the Federal Insurance Administration on the Flood Insurance Rate Maps, Flood Boundary and Flood Maps and Flood Insurance Study dated February 17, 1988, along with any subsequent revisions hereby adopted by reference. SECTION II . This Ordinance shall be in full force and effect from and after February 17, 1988, its passage by the Common Council, approval by the Mayor and publication as required by law. " It is my understanding in talking with the Council Attorney that this ordinance is required to keep the City in compliance with the National Floodplain Insurance Program regulations set forth by the federal government. It is my further understanding that the actual definition proposed in the attached bill was approved by the Area Plan Commission at its meeting of December 15, 1987 (copy attached of the Area Plan recommendation) . Unfortunately, the actual bill was never filed by Area Plan with the City Clerk's office. As a result, the Council Attorney has drafted the attached bill for Council approval. The bill should be set for first reading on Monday, January 25 and have public hearing before the Common Council on Monday, February 8. I look forward to discussing this bill with you at an upcoming meeting of the Zoning and Vacation Committee. Thank you. The Area Plan Commission gave it a public hearing on December 15, 1987, at which time the following action was taken: Upon a motion by Rene Vandewalle, being seconded by William Limerick and unanimously carried, the proposed ordinance initiated by the Area Plan Commission Amending Chapter 21, of the Municipal Code, as amended, commonly known as the Zoning Ordinance of the City of South Bend, Indiana, by revising the definition of Floodplain is sent to the Common Council with a favorable recommendation The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report.
