JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT A Bill to voluntarily annex into the City of South Bend, Indiana has been filed for lots 8 and 9 of the Town of Schroederville which is contiguous to the City limits. That Bill should be heard by the Common Council on September 12, 1988. The land in question would then be subject to this requested rezoning of "B" Residence District (Sec. 21-12) and "B" Height and Area District (Sec. 21-53 et seq. ) It is believed that the proposed rezoning is the highest and best use for the area in question. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Ordinance No. 4990-68, as amended which is the Zoning Ordinance of the City of South Bend, Indiana, is hereby amended in order tha the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana, Lots 8 and 9, Town of Schroederville, Clay Township, St. Joseph County, Indiana, which is to be voluntarily annexed into the City of South Bend, Indiana, be and hereby established as "B" Residential, "B" Height and Area. SECTION II. A separate Bill annexing voluntarily into the City this property has also been filed. If that Ordinance is acted upon favorably by the Council, the attached Bill could then be heard by the Area Plan Commission and the Common Council later this year. The Area Plan Commission gave it a public hearing on November 15, 1988 at which time the following action was taken: Upon a motion by Robert Lehman, being seconded by Joseph Serge and carried, with Lee Slavinskas and Chuck Sausman abstaining, the proposed ordinance initiated by Councilman Lee Slavinskas to zone from "A" Residential, to "B" Residential, "B" Height and Area, property located on the east side of Ivy Road, approximately 525 feet north of Edison Road, City of South Bend is sent to the Common Council with a favorable recommendation. The recently annexed property is joined to the City by property presently zoned "B" Residential and "C" Commercial. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. ACTION: The petitioner is requesting a zone change from "A" Residential to "B" Residential , "A" Height and Area to allow uses permitted in the "B" Residential District. EXISTING LAND USE: The property contains a single-family home. SURROUNDIYdG LAND USE AND ZONING: Located to the north is a single-family home in the County zoned "R" Residential ; to the east is a single-family home in the City zoned "B" I Residential and Jamison Inn zoned "C" Commercial ; to the south is a single-family home in the County zoned "R" Residential ; and to the west across Ivy Road are single-family homes in the County zoned "R" Residential .
